Dear Mr. Nam:
This letter responds to your request to waive the required street improvements along 16" Avenue S.,
which abuts the above -referenced property. After evaluating the existing conditions along the referenced
street, review of Federal Way Revised Code (FWRQ Section 19.135, and direction provided by the City
Council, the Public Works Department hereby modifies the requirements for the street improvements.
Code Section (FWCC) 19.135.070; Modifications of Improvements Along Property Frontage allows the
Public Works Department to grant a request to modify the required street improvements only after
consideration of four specific reasons. The reason most applicable here is contained in FWCC Section 19-
135.070(2), "Unusual topographic or physical conditions preclude the construction of the improvements
as required."
16'h Avenue S is classified as a collector street, corresponding to Federal Way Roadway Section "R". This
roadway section requires, From centerline, a twelve -foot travel lane, eight -foot parking strip, a four -foot
planter strip, a six-foot sidewalk, and a three-foot utility strip, all within a sixty six-foot right-of-way.
Application of the required street improvements would result in an improved street section that is not
harmonious with current or Future road improvements to the south, which are constrained by existing
topography, structures, and above -ground utilities. The required road section is hereby modified to
include, from centerline: a twelve -foot paved travel lane, four -foot planter Strip, six-foot'sidewalk, and
three-foot utility strip all within twenty-five Feet of right-of-way. The eight Foot parking strip is no longer
required.
The conditions of this right-of-way modification will be applicable for a period of one year from the date
of this letter. If a building permit is not issued within the one-year time limit, this modification will be
void and a new request for modification must be submitted.
