The applicant proposes to subdivide one single-family residential lot into two single-family residential lots, including Wetland Tract "A", Open Space Tract "B", future Tract "X", and 9-foot right-of-way dedication along SW 312th Street. The City received the application on November 30, 2016, and deemed it complete on December 15, 2016. The City of Federal Way hereby grants conditional preliminary approval of the Noyes Short Plat, subject to the conditions noted below. This preliminary approval corresponds to, but is not limited to, the following documents submitted by the applicant: Three -page short plat drawing, prepared by Leroy Surveyors and Engineers, date stamped resubmitted July 5, 2017. Lot Closure Report, prepared by Leroy Surveyors & Engineers, date stamped resubmitted June 9, 2017. Updated Wetland Delineation and Rating, prepared by Altmann Oliver Associates, LLC, dated October 24, 2016. CONCLUSION This Decision of the Director is based on the enclosed Statement of Facts (Exhibit A) and is in accordance with the following criteria pursuant to Federal Way Revised Code (FWRC) 18.30.110(2): 1. The applicant must submit a wetland sign and split rail fence details to the City for review prior to installation. 2. The applicant must install the split rail fence and signage along the edge of the wetland buffer/Tract A. 3. The applicant must submit a written letter from the applicant's wetland/stream consultant verifying the split rail fence was installed correctly along the delineated wetland buffer edge. 4. The second driveway to the loop must be abandoned and re -vegetated. 5. The existing driveway/access to the loop depicted on the drawing must be removed from Sheet 2. 6. LD. 76001 A�k CITY OF Federal Way Exhibit A Statement of Facts Noyes Plat, File No. 16-105655-00-SU The Planning Division hereby makes the following Findings of Facts pursuant to content requirements of the Short Subdivision decision as set forth in Federal Way Revised Code (FWRC) 18.30.110. These facts are in reference to King County tax parcel number 072104-9082 located at 31327 101h Place SW, Federal Way. Proposal — The applicant proposes to subdivide one existing 206,218 square -foot (4.72 acres) single-family lot into two single-family residential lots, Open Space Tract, Wetland Tract, Tract X, and 9-foot right-of-way dedication. Lot 1 will be 36,822 square feet in size and has an existing single family residence. Lot 2 will be 89,622 square feet in size overall, 64,715 square feet minus Tract X. Tract X is 24,907 square feet, Tract A is 50,163 square feet and Tract B is 26,647 square feet. The 9-foot right-of-way dedication is 2,962 square feet. 2. Review Process — Pursuant to FWRC Chapter 18.30 `Short Subdivision Plats,' the proposed short plat is subject to administrative review and decision rendered by the Director of Community Development. The proposal has been reviewed by staff from the Department of Community Development, Public Works, Lakehaven Utility District, and South King Fire and Rescue. City staff used the following FWRC development regulations when reviewing the short subdivision application: Title 14 `Environmental Policy;' Title 16 `Surface Water Management;' Title 18 `Subdivisions;' and Title 19, `Zoning and Development Code.' Public Notice & Comment — A Notice of Land Use Application for the short subdivision was published in the Federal Way Mirror and posted at the subject property and city designated notice boards on July 11, 2014. One comment letter was received regarding the short subdivision application. 4. Density & Zoning District Regulations — The subject property is located within a Single - Family Residential (RS 7.2) zone with a minimum lot size requirement of 7,200 square feet. The proposal meets the density requirement as noted above. FWRC 19.200.010 "Detached Dwelling Unit" prescribes setback, height, and parking and lot coverage requirements. Future building permit applications will be reviewed for compliance with these provisions. Driveway — Per FWRC 19.125.280(3), no more than one driveway for each 330 feet of lot frontage is allowed. A driveway and/or parking pad, in a required front yard, may not exceed 20 feet in width except if: i. It serves a three -car garage; ii. The subject property is at least 60 feet in width; and iii. The garage is located no more than 40 feet from the front property line. The existing driveway to the three -car garage can remain as -is. The second driveway/access to the loop depicted on the drawing must be removed from Sheet 2. The second driveway must be abandoned and re -vegetated prior to recording. Comprehensive Plan — The subject property's comprehensive plan designation is Single - Family — High -Density Residential. The proposal provides an urban density consistent with the Federal Way Comprehensive Plan (FWCP) designation. The proposal meets relevant goals and policies of the FWCP. 7. State Environmental Policy Act (SEPA) —The two -lot short plat is exempt from environmental review pursuant to Washington Administrative Code (WAC) 197-11-800(6)(d). 8. Site Profile — The subject property is located at 31327 101h Place SW. The site is flat, with a gentle slope of three percent. The site slopes gradually from the center to the northeast and to the southwest. The northern half of the property is deciduous forest with dense scrub/shrub understory. A wetland is located in the northeast portion of the property. 9. Critical Areas — The applicant submitted to the City the Updated Wetland Delineation and Rating, prepared by Altmann Oliver Associates, LLC. The report was peer reviewed by the City's wetland consultant, Landau Associates, and concurred with the report. There is an onsite Category III wetland with 60-foot buffer, which is consistent with the habitat score and wetland rating pursuant to FWRC 19.145.420(2). The short plat drawing accurately depicts the wetland boundaries and buffer. Prior to recording the short plat, the applicant must install the split rail fence and signage along the edge of the wetland buffer/Tract A. The applicant must submit a written letter from the applicant's wetland/stream consultant verifying the split rail fence was installed correctly along the delineated wetland buffer edge. 10. Tree and Vegetation Retention/Replacement — Single-family residential zones are required to maintain a minimum of 25 tree units per acre. The total required tree units for the subject property are based on the gross land area (4.72 acres). The site is required to maintain a total of 118 tree units. No trees are proposed to be removed as part of this short subdivision. 11. Open Space — The applicant is providing on -site open space in the amount of 15% of the land or 30,933 square feet. Usable open space in the amount of 26,647 square feet is provided and the remaining open space is conservation open space, located within Tract A, open space/wetland buffer. The applicant has proposed a walking trail for the usable open space. A trail system for use of all property owners must be installed prior to recording the short plat. The applicant has placed a note on the face of the plat regarding usable open space ownership and maintenance. 12. Concurrency — The city's Traffic Division reviewed the applicant's concurrency application and concludes the proposed short subdivision will generate 2 new PM peak hour trips. Traffic Division staff have determined that all intersections impacted by one or more weekday evening peak hour trips from the proposed development would meet the level of service (LOS) standards with programmed improvements; therefore, a Capacity Reserve Certificate was issued January 19, 2017. In order to mitigate the impacts of new development on the city's street infrastructure, the applicant will be subject to the transportation impact fee (TIF). Street Frontage Improvements — SW 3121h St is a Principal Arterial planned as a Type "K" street, consisting of a 44-foot street with curb and gutter, six-foot planter strips with street trees, 8-foot sidewalks, and street lights in a 78-foot right-of-way (ROW). Determination and Extent of Liability. Reduction of Liability or Termination of Liability. (a) No payment shall be made without producing this Guarantee for endorsement of the payment unless the Guarantee has been lost or destroyed, in which case proof of loss or destruction shall be furnished to the satisfaction of the Company. (b) When liability and the extent of loss or damage has been definitely fixed in accordance with these Conditions and Stipulations, the loss or damage shall be payable within thirty (30) days thereafter. Subrogation Upon Payment or Settlement. Whenever the Company shall have settled and paid a claim under this Guarantee, all right of subrogation shall vest in the Company unaffected by any act of the Assured claimant. The Company shall be subrogated to and be entitled to all rights and remedies which the Assured would have had against any person or property in respect to the claim had this Guarantee not been issued. Agreement to Dedicate Tract "X" Grantor hereby covenants and agrees, for itself, its successors, grantees, and assigns, to dedicate Tract "X" to the City of Federal Way for right-of-way and street purposes at such time as the City determines in its discretion that Tract "X" is needed for these purposes. A Statutory Warranty Deed in a form acceptable to the City, and conveying Tract "X" to the City shall be executed by the Grantor, its successors, grantees, or assigns, and shall be delivered to the City upon demand. The Statutory Warranty Deed shall convey title subject to taxes and assessments not yet due. 3. Encroachment into Tract "X." 3.1 No structures currently encroach into Tract "X." There shall be no encroachment into "Tract X" by any structure. 3.2 The parties recognize that the Grantor has installed a driveway and utilities and may install utilities in the future to serve the Project. Some of these utilities are or may, in the future, be located in the Tract "X." The Grantor covenants and agrees for itself, its successors, grantees and assigns to remove or relocate any of said driveway and/or utilities that the City determines interfere with the construction of City road improvements within the Tract' X." 4. Access and utility easement. Grantor has created an easement over the Tract X to allow access and utilities to be extended to lot 1 of the Noyes Short Plat. Grantor agrees that when the Tract X becomes dedicated right-of-way, and road improvements are completed, this easement shall become null and void and shall be relinquished via recorded document. 5. Agreement to Participate in and Not Oppose LID. For a period not to exceed ten (10) years from the date of this Agreement, Grantor covenants and agrees, for itself, its successors, grantees, and assigns, to participate in, and not oppose, protest, or challenge, the formation of a Local Improvement District ("LID"), or the approval and execution of a Latecomers' Agreement under Chapter 18.65 FWRC and RCW 35.72.010—.050, for construction of any road or street improvement project approved by the City and designed to improve all or part of Tract "X." Timing of the formation, execution or approval of said LID, Latecomers' Agreement, or other road or street improvement project shall be determined by the City of Federal Way, in its sole discretion. To the extent permitted by state law, the City shall reduce the assessment to the Grantor for the value of the Tract "X" dedication. 6. Utility Easement. Grantor conveys and warrants to the City a nonexclusive perpetual easement over, under, along, across, and through Tract "X" to construct, operate, maintain, repair, replace, improve, remove, enlarge, and use for one or more utility systems. At such time Tract "X" is dedicated to the City, the rights granted herein affecting Tract "X" shall automatically terminate. 7. Amendment of Covenants, Conditions, and Restrictions. Grantor covenants and agrees that this Agreement may be amended only with the proper written consent and agreement of both Grantor and the City, and that Grantor shall take no action that would limit or otherwise affect the rights of the City under this Agreement without the express written consent of the City. In the event either of the parties desire to relocate the Tract "X" on the Property prior to dedication, the relocation shall constitute an amendment requiring the written consent of the other party, which consent shall not be unreasonably withheld. 8. Agreement to Indemnify, Hold Harmless and Defend. Grantor covenants and agrees to indemnify, hold harmless, and defend the City from and against any and all liability, claims, damages, costs, expenses, including attorneys' fees, arising out of Grantor's breach of this Agreement. This agreement to indemnify, defend and hold harmless shall survive delivery and recording of the Statutory Warranty Deed and shall not merge in said Deed. 9. Authority. Grantor represents and warrants to the City that the Grantor has all of the necessary power and authority to enter into this Agreement and to perform the obligations to be performed by the Grantor hereunder, and the individual signing on behalf of the Grantor has full legal authority to do so. 10. Remedies. 10.1 The parties acknowledge and agree that the rights provided to each of them under this Agreement are unique. They further acknowledge and agree that, in the event of a breach by either party of its obligations under this Agreement, any remedy at law would be inadequate and that the other party would suffer irreparable harm as a result of such breach. Accordingly, each party hereby agrees and consents to temporary and permanent injunctive relief and/or an order of specific performance, without bond, in addition to money damages or other available relief in any proceeding brought by a party to enforce this Agreement. 10.2 In the event of a breach of this Agreement, the aggrieved party may pursue any remedy available under this Agreement or any other remedy or remedies available at law or in equity concurrently or consecutively and in any order as to any such breach or violation, and the pursuit of such remedies at any time shall not be deemed an election of remedies or waiver of the right to pursue any of the other of such remedies. 11.
