The Community Development Department has received your Process I Master Land Use (MLU)
application for removal of an existing swimming pool and replacement with construction of a children's
play area and picnic area at Crestview West Apartments, located at 27900 Pacific Highway South. The
Process I application is hereby approved based on conclusions and findings below.
CONCLUSIONS
Various sections of the zoning and development code indicate that certain developments, activities, or
uses are permitted only if approved using Process I — Director's Approval. Based on the findings below,
the proposed improvements to the developed site meet the Process I approval criteria and land use review
thresholds of Federal Way Revised Code (FWRC) 19.15.030 and 19.55.020:
1. The proposed improvements are consistent with applicable chapters of FWRC Title 19 including,
but not limited to: Permits and Review Processes; Process I — Director's Approval; and FWRC
Zone Use Chart 19.205.040 Detached or stacked dwelling units (RM1800).
2. The health, safety, and welfare of the citizens of the city and the housing complex are preserved.
3. The proposal is a minor improvement, modification, or addition to a site that is exempt from State
Environmental Policy Act (SEPA) review.
FINDINGS
The zoning for the site is Residential Multi -Family (RM 1800). The existing multi -unit housing complex
is a permitted use.within the RM1800 zone pursuant to FWRC 19.205.040. The recreation area
modifications are considered a minor improvement to the existing site, and therefore reviewed as an
administrative land use process pursuant to FWRC Chapter 19.55, `Process I — Director's Approval.'
The proposed recreation area modifications do not trigger non-conformance review of the existing site
improvements under FWRC 19.30.090. In addition, the proposed modifications to the recreation area
result in the same area (quantity) of recreation improvements on the site, and the quantity and type of
recreation areas on the site are no more and no less nonconforming as a result of the proposed
modifications.
The location of the recreation area is in the central interior of the site. The proposed improvements do not
exceed allowable building heights, require no additional parking, does not reduce the amount of required
landscaping, parking, buffering, or screening, and does not change pedestrian connections or easements.

REVIEW BY OTHER DIVISIONS / DEPARTMENTS
The owner is required to follow the guidelines of the 2009 King County Stormwater Pollution Prevention
Manual Activity Sheet A-33 (enclosed) for the proper disposal of the pool/ spa water as required by the
Public Works Development Services Division.
A demolition permit from the City of Federal Way Building Division is required for the pool demolition.
The Building Division requires a Geotechnical Engineer to do a compaction test and provide that
inspection report to the City at final inspection.
APPEALS
The effective date of this decision is February 15, 2016, or three days from the date of this letter. Pursuant
to FWRC 19.55.150, any person who received notice of the administrative decision may appeal this
decision to the Federal Way Hearing Examiner by February 29, 2016 (14 days after effective date). Any
appeal must be in the form of a letter delivered to the Department of Community Development with the
established fee. The appeal letter must contain a clear reference to the matter being appealed and a
statement of the alleged errors in the Director's decision, including the identification of specific findings
and conclusions made by the Director disputed by the person filing.
In that you are the only party of record, your appeal period is waived (assuming you do not wish to appeal
this decision). Waiver of the right to appeal does not affect the effective date of this decision.
CLOSING
This land use decision does not waive compliance with fiiture City of Federal Way codes, policies, and
standards relating to this development. This Process I approval does not constitute approval of a building.

Our only comments on this project are that they need to follow the guidelines of the 2009 King County Stormwater
Pollution Prevention Manual, Activity Sheet A-33 (attached), for the proper disposal of the pool/spa water.
(Hopefully, if they've already drained the pool, they followed these guidelines.....)

It is my understanding that the applicant will punch holes in the bottom of the pool and then place some structural fill in
the pool. The building department would want a Geotechnical Engineer to do a compaction test and offer that report to
us at final inspection. We would just require a demo permit.
