RE: Permit #14-101410-00-AD; S 320TH STREET PRESERVATION PROJECT — NIGHT WORK
Dear Jeff,
The Community and Economic Development Department bas received your March 28, 2014,
memorandum requesting a work hour variance for construction activity on South 320t' Street from 11t'
Place South to Interstate 5. Proposed work activities include grinding and paving asphalt concrete
pavement; removing and replacing curbs, gutters, sidewalks and islands; upgrading wheel chair ramps;
and installation of Dura Stripe pavement markings. Due to the scope of the project, construction activity
is expected to take place daily from April to July of 2014. In order to shorten the duration of the project
and limit impact to the public, you have requested to work outside of normally -approved hours. As such,
you are requesting relief from Federal Way Revised Code (FWRC) 19.105.040, "Regulation of Work
Hours." The proposed work schedule follows.
PROPOSED WORK SCHEDULE
Monday night through Friday morning (nightly)
8:00pm to 7:00am
Friday night to Saturday morning
8:00pm to 9:00am
Saturday night to Sunday morning
8:00pm to 9:00am
WORK HOUR EXCEPTION
Pursuant to FWRC 19.105.040, work hours are permitted outright between the following hours:
7:00am and 8:00pm Monday through Friday
9:00am and 8:00pm Saturday
Development activities and heavy equipment operations are not permitted on Sundays or holidays
observed by the city. However, the director of community and economic development may grant
revocable written permission to engage in development activity other than the above permitted times, in
accordance with FWRC 19.105.050(2)(a):

SUBJECT: S 3201h Street Preservation Project from I I'h PI S to I-5 Limited Access
Night and Weekend Work Hours Waiver
DATE: March 26, 2014
During the construction of the S 3201h St Preservation Project, Miles Resources, LLC, will be grinding and paving asphalt
concrete pavement, removing and replacing curbs, gutters, sidewalks and islands, upgrading wheel chair ramps to meet
American with Disabilities Act (ADA) and installation of Dura Stripe pavement marking on S 320" St from 11 Sh PI S to I-
5 Limited Access.
The project lies within mixed zoning. The street is fronted by The Commons at Federal Way and businesses within the
downtown business district. Second row development is a mixture of hotels and a church. In order to shorten the
duration of the project and minimize the construction impacts to The Commons at Federal Way, businesses and public,
the contractor may elect to work nights and weekends.
For these reasons we request a night and weekend work hours waiver as follows:
Monday night through Friday Morning (nightly)
8:00 p.m. to 7:00 a.m.
Friday night to Saturday morning
8:00 p.m. to 9:00 a.m.
Saturday night to Sunday morning
8:00 p.m. to 9:00 a.m.
We further request that public notification requirements be waived. Project information signs will be posted at each end
of the project on S 320'h St. Weekly construction schedule updates will be posted on the City web page and e-mailed to
all interested persons.
We anticipate project construction will begin in April 2014 and the need for the waiver will extend through July 2014.
Please issue a construction work hour waiver to the Public Works Department for the S 320'h St Preservation Project
allowing night work through the months listed. If night work is requested outside this listed window, the contractor will
apply for a waiver covering the times needed based on the requirements of City Code 19.105.040. This waiver is
revocable at any time.
