S., Federal Way (Parcel #'s 720480-0164 & 720480- 0166) Dear Mr. Oldright: The City of Federal Way has completed an administrative review of your two -lot Boundary Line Adjustment (BLA) application to combine parcels 720480-0164 and 720480-0166 into one building lot. The application was deemed complete on October 2, 2017. Original Parcel A is 56,118 sq. ft. and Original Parcel B is 56,775 sq. ft. As a result of the BLA, new consolidated Parcel A will be 112,893 sq. ft. (2.59 acres). The Community Development Department hereby approves the BLA with conditions based on the survey drawing prepared by Stephen H. Woods, PLS, Contour Engineering, LLC (January 22, 2018), date stamped received January 23, 2018. FINDINGS 1. The applicant proposes to remove the interior lot line between two commercial lots in the Community Business (BC) zoning district in order to construct a new self -storage facility. 2. The subject property contains critical areas. A Type-F stream, containing fish habitat with a 100-foot stream buffer exists off site and along the rear (eastern) property -line of Original Parcel A and B per Federal Way Revised Code (FWRC) 19.145.270.1. A 5-foot setback from the edges of the critical area buffer applies to improvements, excluding landscaping, building overhangs and fences under six feet per FWRC 19.145.160. The setback shall be depicted on the recorded BLA. The Washington Department of Fish and Wildlife (email correspondence dated August 11, 2017) and the city's consultant Landau Associates Inc. (December 1, 2017 Technical Memo) agree with the above stream classification, pursuant to Washington Administrative Code (WAC) 222-16-030. There is no minimum lot size in the BC zone; instead the buildable area is determined by other site development requirements i.e., required buffers, parking lot landscaping and surface water facilities, etc. Mr. J. Oldright February 6, 2018 Page 2 of 3 4. The BLA will result in a lot of ample dimensions that will provide a regular -shaped building area which meets the required setbacks. As proposed, resulting Parcel A will increase in size. 5. Resulting Parcel A will take access from Pacific Highway South. DECISIONAL CRITERIA City staff has determined the BLA meets decisional criteria set forth in FWRC Chapter 18.10: The BLA is a minor alteration in the location of lot boundaries on existing lots. The BLA will not increase the number of lots, nor diminish the size of open space or other protected environments. 2. The BLA will not diminish the size of any lot so as to result in a lot of less square footage than prescribed in the Community Business (BC) zoning district. 3. The BLA will not result in the reduction of setbacks or site coverage to less than prescribed in the Community Business (BC) zoning district. 4. All lots resulting from the BLA will be in conformance with the design standards of the city's subdivision title. CONDITIONS OF APPROVAL 1. Prior to final recording, the applicant shall make the following map revisions; see the enclosed redlines: a. Show a 5-foot building setback line from the edge of the stream buffer on the mylar. Landscaping, building overhangs, and fences and railings six feet or less may locate in the 5 ft. buffer setback. b. Remove the King County Health District signature block. c. Sheet 3 of 3 — revise tax parcel no. from 720480-0169 to 720480-0166. RECORDING Please submit three prints of the final BLA drawings (signed and notarized paper mylar) in black ink only. On submitting, please advise the Permit Center to not stamp these documents for recording. Mylars will be routed to the appropriate city officials for signing (allow for 2-3 business days). The project planner will contact you when the originals are available for recording by the applicant/agent at King County. Please return one conformed mylar original to Associate Planner Leila Willoughby -Oakes, immediately after recording. No changes to the approved BLA document are permitted following city signatures. This determination of completeness is based on a review of your submittal relative to applicable requirements referenced within Federal Way Revised Code (FWRC) Chapter 18.10 ".Boundary Line Adjustments." A 120-day time line for reviewing the BLA application has started as of this date. The city's development regulations allow the department 120 days from the date that an application is deemed complete to take action on the application. However, the 120-day timeline can be stopped any time the city requests corrections and/or additional information. TECHNICAL COMMENTS Planning Division (Leila W-Oakes, 253-835-2644, leila.willoughby-oakes@cityoffederalway.com) During the completeness review, staff also completed a technical review. A review of the material you submitted identified the following items that must be addressed before approval by Planning. Planning Manager Robert Hansen has authorized the payment of Lot Line Elimination (LLE) processing fees on the condition that you submit a legal survey and comply with Bulletin #038 `Boundary Line Submittal Checklist.' The King County Recorder's Office does not recognize the Federal Way LLE process on official county documents including the Assessor's mapping. The removal of the interior lot lines via BLA processing requirements is necessary to construct the storage facility project, city file no. 17-102253-00-UP. Critical Areas — FWRC 18.10.030.1 requires boundary line adjustments depict the location of environmentally critical areas and their buffers (i.e. Type F Stream, 100-ft. stream buffer, and any wetland buffers if applicable). Category II wetlands and wetland buffers were mapped and delineated on tax parcel 720490-0200 for the Barkley Ridge Apartment project and received Use Process IV approval on August 25, 2006 (file no. 05-102530-00-UP). Talasea performed the wetland determination before the city's critical area ordinance update effective June 2015. The Barkley Ridge wetland delineation depicts a 50-ft regulated wetland buffer measured from the delineated wetland edge of a stream (major stream) component. The stream segment continues onto the Woodmont Storage LLC project site to the north and the approved apartment site plan also depicts the wetland buffer extending off -site onto the southeast corner of tax parcel 720480-0164. The city's third party biologist, Steve Quatermann,' requests that the applicant, at the discretion of the city, provide data plots and wetland determination data forms in the above -mentioned area on parcel 720480-0164 (`Lot C') in order to determine if regulated wetlands and their buffers are present on the project site. The `existing conditions' site plan (Sheet 1 of 2) in the Woodmont Storage Critical Areas report prepared by Soundview Consultants Inc. (revised June 2017) depicts report data plots examined on the project site (parcel 720480-0166) and off -site on vacant parcels (parcel 720480-0165). No data plots were taken on parcel 720480-0164 submitted critical areas report (see Figure 1).
