Dear Ms. Ray:
On February 5, 2020, the City of Federal Way's Department of Community Development received your
zoning inquiry regarding the property located at 28620 Pacific Highway South, Federal Way, WA 98003
(parcel #332204-9042). Your request for information includes questions listed below in bold, with the city's
response following.
1. What is the current zoning classification for subject properties?
The current zoning classification for the subject properties is Multifamily Residential (RM 1800).
2. What are the adjacent zoning designations?
North: lylultifamily Residential (RM 1800)
South: 1vlultifamily Residential (RM 1800) & Community Business (BC)
East Multifamily Residential (RM 3600)
West Community Business (BC)
3. What municipal code is the subject property currently regulated by?
The subject properties are a "Permitted Use by Right," currently regulated by Federal WI/ay Revised Code
(FWRC) Title 19, "Zoning and Development Code," Chapter 19.205, "Multifamily Residential (RM),
19.205.040, 111vIultifamily dwelling units."
4. To the best of your knowledge, what were the conditions of the subject properties when developed?
The subject property was developed in 1946 under the Ding County zoning code, prior to Federal Way's
incorporation as a city and the adoption of the initial Federal Way City Code (PWCC). Any legal permitted
aspects, elements, activities, or uses on the subject property that does not conform to the FWRC would
be considered legal nonconforming. Typically, the city determines a site's nonconformance as part of
formal review of a specific development proposal that will alter the e:dsting nonconforming site. At this
time, a site inspection and fitil noncompliance analysis will be required in order to identify any applicable
requirements of the FWRC. The immediately identifiable nonconformance is that the property does not
have the required 1,800 square feet of lot area per dwelling unit as 136,800 square feet are required for
the 76 dwelling units, but the lot itself is only 112,312 square feet.

5. Were the above properties granted any Use Permits, Variances, or Special Exceptions?
The city is not aware of any use permits, variances, special exceptions, or any other site specific approved
development conditions that may have been applied to the subject properties at times of construction.
6. In the event of casualty, in whole or in part, can the structures located on the subject properties
be rebuilt?
The structures located on the subject properties are legally nonconforming and regulated by FWRC
19:,30, "Noncbnfo�mance." Per FWRC 19.30.200, the nonconforming development may be
reconstructed in the event of damage by sudden accidental cause, as long as the reconstruction is not any
more nonconforming than it was immediately prior to the damage and all associated building and land
use reconstruction permits are submitted within six months of the date of the damage and reconstructs
pursuant to such permits.
7. To the best of your knowledge, are there any records that show unresolved code violations?
According to the city's database, there do NOT appear to be any outstanding/open zoning or building
code violations that apply to the subject properties. With regards to fire code violations, South King Fire
& Rescue handles fire related records requests. We encourage you to contact the Public Records Officer
Lauri Perry at lauri.perrT,{x southlangfire.org, or 253-946-7253, to obtain information pertaining to fire
code violations.
8. Status of Certificate of Occupancy?
King County was the applicable zoning and building authority at the time of construction for this
property. We encourage you to contact the King County Department of Permitting and Environmental
Review (DPER) Records Center at dperrecords@kingcounty. og_v, or 206-296-6696, to obtain the
Certificates of Occupancy or site plans. You will need to provide them with the parcel numbers
pertaining to these properties. A certificate of occupancy will not be required by this agency unless
applications for building permits are received.
