After evaluating the existing conditions along the referenced street, review of Federal Way Revised Code (FWRC) provisions (Section 19.135.280-290), and direction provided by the City Council, the Public Works Department hereby approves this request as follows: 1. WAC 468-52-040 limits access spacing to no less than 250 feet, with only one access per parcel. As such, no direct access onto S 34$1h St should be granted if shared access with adjacent parcels or access to S 3181h Street is feasible. Direct access to S 348th St should only be granted if the applicant can demonstrate that it is otherwise infeasible to carry out essential and regular functions of doing business. Discussion: Jackson Foods proposes to utilize one of two existing driveways on S 348th St. The unused driveway will be closed. The remaining driveway is shared with other businesses and is located 175' west of the intersection with 16`h Ave S, at the west property line and as far from the intersection as can be accomplished on this parcel. The proposal is expected to reduce turning conflicts on S 3481h Street as compared to existing conditions. Minimum driveway spacing on 161h Ave S is 150 feet. The proposed driveway on 16`h Ave S exceeds this minimum distance, both from the intersection and from the driveway to the north. Since two existing driveways on 16`h Ave S will be closed, this proposal is expected to reduce turning conflicts on 16"' Ave S. The applicant has submitted an Autoturns template establishing that driveways on both S 3481h St and 16`h Ave S are necessary to accommodate their delivery trucks. Both driveways are restricted to right-in/right-out by existing medians. 2. Federal Way Revised Code Section 19.135.270 (3) states the maximum driveway width for this application is 30 feet for a two lane two-way driveway and 40 feet for a three -lane two-way driveway. I.D. Discussion: The applicant proposes a 35' wide, two-way driveway on both streets to accommodate larger vehicles and fuel delivery trucks. An Autotums template has been submitted in support of the proposal. Conclusion: Because the applicant has established that the driveway locations and sizes are necessary for doing business, the proposal will reduce turning conflicts as compared to existing conditions, and the proposed driveways will be restricted to right-in/right-out only, this right-of-way modification is approved as proposed. At the City's request, the applicant has agreed to install frontage improvements along 16t' Ave S rather than paying a fee -in -lieu toward the City's project. Credit will be given toward the required Traffic Impact Fee. The amount of credit will be based upon the applicant submitting the following information: 1. Jacksons Food Store proposes to close three existing driveways: one nearest the intersection on S 348th St, one nearest the intersection on 16th Ave S, and one on the northeast corner of the site. The applicant proposes one driveway on each of the two streets. The proposed driveway on S 348th Street is located 175'west of the intersection, and is used jointly with other businesses. Due to physical constraints, it cannot be moved further west to meet the minimum driveway spacing requirement of 250'. One (1) check from Barghausen Consulting Engineers, Inc. for required fees PROJECT DESCRIPTION The project proposes to demolish all of the existing buildings and redevelop the subject property with a new 4,024-square-foot convenience store, a new fueling canopy with six (6) fuel dispensers (twelve (12) vehicle fueling positions), and a new trash enclosure. The project will demolish the existing 2,007- square-foot convenience store, car wash, and 3,202-square-foot auto repair structure. The existing underground fuel storage tanks are planned to remain. SITE DESCRIPTION The site is located at the northwest corner of 16th Avenue South and South 348th Street. The project site is comprised of two (2) parcels that are both developed. The northern parcel contains an existing auto repair/parts store. The south parcel is developed with a Shell gas station that has four (4) MPDs, a 2,007-square-foot Jacksons convenience store, a car wash, and four (4) underground fuel storage tanks. The site contains a row of evergreen trees along the west property line. Surrounding the site is Greg's Japanese Auto to the west, an auto repair shop to the north, and casual dining / quick -sere restaurants to the east and south. Fronting the property are 16th Avenue South, a principal arterial designated street, and South 348th Street (aka SR-18), a state highway also designated as a principal arterial. Below are the criteria for modifications, deferments, and waivers in italics along with responses to the criteria for the requested items. 19.135.070 Modifications, deferments, and waivers. The public works director may modify, defer or waive the requirements of this chapter only after consideration of a written request for the following reasons: 1. The improvement as required would not be harmonious with existing street improvements, would not function properly or safely or would not be advantageous to the neighborhood or city as a whole. Response: We understand from the pre -application comments that we received that the City has a planned auxiliary southbound lane per Project Number 20 in the 2017 — 2022 Federal Way Six - Year Transportation Improvement Ian (TIP). We understand that completion of the auxiliary lane would require a dedication of 18 feet of right-of-way along the project frontage of 16th Avenue South. Because of the location of existing underground fuel storage tanks (UST) that would be impacted by the full dedication, the agplicant reguests a modification to dedicate 10 feet instead of 18 feet of right—of—wayright-oi-Agy at the location of the USTs. The reduced dedication would accommodate the full additional traffic lane planned per TIP project #20 and a 10-foot wide sidewalk with tree wells (if applicable) just at the UST location. While this does not exactly meet the standard of the Arterial "3-02A Street Section A" detail, it would accommodate the full traffic movement and eliminate the high cost and environmental impacts from removing the existing USTs. The applicant also requests to pay a fee in iieu of constructing frontage improvements on 16th Avenue South since it would be a limited length addition of the planned travel lane and the project is part of the Six -Year TIP. Continued access to South 348th Street at the existing driveway is necessary because the existing driveway and frontage road is shared with other commercial uses. Because both driveways are right-in/right-out, additional driveway width of five (5) feet (total width 35 feet) is necessary to accommodate the fuel delivery truck turning movements. 2. Unusual topographic or physical conditions preclude the construction of the improvements as required. Response: The site has physical constraints that restrict redevelopment, turning movements, and access. Continued access to South 348th Street at the existing driveway is necessary because the existing driveway and frontage road is shared with other commercial uses and because the fuel delivery truck needs an exit path. Because both driveways are right-in/right-out, additional width to 35 feet is necessary to accommodate the fuel delivery truck turning movements. 3. Proper vertical or horizontal alignments cannot be determined because the existing streets do not have correct alignments. Response: This criterion does not apply to any of the proposed modifications, deferments, or waivers. 4. The required improvement is part of a larger project that has been scheduled for construction in the city's adopted six -year transportation improvement program. Response: We understand from the pre -application comments that the City has a planned auxiliary southbound lane per Project Number 20 in the 2017 — 2022 Federal Way 6-year Transportation Improvement Plan (TIP).
