Dear Mr. Wittenberg,
The Community Development Department has completed review of your Process I Master Land Use
application for a proposed private urban farm at the above -referenced vacant parcel received on
December 14, 2017, A mailing notice was sent to abutting landowners on March 13, 2018. The Process 1
application is hereby approved with conditions per the findings noted below.
FINDINGS OF FACT
1. The subject property is located within Multi -Family Residential RM3600 - 1 Unit/3,600 square feet.
2. An urban farm is an allowed use in the RM3600 zone per Federal Way Revised Code (FWRC)
19.205.210, `Urban agriculture.'
3. The applicant is proposing to establish an urban farm on a vacant 15,478 square -foot parcel.
4. An urban farm may locate.planting areas, including raised beds, within required yards (front yard —
twenty feet; side yard —five feet (measured from the access easement); and rear yard —five feet) per
FWRC 19.205.210; note 6(a). This use does not require perimeter landscape buffers as outlined in
FWRC 19.125-060.3.
5. There are no proposed improvements or structures.
6. The applicant does not propose the keeping of animals pursuant to FWRC 19.125.060.
7. The subject property is Iocated in the Tacoma Smelter Plume detect area Containing 20.1 ppm to 40.0
ppm arsenic concentration. The applicant may conduct soil testing during clearing actions at the
request of the Department of Ecology's Voluntary Clean -Up Program.
8. The proposed upgrades will not create new impervious area; do not reduce the amount of required
landscaping, parking, buffering, open space, or public areas.
Lakehaven Water and Sewer District is the water and sewer service provider. The applicant proposes
no utility connections at this time.

10. Pursuant to FWRC 19.262.030.1.b `Community gardens and urban farms,' on March 13, 2018, staff
mailed written notice of the land use proposal to property owners Within 300 feet of the subject
property's boundaries. The city did not receive any written comments on this application, but did
receive two inquiries.
CONDITIONS OF APPROVAL
The following conditions are reasonably necessary to eliminate or minimize undesirable effects of
granting application approval.
The applicant shall utilize erosion and sediment control best management practices (BMPs)
during tree and vegetation removal and until the site is stabilized.
Direct construction and/or truck access onto Military Road South is prohibited.applicant
The applicant shall retain a minimum of 11 tree units on the subject property; the a pp
removes all the trees on site, the applicant shall submit a replacement planting plan to the city for
Planning Division review.
Only mechanical equipment designed for household use may be used.
Fertilizer, pesticides, and other chemicals used must be typical of household use only.

writing (assuming you do not wish to appeal this decision). Waiver of the right to appeal does not affect
the effective date of this decision.
CLOSING
This land use decision does not waive compliance with future City of Federal Way codes, policies, and
standards relating to this development. This Process I approval does not constitute approval of a building
permit. As noted above, this decision is not intended to approve signage depicted in the submitted

kept clear for townhome residents and emergency vehicle access at all times.
