Presently, the site is developed with an existing single-family residence and a boat house. Pursuant to the State Shoreline Management Act and the City of Federal Way Shoreline Master Program, this proposal is exempt from the Shoreline Substantial Development Permit process requirements based on project plans and per the description of the proposal identified in the construction plans prepared by Waterfront Construction, Inc. dated July 4, 2007; project description and construction sequence letter prepared by Waterfront Construction, Inc. dated January 11, 2008; and undated site photographs of the subject site. The proposal is exempt from the requirements of a Shoreline Substantial Development Permit because it is classified as "normal maintenance or repair of existing structures or development, including damage by accident, fire or elements" per Washington Administrative Code (WAC) section 173-27-040(b).2 The proposal is located adjacent to Puget Sound and is consistent with policies of Washington State Shoreline Management Act and guidelines of the City of Federal Way Shoreline Master Program for existing conditions. This Shoreline Substantial Development Permit Exemption authorizes you to restore the first 65 feet of rail onto existing concrete piers located in the Puget Sound tidelands at 3112 SW 300`h Place, in Federal Way, WA, based on construction plans prepared by Waterfront Construction, Inc. dated July 4, 2007; project description and construction sequence letter prepared by Waterfront Construction, Inc. dated January 11, 2008; and undated site photographs of the subject site. Copies of the authorized plans are enclosed. In an October 10, 2007 letter, the Seattle District, Army Corps of Engineers granted NWP authorization of the proposed repair actions subject to work being performed in accordance with Nationwide Permit 3, ' Environmental DNS issued on March 5, 2008, under file #07-106346-SE. 2 Subsection 040(b)(2) goes on to state that normal maintenance and repair means to restore a development to a state comparable to its original condition, including but not limited to its size, shape, configuration, location, and external appearance, within a reasonable period after decay or partial destruction, except where repair causes substantial adverse effects to shoreline resource or environment. The definition also includes replacement where, "...replacement of a structure is the common method of repair of such structure." On March 5, 2008, the City issued a Determination of Nonsignificance (DNS) for the proposed repair to the rail boat launch system at the above referenced site. Copies of this decision were provided to interested agencies. On March 19, 2008, the City received the enclosed comment letter from the Puyallup Tribe of Indians. They recommend that an archaeologist be hired to oversee and evaluate the proposed location of the project and complete a cultural resource report. Although the issue of archeologist report was disclosed within the staff evaluation, the project was not conditioned to provide this report in conjunction with the environmental determination. Given the recommendation from the Puyallup Tribe, the City can opt to reissue the environmental determination, incorporating the proposed recommendation as a condition of approval. However, should you agree in writing to the Tribal recommendation, the existing environmental determination can remain in place and the shoreline exemption can be issued to incorporate a condition that the marine rail repair project shall comply with the recommended Tribal actions. Please let me know as soon as possible how your client wishes to proceed with this application. As you are aware, the comment period from the environmental determination has ended while the two week appeal period ends on April 2, 2008. I await your response. A copy of this Environmental Determination of Nonsignificance (DNS) is enclosed. A 14-day comment period is required by the SEPA Rules, Washington Administrative Code (WAC) 197-11-340. A notice inviting comments will be published in the Federal Way Mirror on March 5, 2008. At the end of the comment period, the Department will determine if the DNS should be retained, modified, or withdrawn. The final determination may be appealed within 14 days following the comment deadline. No licenses, permits, or approvals will be issued until completion of the appeal period. Our decision not to require an EIS does not mean that the license, permit, or approval you are seeking from the.City has been granted. Approval or denial of the proposal will be made by the appropriate administrative or legislative body vested with that authority. The environmental record is considered by the decision maker(s) and conditions will be imposed to reduce identified environmental impacts, as long as the conditions are based on adopted and designated City policy. After a final decision has been made on your proposal, you may, but are not required to, publish a Notice of Action as set forth in RCW 43.21C.075. The Notice of Action sets forth a time period after which no legal challenges regarding the proposal's compliance with SEPA can be made. The existing bulkhead is approximately six feet tall. b. Landward of the existing bulkhead is moderately sloping upland grass and the house; waterward of the existing boathouse and bulkhead is a gentle sloping beach. c. Information from the City's soils maps indicates that the soils in this area are CB (Coastal Beach) and InC (Indianola Loam Fine Sand with 4-15% slope). d-e. Concur with checklist. Minimal compaction around the existing piers could occur during construction related activities. No erosion impacts are foreseen. Provisions for establishing and maintaining equipment and material limits shall be provided by the applicant prior to construction, and be consistent with any conditions of the Hydraulic Permit. g. Short-term impacts to air quality may occur during construction of the bulkhead from diesel engine exhaust during pickup and delivery on construction materials, and will contribute to increases in local suspended particulate levels. The property is situated within the southwest quarter of Section 01, Township 21 North, Range 03 East, W.M. Lat: 47°.331900 N; Long:-122°.374674 W. The property is a single family residential lot of Lakota Division No. 2. Project Description Ray Dapp proposes to repair his existing 150' foot long marine rail boat launch which was constructed on the tidelands approximately 70 years ago. Damage from storm events which occurred in January 2007 have rendered the launching rails unusable. The existing marine rail system originates at the base of a boathouse constructed above the existing concrete bulkhead. Two metal rails are imbeded in the concrete cap of the bulkhead and angle down toward the beach where they are supported on cast in place concrete pylons. A new galvanized steel rail support structure will be attached to the existing concrete pylons. Atop this support structure, new parallel rails will extend approximately 65 feet down the beach. The work is anticipated to take approximately 2 to 3 weeks to complete. Construction Sequence 1) Mobilize construction barge to the site with all required materials and equipment. Moor barge insuring that it does not ground out on the substrate. 2) Deliver the equipment (barge crane or light weight track hoe) and construction materials to a location on the beach during high tide. In all cases, the construction barge will work the tides and will not be allowed to ground out at any time during construction. 3) At low tide, remove old rails and any beach embedded supports located beyond the 65-foot distance from the bulkhead. We have submitted an application for a Shoreline Exemption and SEPA Exemption permit for the repair of some pilings on the existing dock located on Steel Lake on residential property. I discussed with you on December 4, 2007 whether or not we will require a Building Permit. You told me that in this case, since the work was minor and we are not doing new decking on the dock, that a Building Permit will not be required. I am sending this email with specific details of the work in order to receive a reply back for my record, stating that the permit is not required. The value of the work is estimated at $12,000.00. Marine Restoration & Construction LLC are requesting permission for the pile repairs on the existing dock structure. The work is a minor repair including the sleeving of 6 piles on outer dock and 8 piles on shore dock. It is considered normal maintenance and repair of an existing structure.
