The City of Federal Way's Community Development Department has completed administrative review of
the proposed Red Lion pool building located at 1688 South 348`h Street. The Process 11 land use
application submitted on July 31, 2014, is hereby conditionally approved as the proposal meets site plan
and community design guideline criteria set forth in Federal Way Revised Code (FWRC) 19.60.050 as
found in the enclosed Exhibit A - Findings for Process II Site Plan Approval and incorporated into this
decision. The remainder of this letter outlines the zoning and development review process required for
this proposal, condition(s) of approval, and a summary of appeal procedures.
REQUIRED REVIEW PROCESS
The proposed improvements to the site are subject to Process II Site Plan Review pursuant to motel use
requirements set forth in FWRC 19.240.090 and review processes for additions to developed sites as set
forth in FWRC 19.15.030(2). The proposal does not exceed the city -adopted flexible thresholds set forth
in FWRC 14.15.030(c) and therefore is exempt from review under the State Environmental Policy Act.
CONDITIONS OF APPROVAL
1) Building permit plans for the trash/recycling enclosure shall demonstrate compliance with FWRC
19.115.050(6)(a)(iii). [Service yard walls, enclosures, and similar accessory site elements shall be
consistent with the primary building(s) relative to architecture, materials and colors.]
2) Building permit landscaping plans shall show the landscaping proposed along the west and east
fagades as Type II.
APPROVAL DURATION
Unless modified or appealed, the Process II decision is valid for five years from the date of issuance of
the decision. Time extensions to the decision may be requested prior to the lapse of approval following
the provisions listed in FWRC 19.15.110. The improvements must be substantially completed within the
five-year time period or the land use decision becomes void.
APPEALS
The effective date of this decision is August 23, 2014, or three days from the date of this letter per FWRC
19.05.360. Pursuant to FWRC 19.60.080, any person who received notice of this administrative decision
may appeal the decision to the Federal Way Hearing Examiner by September 13 2014. Any appeal must
be in the form of a letter delivered to the Department of Community Development with the established

fee. The appeal letter must contain a clear reference to the matter being appealed and a statement of the
alleged errors in the Director's decision, including the identification of specific findings and conclusions
made by the Director disputed by the person filing.
However, in that you are the only party of record, your appeal period is waived (assuming you do not
wish to appeal this decision). Waiver of the right to appeal does not affect the effective date of this
decision.
CLOSING
This land use decision does not waive compliance with future City of Federal Way codes, policies, and
standards relating to this development. This Process II approval does not constitute approval of a building

Findings for Process II Site Plan Approval

The Planning Division hereby presents the following analysis to the Director of Community Development
pursuant to content requirements of the Process II written decision as set forth in Federal Way Revised Code
(FWRC) 19.60.070. These findings are based on review of existing city documents and submitted items by
the applicant received July 31, 2014.
1. Proposal — The applicant proposes to construct a new 3,400 sq. ft. pool building, accessory to an
existing motel.
2. Comprehensive Plan & Zoning Designation — The subject property is located within the
Commercial Enterprise (CE) comprehensive plan and zoning designation. The property's proposed
use as a motel and accessory building is a permitted use within the CE zoning designation pursuant
to FWRC 19.40.090.
3. Review Process — Per FWRC 19.15.030.2, "Improvements and/or additions to an. existing developed
site that are exempt from SEPA and exceed the thresholds in subsection (1) of this section, but do
not exceed 100 percent of the square footage of the gross floor area of the existing use, shall be
reviewed using Process II..." The proposed building falls within this criteria. In addition, motel uses
located in the CE zone are subject to development review procedures of Process II `Site Plan
Review' set forth in FWRC Chapter 19.60. Process II review requires no public notice period and
concludes with a written decision issued by the Director of Community Development. Appeals of
the director's decision are conducted by the city's Hearing Examiner.
4. Environmental Review — The proposed improvements are exempt from environmental review. The
new building will be less than 12,000 square feet; the improvements are consistent with the State
Environmental Policy Act (SEPA) "minor new construction" flexible thresholds as set forth in
FWRC 14.15.030.
Nonconforming Development — The existing site is nonconforming in regards to certain site
development standards such as landscaping. Per FWRC 19.30.090(1)(a)(ii), if any aspect, structure,
improvement, or development does not conform to the current development regulations, the aspect,
structure, improvement, or development must be brought into conformance if:
a. (ii) A new and separate structure is being constructed on an already developed site, the
applicant shall comply with all development regulations applicable to the geographic portion
of the site on which the new structure and any related improvements are to be constructed.
The applicant's proposal demonstrates conformance with regard to zoning regulations such as
landscaping for the applicable geographic portion of the site.
6. Height — The height of the development is approximately 24 feet above average building elevation,
which is below the 45-foot height maximum.
Setbacks — The required front yard for motel use is a 5-foot setback. Per FWRC 19.240.090, note 1,
the minimum side and rear yards shall be 20 ft. along residential zones and 5 ft. along all other
zones. Adjacent parcels in all directions are zoned CE, so a 5 ft. side and rear yard setback are
applicable. The new building is greater than 5' from all property lines, which exceeds the
requirement.
8. Lot Coverage — No maximum lot coverage applies. Instead, the buildable area will be determined
by other site development regulations, i.e., required yards, landscaping, surface water facility, etc.
9. Parking — Pursuant to FWRC 19.240.090, motel use shall provide 1 parking space for each guest
room. The proposed building is accessory to the motel building and contains no guest rooms. The
site currently contains 99 guest rooms and provides an accompanying 126 parking spaces. The
installation of the pool building and new garbage/recycling receptacle will remove 24 parking
spaces, leaving 102 parking spaces, which just exceeds the minimum requirement.
10. Landscaping — FWRC 19.125.060(9) contains required widths for landscaping in the CE zone. The
required landscaping is 5' of Type III along all property lines. FWRC 19.30.090(1)(a)(ii) addresses
the requirement to upgrade the non -conforming required landscaping near the new building (in this
case along the south property line in the vicinity of the new building and along the east side near the
new building --rather than at the far eastern property line). The site plan shows 5' of Type III
landscaping as stated above and 5' of Type 1 landscaping around the new trash/recycling enclosure.
The remaining areas of landscaping proposed around the building are not considered "required"
landscaping. No new parking is proposed; therefore, no change to interior parking lot landscaping is
required.
11. Community Design Guidelines — The proposed building, as conditioned, complies with the
provisions of FWRC Chapter 19.115, "Community Design Guidelines" that are reasonably related
and applicable to the area of development as detailed below.
a. Crime prevention through environmental design (CPTED) guidelines — The applicant filled out
a CPTED checklist, which was reviewed by Police staff and there are no additional crime
prevention suggestions based upon the plans submitted.
b. Commercial service and institutional facilities — Service yard walls, enclosures, and similar
accessory site elements shall be consistent with the primary building(s) relative to architecture,
materials and colors. A new trash/recycling enclosure is proposed in addition to the pool
building. Based upon the information submitted pertaining to color choices for the pool
building, it is unclear whether there is consistency between the primary building (pool building)
and the trash/recycling enclosure. A condition of approval of this Use Process decision shall
state that the building plans for the trash/recycling enclosure must demonstrate compliance with
this guideline.
C. Building design — The building's primary entrance is located on the west facade but is clearly
visible from the right-of-way, South 347t' Place to the north and Highway 18 to the south. The
west and east building facades are both longer than 60 feet and are visible from a right-of-way
and therefore must incorporate two of four facade treatments. The west facade is the main

entrance and utilizes fagade modulation and landscaping. The east fagade utilizes fagade
modulation and landscaping.
While landscaping is shown around the proposed building, in order to fully comply with this
guideline, a condition of approval of this Use Process decision shall state that the landscaping
material proposed along the west and east facades will need to be modified to Type II. The
width of the landscaping on the west and east sides varies and a pedestrian walkway prevents
location of landscaping near the building in certain areas. The length of these areas is less than
60'; therefore, on balance the intent of this design guideline section is met. Window openings,
wall projections and material variations provide other methods of articulation and accessory
elements in the overall architectural design.
d. Pedestrian circulation — Pedestrian pathways are incorporated into the site design. The
proposal is for an accessory pool building to the main motel. There is an existing bridge from
the motel building to the pool building site. A new pedestrian pathway will take guests from the
bridge to the pool building entrance and to the parking lot.
e. District guidelines —The principal entrance fagade is clearly recognizable from South 347t'
Place. The entrance is angled and would be clearly recognizable from the right-of-way. The
building entrance incorporates transparent glass.
12. Transportation — As the project will not add rooms to the motel, no vehicle trips are added to the
system as a result of this project. Therefore, no concurrency, traffic impact fee, or frontage
improvements are required.
13. Stormwater — There are no major stormwater requirements for this project; technical review
comments will be addressed through the building permit process. If the project changes (i.e.,
additional removal/ replacement of impervious surfaces), then the site may trigger the Non-
conforming Water Quality Code (19.30.120), since the current project gets the site to within about
200 square feet of triggering that code section.
14. Water/Sewer — Lakehaven Utility District is the water and sewer service provider. Service
connections for the pool building need to be obtained by the applicant. A Certificate of Water
Availability (issued separately by Lakehaven upon the applicant's request) may be required to be
submitted with a building permit application. Applicable utility related handouts are enclosed with
this decision for the applicant's use.
15. Building Permit — The City's Building Division is currently reviewing the building permit (File
# 14-103 866-00-CO). No work may begin until building permit approval. Please contact the Permit
Center at 253-835-2607, or permitcenter@cityoffederalway.com, if you have any questions
regarding the building permit.
16. Decision Criteria — Staff finds the proposal is consistent with applicable site plan approval criteria
required for Process H as set forth in FWRC 19.60.050. The proposal is consistent with the city's
comprehensive plan; applicable provisions of FWRC Title 19 Zoning and Development Code; public
health, safety, and welfare; and streets and utilities in the area are adequate to serve the anticipated
demand from the proposal. As conditioned, the proposal is consistent with Community Design
Guideline decisional criteria set forth in FWRC Chapter 19.115.

Final construction drawings will be reviewed for compliance with specific regulations, conditions of
approval, and other applicable city requirements. These findings shall not waive compliance with future

1. The term "mortgage" when used herein shall include deed of trust, trust deed, or other security
instrument.
2. If the proposed Insured has or acquires actual knowledge of a defect, lien, encumbrance,
adverse claim or other matter affecting the estate or interest or mortgage thereon covered by
this Commitment, other than those shown in Schedule B hereof, and shall fail to disclose such
knowledge to the Company in writing, the Company shall be relieved from liability for any loss or
damage resulting from any act or reliance hereon to the extent the Company is prejudiced by

to the Company, or if the Company otherwise acquires actual knowledge of any such defect, lien,

3. Liability of the Company under this Commitment shall be only to the named proposed Insured
and such parties included under the definition of Insured in the form of Policy or Policies
committed for, and only for actual loss incurred in reliance hereon in undertaking in good faith
(a) to comply with the requirements hereof, or (b) to eliminate exceptions shown in Schedule B,
or (c) to acquire or create the estate or interest or mortgage thereon covered by this

Introduction
The report addresses the drainage impacts of a proposed swimming pool enclosure building for the Red
Lion Hotel in Federal Way, Washington. The construction cost of this project is estimated at
$450,000.00, with a finished value of $500,000.00. Total property, existing hotel building and proposed
swimming pool building is valued at $5.0 million.
The new swimming pool building will be built in the same location as an existing parking lot. The project
area will actually decrease the impervious area by 2200 square feet. The existing impervious area is
6124 square feet and the proposed impervious area will be 3924. The proposed project will remove
6124 square feet of an existing asphalt parking lot and replace it with a 3440 square foot swimming
pool enclosure building with sidewalks leading from existing parking to the building.
There will be virtually no drainage impacts as a result of this project. Each of the 8 Core requirements as
well as the 5 special requirements is addressed in the following report.
8 Core Requirements
Core 1: Discharge at a Natural location
This project site previously drained to existing catch basins and will continue to do so after this project is
established. This project will decrease site runoff as landscape area will be added and area yard drains
will collect and additional runoff prior to the runoff leaving the site.
Core 2: Offsite Analysis
Catch basins, gutter and other runoff interceptors are existing to prevent offsite runoff from entering
the proposed site. Due to the site already being developed there are not expected to be any offsite
impacts.
Core 3: This requirement is not applicable as we are decreasing the impervious area. This requirement
establishes flow control for projects that increase the impervious area by 2000 square feet or more. As
stated earlier we are decreasing the impervious area by 3000 square feet.
Core 4: Conveyance System
The proposed project will take advantage of the existing conveyance system. The Storm Water Utility
plan will include the addition of yard drains and a 4" collection pipe to tie into the existing conveyance
system. The components have been sized to handle the peak flows as required by the KCSWDM.
Core 5: Erosion Control
There will be no permanent erosion control and sediment issues with the construction of this site. By
decreasing the impervious area and increasing the landscape area, there will be less run-off and
therefore less erosion and sediment runoff. During construction silt fence will be places along the East
and South sides of the site area to prevent erosion and sediment transport off the site. All existing
storm water catch basins will have inlet protection placed around them and as the proposed yard drains
are constructed they too will have inlet protection placed around them for the duration of the project.
Core 6: Maintenance and Operation
They property owner will assume responsibility of keeping the additional yard drains clear of debris and
ensuring that proper grading allows for the free flow of any runoff to the catch basin.
Core 7: Financial guarantees and responsibility
The owner shall comply with the liability requirements as set forth in KCC 9.04.100 and the financial
guarantee requirements of KCC Title 27A.
Core 8: Water Quality
This requirement is not applicable as the new impervious area is actually decreasing.
Special Requirement 1: Other adopted area -specific requirements
This special requirement is not applicable to this project. There are no critical area, stream or master
drainage plans that this project falls under.
Special Requirement 2: Flood pla in/floodway delineation
This project does not fall in a floodway hazard area.
Special Requirement 3: Flood Protection facilities
There are no flood protection facilities in the project area.
Special Requirement 4: Source Control
Downspouts will be placed to catch building runoff from the proposed swimming pool enclosure. Yard
drains will collect any ground water runoff. There will be no contact of pollutants with the runoff
leaving the site.

This is not a high —use site and will not require oil control.

(CPTED) Checklist Instructions
This checklist is designed to assist the project proponent in demonstrating how CPTED principles have
been met. This goal can also be met by submitting a written explanation as to how each of the three design
principles of Natural Surveillance, Access Control, and Ownership has been met.
The checklist has been prepared to provide guidance and assistance in regard to the integration of CPTED
principles into proposed project designs. The purpose of the checklist is to assist a project proponent in
identifying and incorporating design strategies that implement the CPTED principles identified in Federal
Way Revised Code (FWRC) 19.115.010.
CPTED principles, performance standards, and strategies are used during project development review to
identify and incorporate design features, which reduce opportunities for criminal activity to occur. The
effectiveness of CPTED is based on the fact that criminals make rational choices about their targets. In
general:
(1) The greater the risk of being seen, challenged, or caught; the less likely they are to commit
a crime.
(2) The greater the effort required, the less likely they are to commit a crime.
(3) The lesser the actual or perceived rewards, the less likely they are to commit a crime.
Through use of CPTED principles, the built environment can be designed and managed to ensure:
(1) There is more chance of being seen, challenged, or caught;
(2) Greater effort is required;
(3) The actual or perceived rewards are less; and
(4) Opportunities for criminal activity are minimized.
CPTED Design Principles
CPTED design principles are functionally grouped into three categories:
(1) Natural Surveillance. This category focuses on strategies to design the built environment in
a manner that promotes visibility of public spaces and areas.
(2) Access Control. This category focuses on the techniques that prevent and/or deter
unauthorized and/or inappropriate access.
(3) Ownership. This category focuses on strategies to reduce the perception of areas as
C'ownerless'-' and- therefore available -for undesirable -uses

Locate elevated light fixtures (poles, light standards, etc.) in a
