The subject property is zoned single-family residential, RS7.2, and existing and proposed improvements are located within an urban conservancy environment designation by the city's Shoreline Master Program (SMP). PROPOSAL The applicant proposes to remodel the existing single-family dwelling. Proposed improvements are landward of the ordinary high water mark, and landward of the 50-foot shoreline setback. The proposed height of the structure does not exceed 35 feet above average building elevation. The proposal may potentially include a drainage pipe from the house to shoreline. SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT EXEMPTION Washington Administrative Code (WAC) 173-27-040 identifies actions exempt from the requirement to obtain a shoreline substantial development permit. WAC 173-27-040(2)(g) exempts, under specific circumstances, construction on shorelands of a single-family residence for their own use or for the use of their family, which does not exceed a height of thirty-five feet above average grade level and which meets all requirements of the state agency or local government having jurisdiction thereof. Following review of the proposal, the department's Planning Division staff has concluded the proposed improvements meet the terms of the referenced exemption and are consistent with the policies of the SMP and state's Shoreline Management Act, therefore, a shoreline substantial development permit is not required. CLOSING This exemption is not an approval to begin construction. All necessary permits must be issued prior to construction activities. I'm following upon the issue of whether a geotechnical report (and potentially State Environmental Policy Act (SEPA) review) would be required for your single-family addition project if all construction activity remains in the existing building footprint. Your property is mapped as being located within an erosion hazard area (a type of critical area). Typically, this status would require that you submit a geotechnical report, which evaluates the site and determines if in fact the site is located within an erosion hazard area (or other category of geologically hazardous area). If the answer is no, the issue is resolved. If the answer is yes, then the geotechnical engineer makes recommendations to mitigate the impact of construction in the erosion hazard area and, by function of state law, SEPA review is triggered (this review process takes about 10 - 12 weeks typically). Federal Way Revised Code (FWRC) 19.160.010(2) states: (2) The director of community development may permit development activities, land surface modifications or the installation and maintenance of landscaping normally associated with residential, commercial or park use on or within 25 feet of a geologically hazardous area if no reasonable alternative exists and only if the development activity or land surface modification will not lead to or create any increased slide, seismic or erosion hazard. Based on this language, my interpretation would be that improvements in the same footprint, that do not disturb the foundation would meet this requirement. At the time of building permit application we would issue a formal letter to this effect. I also conclude that the improvements would be exempt from SEPA review pursuant to Washington Administrative Code (WAC) 197-11-800(3) - remodeling activity. Therefore, your project, if as described above, would not require submittal of a geotechnical report (for land use review - if building division finds the need for such a report for structural reasons, it may be required) or SEPA review. 1 suggest you bring this email with you to the front counter when submitting your application.
