The NGPE document recorded under King County recording number 8810271104 allows vegetation within the easement to be cut, pruned, covered with fill, removed, etc., with written approval of the King County Building and Land Development Division or its successor agency, which in this circumstance is the City of Federal Way. Relief from the NGPE provisions is based on the public nature of the WSDOT Triangle project. This letter only grants relief from the provisions of the NGPE document. This correspondence does not grant City approval of any critical areas or critical area buffer intrusions and impacts. Pursuant to Federal Way City Code Chapter 22, Critical Areas, compliance with critical areas regulations is required. A separate master land use application in compliance with FWCC standards is required for critical areas impacts or critical area buffer impacts. Triangle Project Description: The I-5 - SR 161/SR 18 Interchange Improvement project, also known as the Triangle Project, will improve safety and travel times at one of the most dangerous and congested freeway interchanges in the state. Located in Federal Way, the I-5/SR 18 cloverleaf interchange is defined as a High Accident Location. As part of this project, WSDOT will reconstruct the I-5/SR 18 interchange. The reconstruction includes replacing two cloverleaf loop ramps with flyover ramps for westbound SR 18 to southbound I-5 traffic and eastbound SR 18 to northbound I-5 traffic. Removing these loop ramps will improve safety by eliminating the current weave situation caused by closely spaced on and off ramps on I-5 and SR 18. WSDOT will provide direct access to SR 161 from southbound I-5 and westbound SR 18 by building new exit ramps at S. 356th Street and S. 359th Street. These improvements will improve traffic flow and safety at this increasingly congested interchange. In addition, the project will construct a collector -distributor on the west side of the interchange connecting southbound 1-5 and westbound SR 18 directly to SR 161. A portion of the Triangle Project area is currently owned by Costco. The Costco land is limited by a Native Growth Protection Easement (NGPE); WSDOT will be permanently acquiring 817 square feet of land from Costco, part of Parcel # 2192600180. The strip of land to be acquired will be purchased via fee acquisition and measures 4.75' in width by approximately 172' in length (a total of 817 square feet). I. Permanent Impacts: In the project design, the 817 square feet to be acquired will be permanently impacted to provide maintenance access via a 10' space outside of the drip line of a bridge structure. The acquisition area is currently filled with blackberries, shrubs, some trees, and includes a portion of an unnamed tributary of Hylebos Creek. As part of the project design, the stream will need to be relocated in this area. WSDOT will meet all local, state, and federal permitting requirements for the stream relocation work. WSDOT anticipates obtaining all permits for the project by Spring of 2009. •4 II. Temporary Construction Impacts Immediately adjacent to the 817 square feet purchased for maintenance access, WSDOT is requesting a construction easement from Costco for an area that is 45' in width by 172 feet in length (approximately 8496 square feet). This temporary construction area is needed to provide an access road for construction equipment, including a crane. This area is currently filled with blackberries, shrubs and some trees. Since this area is also within the NGPE, special care will be taken to remove the minimum amount of existing vegetation as possible during construction. However, to allow the crane to swing freely, some the vegetation will have to be removed. The vegetation that is removed will be replaced in kind.
