The Department of Community Development has completed review of the Accessory Dwelling Unit
(ADU) application submitted to the city on September 7, 2017. The ADU application is hereby approved
pursuant to the findings presented by the department's Planning Division staff and the conclusions based
on those findings.
FINDINGS OF FACT
The following findings are based on site, elevation, and floor plans received with the ADU application on
September 7, 2017:
1. Proposal — The applicant proposes to construct an attached ADU within an existing single-family
house located at 29628 1" Avenue South, Federal Way. The ADU is located in the unfinished
basement of the house and no change in the footprint is proposed.
2. Zoning —The subject property is a 13,939 square -foot (032-acre) lot with a Single -Family
Residential (RS9.6) zoning designation. The proposal meets the minimum lot size requirement per
Federal Way Revisecl Code (FWRC) 19.200.180, Note 1.
Lot Coverage — There is no change in the lot coverage.
4. Floor Plan — The total square footage of the proposed ADU living area is 793 square feet, including a
living room, kitchen, bathroom, and two bedrooms. There is a recreation area in the basement that is
not included as part of the ADU. The principal dwelling unit contains 3,691 square feet of livable
area; therefore, the proposed ADU complies with the maximum allowable livable area, which is 40%
of the living area in the primary dwelling unit. The proposal also will not exceed the maximum
accessory dwelling unit size of 800 sq. ft. (FWRC 19.200.180, Note 9).
5. Parking — The site plan depicts an existing three -car garage and concrete driveway. As such, there is
sufficient amount of parking for the required one on -site parking for the ADU.
Required Yards & Height —The proposed ADU is located within the basement of the existing house,
which meets all the current setback and height requirements.
7. Water & Seiver— Lakehaven Water and Sewer District issued Certificates of Water and Sewer
Availability on September 6, 2017. The existing 8" diameter sewer main has capacity to serve the

proposed land use; a Sewer Service Connection Permit is required. Water service can be provided by
service connection to an existing 6" diameter water main; a Water Service Connection application is
required.
8. Owner Occupancy —The applicant has submitted a signed letter of application and deed restriction
stating the owner shall occupy one of the two dwelling units as a permanent residence •for six months
or more of the calendar year. The owner will occupy the primary dwelling unit. When the ADU is
completed, the applicant must record the Letter of Application and Deed Restriction with King
County and provide a copy of the recorded document to the City.
CONCLUSIONS
The following conclusions are based on the above findings of fact.
1. The proposal is consistent with policies of the Federal Way Comprehensive Plan.
2. The proposal meets density, square footage, parking, occupancy, and dimensional requirements of the
ADU Use Zone Chart within Federal Way Revised Code (FWRC) 19.200.180.
3. The ADU is subordinate and incidental in size, scale and design of the primary dwelling unit, and the
appearance remains that of a single family residence.
CONDITION OF APPROVAL
Prior to the final building inspection of the new ADU, please record the enclosed Letter of Application &
Deed Restriction with the King County Recorder's Office, and return a copy to the City with the enclosed
resubmittal form.
BUILDING PERMIT REQUIRED
This ADU decision does not constitute building permit approval. Building permit #17-104332-00-SF for
the ADU is under review by City staff. Final inspections for the completed ADU will be conducted as
part of a building permit process associated with this project.

This administrative ADU decision does not waive compliance with future City of Federal Way codes,
