After evaluating the existing conditions along the referenced street, review of the Federal Way Revisdd Code (FWRC) provisions (Section 19.135.040; 19.135.280) and the direction provided by the City Council, Public Works Department hereby provides the following response to each of your requests: Request to waive street improvements along S 373d Street: South 373'd Street is identified as a Principal Collector, corresponding to City Standard Street Section Type "P", which requires 32-foot paved section, two 10-foot ditches, two 6-foot sidewalks and two 3-foot utility strips within a 70-foot right-of-way. Currently South 373'd Street has a 60-foot right -of --way with areas of ditches but no sidewalks. The Public Works Department hereby approves your request to waive frontage improvements along South 373`d Street, with the following conditions: 1. The Applicant shall dedicate 5-feet of additional right-of-way along South 373`d Street. 2. In lieu of half street improvements, the applicant will be required to provide an 11-foot travel lane and 5-foot asphalt shoulder for a walking path as measured from the existing roadway centerline. 3. The Applicant shall dedicate 35-feet of additional right-of-way along 8t" Avenue South. 2. In lieu of half street improvements, the applicant will be required to provide an 11-foot travel lane and 5-foot crushed rock shoulder for a walking path as measured from the existing roadway centerline. The Applicant shall sign a Local Improvement District Waiver of Protest (Mailed separately) to acknowledge and understand the responsibilities should the City modify this roadway section in the future. The conditions of this right-of-way modification will be applicable for a period of one year. If the development permit for the short plat is not issued within the one-year time period, this modification will be void, and a new request for modification must be submitted. The property is located at the corner of S 373`d Street and 81h Avenue S. The applicant is requesting a waiver of street frontage improvements along both S 373`d Street and 81h Avenue S. Staff Analysis S 373`d Street is classified as a Principal Collector and 81h Avenue S is classified as a Minor Collector. Both street classifications correspond to City Cross Section Type "P". The street section requires a 32-foot wide street two 10-foot ditches, two 6-foot sidewalks and two 3-foot utility strips within a 70-foot right-of-way. The existing right-of-way along S 373`d Street is 60-foot and along 81h Avenue South is 30-foot all located east of the proposed center line. There isn't any sidewalk in close proximity to this site. Approximately 500 feet west along S 373`d Street, the City constructed a crossing of West Hylebos Creek the crossing included a 5- foot paved shoulder along the north and south sides. Site measurements indicate that the existing roadway section in front of this parcel appears to be between 16 and 19 feet wide. The existing street section along 8th Avenue S appears to be between 16 and 18 feet wide with little shoulder. Requirements / Conditions of Approval Development Services staff recommend approval of this request to waive street improvements with the following modifications: 1. The applicant will dedicate 5-feet of additional right-of-way along S 373`d Street. 2. The applicant will dedicate 35-feet of additional right-of-way along 81h Avenue South. 3. In lieu of half -street roadway section installation the applicant will be required to provide an 11-foot travel lane and 5-foot asphalt shoulder as measured from the existing roadway centerline along S 373`d Street for a walking path. 4. In lieu of half street improvements the applicant will be required to provide an 11-foot travel lane and 5-foot crushed rock shoulder as measured from the existing roadway centerline along 8th Avenue South. 5. Sign a Local Improvement District Waiver of Protest Covenant; so that the Applicant will acknowledge and understand their responsibilities should the City modify this roadway section in the future. As stated in the meeting notes from the preapplication process, Caliber Company Inc. is required to construct improvements of the following streets: South 373'd ST. is a principal collector planned as a Type "P" street, consisting of a 32' street with curb and gutter, 10' ditch, 6' sidewalks and street lights in a 70' right of way (ROW). Assuming a symmetrical cross section, half street improvements and 5' right-of-way dedication are required as measured from the street centerline. 8th Ave S is a minor collector planned as a Type "P" street consisting of a 32' street with curb and gutter, 10' ditch, 6' sidewalks and street lights in a 70' right-of-way (ROW) Assuming a symmetrical cross section, half street improvements and 35' right-of-way dedication are required as measured from the street centerline. Caliber Company Inc. is requesting these improvements be waived for the following reasons. 1. The improvements as required would not function properly or safely due to kids exiting the ends of sidewalks into ditches or if we place barricades at the end of sidewalks it would force kids to walk unsafely around them and into the roads. This could cause pedestrian vehicular incidents from pedestrians being struck. Also, the improvements as required would not be advantageous to the neighborhood due to the Hylebos Creek to the west of the property on S 373'd St being a conservation for the Chinook Salmon. Furthermore, the surrounding area around the property will not be highly developed. Additionally, due to zoning at parcel # 3221049023 and the surrounding area, distances between houses and stores are great enough to discourage walking and will require travel by auto. Frequent visiting back and forth between neighbors is not likely to take place. The topographic and physical conditions of S 373rd St provide a natural flow of water down -hill to the wetlands surrounding Hylebos Creek. By improving the roads, you will be affecting the natural water flow and collecting water that will go nowhere. Proper vertical or horizontal alignments cannot be determined because the existing streets along 8th Ave S do not have correct alignments. King County records show that 8th Ave S located to the North of S 373rd St, is a 60' road. After analyzing further, we have determined that the existing road does not meet county records; therefore, proper alignments cannot be determined and required improvements will cause the roads to be misaligned.
