The application is hereby revised and approved as conditioned, per the findings, conclusions, and conditions below. The application was deemed complete on June 12, 2015. A revision was submitted on August 6, 2015, requesting to convert the depression area to gravel where it was previously grass. Previously, the applicant requested to stabilize the area with grass. The area will be used for truck parking and trailer storage associated with Graham Trucking. FINDINGS OF FACT 1. The property is zoned Commercial Enterprise (CE). The applicant proposes to change the use from a "Tow Lot" per Federal Way Revised Code (FWRC) 19.240.050 to "truck and trailer storage." Per FWRC 19.240.020, "Storage Facilities -Commercial vehicle facilities and service yards" are allowed uses in the CE zone. On May 21, 2015, the proponent applied for a business license requesting a change of use from a "tow lot" to "truck and trailer storage" associated with Graham Trucking. The uses have similar requirements for setbacks and parking. The applicant is entitled to utilize the outdoor parking areas as employed for the previous use, including limited areas within the wetland/stream buffer that have previously been utilized for vehicle storage (enclosure). The change of use is considered to be in compliance with zoning requirements and the business license was approved. 2. The depressed area is approximately 1,950 square feet +/-. 3. The subject property contains cri.ticaI areas regulated by FWRC 19.175 `Regulated Wetlands' and FWRC 19.165 `Streams.' A major stream abuts the western property line with a 1.00' stream buffer on the subject property. The West Hylebos (Category I Wetland) is located directly south of the subject property. The subject property is a non -conforming development pursuant to the required perimeter landscaping along property lines abutting public rights -of -ways. In the CE zoning district developments shall provide Type III landscaping 10 feet in width. 5. Per FWRC 19.130.240(3), parking areas are permitted within the required setback yards of this use. 6. The Lakehaven Utility District issued a sewer service connection permit on June 29, 2015. At this time the applicant installed upright pipes of a 2-way sewer cleanout to connect to a shop building on the subject property. 7. ESM Consulting Engineers requests a revision to the proposed engineering permit (15-103223-E1) and Use Process I review. The applicant requests to fill and convert a grassed depressed area to gravel. The area will now be used for truck parking and trailer storage associated with Graham Trucking. The submittal states there will be no concentration of flows from this action, and the existing stream and wetland critical area buffers will remain undisturbed. 8. The Public Works Traffic Division has no comments. Lakehaven Utility District (LUD) has no comments based on the submittal. If any water or sewer utility conflicts are encountered during permitted activities the applicant should promptly contact LUD for additional information. 9. If more than 2,000 square feet of new and/or replaced impervious area is created, drainage review will be required. The 2009 King County Surface Water Design Manual outlines requirements for flow control and water quality. An engineering permit for this proposal is required. The proponent submitted an application (15-103223-E1) on July 6, 2015, revisions requested on August 6, 2015. Erosion controls will be implemented. 10. The scope of proposed site improvements, limited to 500 sq. ft. of fill including the proposed gravel, is shown on the site plan prepared by ESM Consulting Engineers on June 9, 2015. The proposal does not have adverse impacts on the amount of required landscaping, parking, buffering from critical areas, open space, or public areas, and does not change pedestrian connections, utilities, or easements. CONCLUSIONS OF LAVE' 1. The proposed land modifications are not exempt from permitting as they do not meet FWRC 19.120.030 criteria, "Exemptions." The proposed activity exceeds grading, filling and excavation totaling 100 cubic yards. 2. The proposed land disturbance does not impact or intrude into the wetland and stream buffers. Clearing, grading and land development activities within critically sensitive areas including buffers are strictly prohibited. 3. The proposal is categorically exempt from the State Environmental Policy Act per WAC 197-11-800 and does not exceed the flexible thresholds under FWRC 14.15.030 (total excavation and fill does not exceed 500 cubic yards). 4. The proposed grading and imported fill and surface area impacted as shown on the site plan dated June 9, 2015, meets the `Clearing and Grading Regulations' set forth in FWRC 19.120.070-120. 15-102864-UP Doc, I.D. 70537 Mr. LaBrie August 18, 2015 Page 3 5. The proposed truck parking location as shown on the site plan complies with the requirements of FWRC 19.130.240(3). 6. The proposed improvements meet Process I criteria of FWRC 19.55.020, including compliance with applicable provisions of FWRC Title 19, "Zoning and Development," and health, safety, and welfare standards. CONDITIONS a. The applicant shall receive final approval of a grading permit (15-103223-E1) and satisfy final inspections by the Planning and Development Services Divisions. b. The new graveled area shall maintain a minimum of ten feet of vegetation between the new parking area and the northwest property line. c. Any work performed on the subject property shall comply with the provisions of Chapter 19.145 FWRC. Critical area buffer disturbance is strictly prohibited under this decision. APPEALS The effective date of this decision is August 18, 2015. Pursuant to FWRC 19.55.050, any person who received notice of the administrative decision may appeal this decision to the Federal Way Hearing Examiner within 14 calendar days after issuance, by September 2, 2015. Any appeal must be in the form of a letter delivered to the Community Development Department with the established fee. The appeal letter must contain a clear reference to the matter being appealed and a statement of the alleged errors in the director's decision, including the identification of specific findings and conclusions made by the director disputed by the person filing. In that you are the only party of record, your appeal period is waived. Waiver of the right to appeal does not affect the effective date of this decision. CLOSING This decision does not waive compliance with future City of Federal Way codes, policies, and standards relating to this development. After conducting a site visit on Friday, I have attached an enlarged site plan (not to scale) with plant locations and instructions for you in this email and on a scanned planting plan. If you speak with the nursery you purchase the plants from they can help you choose a species or you may choose from the city tree list attached. After planting and my inspection I will send you a city letter clearing the condition and closing the Use Process file. Landscape Buffer Instructions 1. Plant eight (8) coniferous evergreen species evenly spaced 3 or more feet apart (for room to growth) along the fence line of 1225 356th Avenue South. Please set the trees/tall shrubs at least 5 feet south of the new fence. The evergreens shall be a minimum of six feet in height (measured from the tree top to the ground) at the time of planting. i. There are plant options on City's tree list or the Thuja Emerald (similar to those growing at Lowes north on 356th) 2. There are no actions required on your or our part. The UP permit was also approved, there is one condition that has not been met, the landscaping, see below. Once that is completed a final inspection can be completed by the Planning Department and this can be closed. 2) Landscaping • Per the Use Process permit, above, there was a condition that screening must be provided. • Per code, the applicant/owner is supposed to prepare a plan for the landscaping and submit it to the City for review and approval. To try to help and expedite, instead of requiring you to submit one, be reviewed, etc. Leila is preparing one that meets the minimum requirements for you and is forthcoming. • The only action on your part, is once you have the plan, the plants need to be installed and then as noted under Permitting Status, a final inspection can be completed and the UP closed. 3) Survey / Plans • No action is required on your or our part and there is no requirements for additional plans or work. ■ The comment was intended as educational, the drawings ESM prepared were based on an aerial image and do not completely accurately represent your site. To get an accurate representation of the site a field survey would need to be done. • The survey could then be used for design of any other stormwater mitigation / improvements as needed. • This information was provided for your benefit if you are having onsite stormwater problems, no action is required and nothing needs to be submitted. 4) S 356th St Stormwater ■ No action is required on your part. • This is related to your conversations with Tony. ■ Public Works has it on our project list to install an asphalt deflection curb to direct what we can of the water coming across the street into the catch basin. With the amount of rain we have had, we have been very limited on days we can actually get work done. • This is a stop gap solution until the 356th road re -construction project is completed. (b) Identification of existing slope depicting: areas with zero percent to 15 percent slope; areas with 15 percent to 40 percent slope; and areas of 40 percent or greater slope. (c) Proposed grades. (d) Location of all existing and/or proposed structures, driveways, right-of-way improvements, utilities, and easements on the subject property. (e) Designation of all wetlands, streams, and other critical areas regulated under Chapter 19.145 FWRC that is on or within 200 feet of any area to be disturbed by the proposed clearing and/or grading action. When I first discussed this with my staff I didn't understand that the site was already improved — at least in part. That being the case you are allowed to make improvements and correct drainage problems. My understanding is you would stay under 500 cubic yards of cut and fill — which is the SEPA threshold. Per Federal Way Revised Code (FWRC) 19.15.030(1) you are required to submit a Process I application for land use approval and an Engineering Approval (EN) to allow the construction. To be clear, the Process I would take the place of the Process III that was previously mentioned — sorry for the confusion. I am aware that there are wetlands and streams in close proximity to your property. For that reason we need to understand where those features and their buffers exist on -site to ensure that grading activities stay out of those areas. For that reason you will need to include a report that delineates these features and their buffers with your application. I am not in a position to comment on the cause of the drainage problems (you've indicated you believe City improvements are causing the problem). Regarding your desired use of the property. I'm not exactly sure what you mean by "truck parking", but based on the types of uses allowed in the zone that would be considered an allowed use. It is a change -of -use from the prior tow -lot that operated on the site, so we would need to do a zoning compliance review for the change -of -use. The fee for that is $148. You would also need a City business license. Fee of $75. If your immediate concern is the grading work, then you need to submit the Process I application and the clearing/grading plans for the EN (Mr. Kelly has been informed of what needs to be submitted for the EN). For the Process i application we need a site plan showing area of proposed work, the Master Land Use application (attached), written description of the project and the initial application fee of $82 (charged at $62/hour for each additional hour of review time). One of my contractors have been attempting for some time to get a permit to fill and rock a small area next to an area that the city of Federal way filled and graded when they did the road project on 356th. Adding to the fact that the city created a bowl for water and simply left it that way is the fact that they also sloped a very large stretch of roadway that dumps water into this bowl during heavy rains- My contractor completed the paperwork he was given for this project and was then told, "sorry i think I gave you the wrong information and application" he was then referred to Layla. When I called to speak with Layla she told me that you have decided that this requires a level three review, I'm betting that you already know that I have no intention of doing that. This property has been used as a tow and impound yard for many years, I would like to use this property for truck parking, do you feel that this use is consistent or do you feel that I would be required to jump through all of the cities hoops to use the property? Unfortunately I have been notified that both of the properties I own in Federal way are properties that are part of the cities capital improvement projects and that they want to take parts of them. Part of his concern is the existing paved road approach channels all of the water in the area right into his property, not away from it. The new road improvements will help solve this. He mentioned work he thought work was done on a city site diverting storm water at some point and he is looking to remedy the problem. We own 2921049090 as a ROW Utility Road. If they exceed 500 cubic yards or proposed to do work within 10 feet of a wetland buffer, come back to planning or just add us anyway as reviewers. He might be subject to a Process I review per FPAURC 19.15.030 and Clearing, Grading etc. under 19.120 (1 am not entirely sure why some of these provisions belong to planning). He would use more than 500 cy if SEPA was not imposed, maximum exemption levels in fully planning GMA counties are 1,000 cy for fill or excavation under WAC 197-11-800. Our client, Graham Real Ventures, LLC is proposing to fill a small depression on their property, located at 1225 S 356th St. The 4.01 acre property, also known as King County Tax Parcel 292104-9036, is located in southern Federal Way, on S 3561h St between Pacific Highway S and Enchanted Parkway S. The site gains access to 356th via a gravel driveway located in its northwestern corner. This gravel driveway sits at approximately 212 feet above sea level. Adjacent to this pad sits an approximately 5,800 square foot depression, shown in yellow on the attached Grading Exhibit. Elevations in this area are approximately 210 feet above sea level. This difference in elevation causes water to flow from the gravel driveway into the depression, resulting in large pools of standing water. Our client proposes to fill the depressed area in order to prevent further accumulation of standing water. To do so, the depression will be filled such that it is level with the gravel driveway and surrounding area. This will require, on average, approximately 2 feet of fill across the breadth of the depression in order to achieve an elevation of 212 feet. Based on our calculations, this will require less than 500 cubic yards of total fill, which exempts the proposed action from SEPA review under the City of Federal Ways code. Please see the "Grading Permit - Cross Section" exhibit included as part of this submittal for more information. According to Federal Way's GIS Data, a stream and a large wetland are located adjacent to the site. These critical areas and their buffers (100 and 200 feet, respectively) have been shown on the attached Grading Exhibit. Silt fences have been proposed in order to mitigate any potential temporary negative impacts that might occur as a result of the proposed action. Based on our conversations with the City, it is our understanding that these measures will be sufficient.
