Dear Applicant:
The Community and Economic Development Department bas received your Process I Master Land Use
(MLU) application to construct a CMU compactor enclosure. The Process I MLU application is hereby
approved pursuant to conclusions based on findings made by the department's Planning Division.
FINDINGS
The zoning for the site is Multi -Family Residential (RM2400). The existing Cove East Apartments are an
allowed use in the RM2400 zone per Federal Way Revised Code (FWRC) 19.205.040 The new trash
compactor and enclosure was reviewed as an administrative land use process pursuant to FWRC Chapter
19.55, `Process I — Director's Approval'.
The proposed compactor enclosure is 8 feet 8 inches tall installed on a new concrete slab. The
construction is a solid screen CMU wall with gate. Additionally, due to the location of the proposed
enclosure and existing mature vegetation/landscaping along the right-of-way, the proposed compactor
enclosure does not require additional screening.
The enclosure does not reduce the amount of required landscaping, buffering, open space, parking, or
public areas; and does not alter pedestrian connections, utilities, or easements.
RECOMMENDATION
The City's Surface Water Management Division has found that trash compactors will eventually, over
time, leak liquids and/or hydraulic fluids, which then get washed into the City's storm drain system in
violation of the City's NPDES permit and water quality standards, and then becomes an enforcement
action by the City against the property owner.
While not required, we strongly encourage the owner to provide a roof over the compactor, provide a
drain in the slab that the compactor will rest on, and connect that drain to the sanitary sewer system (with
Lakehaven Utility District approval), in order to avoid future water quality violations, enforcement
actions and/or fines.

If sewer service connection for the proposed trash enclosure area is provided, then a Lakehaven sewer
service connection permit (SSCP) & Discharge Agreement (DA) will be required. The design guidelines
are enclosed for reference.
ADDITIONAL PERMIT ISSUANCE REQUIRED
The city's Building Division is currently reviewing the building permit for the compactor enclosure (file
#13-104997-00-CO). Please contact the permit center at 253-835-2607, or
permitcenter@cityoffederalway.com, if you have any questions regarding the permit.
APPEALS
The effective date of this decision is December 13, 2013, or three days from the date of this letter.
Pursuant to FWRC 19.55.150, any person who received notice of the administrative decision may appeal
this decision to the Federal Way Hearing Examiner by December 27, 2013. Any appeal must be in the
form of a letter delivered to the Department of Community and Economic Development with the
established fee. The appeal letter must contain a clear reference to the matter being appealed and a
statement of the alleged errors in the Director's decision, including the identification of specific findings
and conclusions made by the Director disputed by the person filing.
In that you are the only party of record, your appeal period is waived (assuming you do not wish to appeal
this decision). Waiver of the right to appeal does not affect the effective date of this decision.
CLOSING
This land use decision does not waive compliance with future City of Federal Way codes, policies, and
standards relating to this development. This Process I approval does not constitute approval of a building,
