We hope that the information discussed at that meeting was helpful in understanding the general requirements for your project as submitted. This letter summarizes comments given to you at the meeting by the members of the DRC. The members who reviewed your project and provided comments include staff from the City's Planning and Building Divisions and Public Works Department, and representatives from Lakehaven Utility District and South King Fire and Rescue. Some sections of the Federal Way Revised Code (FWRC) and relevant information handouts are enclosed with this letter. Please be advised, this letter does not represent all applicable codes. In preparing your formal application, please refer to the complete FWRC and other relevant codes for all additional requirements that may apply to your project. PROJECT DESCRIPTION Proposal to subdivide one existing single-family residential parcel into three single-family residential parcels. DEPARTMENT COMMENTS Outlined below are the comments made by the representatives of each department present at the preapplication conference. Each section should be read thoroughly. If you have questions, please contact the representative listed for that section. Mr. Kirkebo Page 2 October 25, 2013 PLANNING DIVISION (Matthew Herrera, 253-835-2638, matt.herrera@cityoffederalway.com) Comprehensive Plan and Zoning Designation — The city's comprehensive plan designation for the subject property is Single -Family Residential — High Density. The property is currently zoned RS 7.2. The minimum lot area for residential lots in RS 7.2 zones is 7,200 square feet. 2. Procedural Information — Short subdivision review is administrative. The department will issue a complete application letter and/or request for additional information within 28 days of receiving the short subdivision application. Vesting of the proposed short subdivision shall take place at the time of complete application. A notice of application with an accompanied two -week comment period is required prior to preliminary approval. Preliminary approval is granted by the city's Director of Community and Economic Development. A two -week appeal period follows the director's decision. Prior to construction of short plat improvements, engineering approval must be granted by the Public Works Department. Please see Kevin Peterson's comments for specific information regarding engineering requirements. 3. Short Plat Content Requirements — For an itemized list of required information to be included in the f short plat, please refer to the enclosed bulletin. The city's Subdivision code (Title 18) and Zoning and Development code (Title 19) can be accessed from hM://www.codepublishing.com/WA/FederalWav,. 4. State Environmental Policy Act (SEPA) — Short plat applications are typically exempt from the requirements of SEPA review. Public Notice — The city will prepare and post a notice board on the subject property. Copies of the Notice of Application will also be posted at the city's designated public notice areas and published in the Federal Way Mirror. If the proposal will require SEPA review, the applicant is responsible for acquiring mailing labels and providing postage paid envelopes for property owners within 300 feet of the subject property for the environmental determination. 6. Critical Areas — The city's critical areas map has identified a geologically hazardous area (erosion hazard) on the far western portion of the subject property. These areas require a 25-foot setback. Soils reports will likely be required for building permits on the far lot. Opportunities to reduce the 25-foot setback are detailed in FWRC 19.160.010(2). 7. Lot Size — The zoning for the subject site is Residential Single -Family (RS-7.2). Minimum lot size for each lot is 7,200 square feet. Please be advised that any area established as an ingress/egress easement, pipestem, or access tract for each property must be deducted from the underlying parcel lot size. Please include this "net" lot area on the lot closure calculations and short plat document. Design Criteria — Short plats are subject to the subdivision design criteria set forth in FWRC Chapter 18.55. 9. Setbacks and Lot Coverage — Existing and future residences must conform to the following structural setback requirements of 19.200.010, "Detached Dwelling Units" (enclosed): front yard - 20 feet; side yard - five feet; and rear yard - five feet. Lot coverage for residential uses is limited to 60 percent and includes all impervious surfaces such as driveways, walkways, patios, and roof overhangs. Open Space — All residential subdivisions are required to provide open space in the amount of 15 percent of the gross land area of the subdivision site per FWRC 18.55.060(2). All or some of the open space requirement may be satisfied by a fee -in -lieu payment at the discretion of the parks director after consideration of the city's overall park plan, quality, location, and service area of the open space that would otherwise be provided with the project. If the fee -in -lieu option is chosen, a written request to Public Works and Parks Director Cary Roe is required. A copy of this request is a required component of the short plat application. 11. Tree Retention/Replacement — The city's tree standards require each development/redevelopment to maintain a tree unit density. The minimum tree density requirements for RS zones are 25 tree units per acre. A tree retention plan prepared by a certified arborist or a certified landscape architect detailing how the subject property will meet tree unit density requirements shall be submitted with the short subdivision application. Items required to be included in the plan are itemized in FWRC 19.120.040(2)(a) through (e). The table below identifies tree unit values for retained and replacement trees. Clearing & Grading —A clearing and grading plan addressing items listed in FWRC 19.120.040(1)(a) through 0) is required. Prior to beginning clearing and grading activities, all trees/vegetation that are to be preserved within and adjacent to the construction area shall be clearly marked and protected per guidelines prescribed within FWRC 19.120.160. 13. Administrative Fees — The current short subdivision review fee is $2,416.50. The applicant will also be responsible for transportation concurrency, engineering review (EN) fees, and King County recording fees. 14. Approval Timeline — Infrastructure and improvements associated with short plat approval shall be constructed within five (5) years of the date of approval or the decision shall expire. 15. Recording — The City will record the short plat with the King County Division of Records and Elections subsequent to Public Works Department approval of submitted as -built plans. Prior to recording the short plat, all surveying and monumentation must be complete. In addition, all other required improvements must be substantially completed as determined by the departments of Community Development and Public Works. Unless deferred, all open space and traffic impact fees must be paid in full prior to recording. PUBLIC WORKS DEVELOPMENT SERVICES DIVISION (Kevin Peterson, 253-835-2734, kevin.peterson@cityoffederalway.com) Land Use Issues — Stormwater 1. Surface water runoff control and water quality treatment will be required per the 2009 King County Surface Water Design Manual (KCSWDM) and the City of Federal Way Addendum to the 2009 KCSWDM. It appears this project will be subject to Appendix C — Small Site Drainage Requirements of the 2009 KCSWDM. At the time of preliminary short plat submittal, preliminary drainage system design for all new impervious surfaces shall be shown on a plan, including those associated with future home development. 2. If infiltration is proposed, soil logs prepared by a licensed geotechnical engineer or septic designer must be provided to verify infiltration suitability. Show the proposed location and dimensions of the storm water facilities on the preliminary plans. 4. If more than one acre will be disturbed during construction, a National Pollutant Discharge Elimination System (NPDES) permit may be required. Information regarding this permit can be obtained from the Washington State Department of Ecology at hap:/Iwww.ecy.wa.gov/programs/sea/pac/index.htrnl, or by calling 360-407-6437. Based on available records and the submitted materials, it appears that this proposal meets the 25 percent threshold criteria for requiring street frontage improvements as identified in FWRC 19.135.030. The applicant/owner may submit an MAI appraisal for the subject property, or King County Assessor's records may be used. Development Services Division will evaluate this data to determine if the project actually meets the City's 25 percent threshold for requiring street frontage improvements. 3. If dedication of additional right-of-way is required to install street frontage improvements, the dedication shall be conveyed to the City through a statutory warranty deed. The dedicated area must have clear title prior to recording. 4. All stormwater treatment and detention requirements outlined above will be applied to new impervious area within the public right-of-way. FWRC 11.05.120 requires that all future utility connections (power, phone, cable, etc.) be located underground. 6. FWRC 19.135.280 requires that driveways serving residential uses may not be located closer than 25 feet to any street intersection. Lots and intersections within new subdivisions or short plats must be designed to meet this standard. EN Approval Issues 1. Engineered plans are required for clearing, grading, road construction, and utility work. Plans must be reviewed and approved by the City. Engineering review fees are $844.50 for the first 12 hours of review, and $68.50 per hour for additional review time. The plans will require the signature/seal of a professional engineer registered/licensed in the State of Washington. 2. In addition to engineering approval, short plats and subdivisions are required to obtain a separate permit for grading on the building pad areas. Details and fees may be obtained from the Federal Way Building Department. 3. The Federal Way Development Standards Manual (including standard detail drawings, standard notes, and engineering checklists) is available on the City's website atwww.citYoffederalway.com to assist the applicant's engineer in preparing the plans and TIR. 4. Bonding is required for all street improvements and temporary erosion and sediment control measures associated with the project. The bond amount shall be 120 percent of the estimated costs of the improvements. An administrative fee deposit will need to accompany the bond to cover any possible legal fees in the event the bond must be called. Upon completion of the installation of the improvements, and final approval of the Public Works Inspector, the bond will be reduced to 30 percent of the original amount and held for a two-year maintenance period. 5. When topographic survey information is shown on the plans, the vertical datum block shall include the phrase "DATUM: N.G.V.D.-29" or "DATUM: K.C.A.S.," on all sheets where vertical elevations are called out. 13-104251 Doc. I.D. 64324 Mr. Kirkebo Page 6 October 25, 2013 6. Drawings submitted for plan review shall be printed on 24" x 36" or 22" x 34" paper. All final approved drawings shall be drafted/plotted on 24" x 36" or 22" x 34" mylar sheet with permanent black ink. Site plans shall be drawn at a scale of 1" = 20', or larger. Architectural scales are not permitted on engineering plans. 7. Provide cut and fill quantities on the clearing and grading plan. Erosion control measures, per Appendix D, 2009 KCSWDM, must be shown on the engineering plans. 8. The site plan shall show the location of any existing and proposed utilities in the areas affected by construction. PUBLIC WORKS TRAFFIC DIVISION (Erik Preston, PE, 253-835-2744, erik.preston@cityoffederalway.com) Transportation Concurrency Analysis (FWRC 19.90) The estimated fee for the concurrency permit application is $344.50 (1 - 10 Trips). This fee is an estimate and based on the materials submitted for the preapplication meeting. The concurrency application fee must be paid in full at the time the concurrency permit application is submitted with land use application. The fee may change based on the new weekday PM peak hour trips as identified in the concurrency trip generation. The applicant has the option of having an independent traffic engineer prepare the concurrency analysis consistent with City procedures; however, the fee remains the same. Transportation Impact Fees (TIF) (FWRC 19.91) Residential Land Divisions - Based on the submitted materials for 2 new single-family lots, the estimated traffic impact fee is $6,410.60. The actual fee will be calculated and paid at the time of plat recording. The applicant may defer part or all of the impact fee payment amount to either building permit issuance; or to later than closing of the sale of the single-family home. If this option is selected, a covenants prepared by the city to enforce payment of the deferred fees will be recorded at the applicant's expense on each lot at the time of plat recording for residential land divisions. Street Frontage Improvements (FWRC 19.135) 1. The applicant/owner would be expected to construct half street improvements consistent with the planned roadway cross -sections as shown in Map III-6 of the FWCP and Capital Improvement Program (CIP) shown as Table III-19 (FWRC 19.135.040). Based on the materials submitted, staff conducted a limited analysis to determine the appropriate street frontage improvements. The applicant would be expected to construct half street improvements on the following streets to the City's planned roadway cross -sections: ■ 20th Avenue South (south of South 298t` Street) is a Local Street planned as a Type "T" street, consisting of a 28-foot street with 8-foot ditches and 5-foot sidewalks in a 60-foot right-of- way (ROW). No ROW dedication is anticipated. 2. The applicant may make a written request to the Public Works Director to modify, defer, or waive the required street improvements (FWRC 19.135.070). Information about a right-of-way modification requests are available through the Public Works Development Services Division. These modification requests have a nominal review fee currently at $91.50. City staff would support such a modification request because the required frontage improvements would not fit the character of the surrounding streets and neighboring lots. 13-104251 Doc. I.D. 64324 Mr. Kirkebo Page 7 October 25, 2013 Design Criteria (FWRC 18.55) All lots shall be accessed by a public street right-of-way (FWRC 18.55.020). In certain cases, lots may be accessed by an ingress/egress and utilities easement or alley subject to the requirements established in the city of Federal Way public works development standards. LAKEIIAVEN UTILITY DISTRICT (Brian Asbury, 253-946-5407, basbury@lakehaven.org) Water • A Certificate of Water Availability (application form enclosed) issued separately by Lakehaven may be required to be submitted with any land use and/or building permit applications (check with land use agency for requirement). Certificate is valid for one (1) year from date of issuance. If Certificate is needed, allow 10 work days to issue for typical, 3 work days for accelerated, processing. • The site has the following existing water service connections: ■ Domestic, Residential: One, 5/8"x3/4" meter (Serv. No. 11127). ■ A water service connection application (form attached) submitted separately to Lakehaven is required for each new service connection to the water distribution system, or any modification to an existing water service connection (e.g., larger service, irrigation, abandonment of existing service(s), re -activation, etc.), in accordance with standards defined in Lakehaven's current `Fees and Charges Resolution'. Non -single-family properties require separate domestic (per building), irrigation (if irrigated landscaped areas are incorporated into the site development), and fire protection (if required or installed) water service connections & meters. • Residential fire protection systems proposed to be connected to a residential domestic water service connection shall require installation of a private double check valve assembly (DCVA) directly adjacent to the service meter box. • Proof of private, water easement will be required across the easterly portion(s) of the short plat, for the benefit of the portion of the westerly lot(s) building supply line(s) across said property. This private easement shall cover off -lot property along the route of the affected portion of the building supply line(s) from the edge of public right-of-way to the short plat lot served. This easement area can be reserved on the recorded short plat, or by separate instrument if necessary. • Based on the proposal submitted, preliminary estimated Lakehaven water service connection fees/charges/deposits (2013 schedule) will be as follows. Actual connection charges will be determined upon submittal of service connection application(s) to Lakehaven. All Lakehaven fees, charges and deposits are typically reviewed & adjusted (if necessary) annually, and are subject to change without notice. • Water Service/Meter Installation Deposit, New 1" Residential (two): $4,150.00 each. • Water Service/Meter Upsize Deposit, Existing to 1" Residential (one): $1,500 (est.). • Capital Facilities Charge(s)-Water: $0.00.
