Dear Michelle Henry:
The Planning Division has reviewed the documents received on July 19, 2021 and September 17, 2021 as part
of the three Process III Master Land Use applications in response to the June 16, 2021 technical comment
letter (enclosed) and August 23, 2021 meeting with city staff, the applicant, applicant’s consultant, and the city
third party reviewer, Landau.
During preliminary review of the submitted documents Landau identified gaps in the analysis and suggested a
meeting and resubmittal of updated reports prior to conducting a complete review. Landau requested
evaluation of the proposed wetland buffer encroachment with criteria provided in Federal Way Revised Code
(FWRC) 19.145.090(3) and the stream buffer encroachment with criteria provided in FWRC 19.145.330.
Landau requested the applicant check consistency of impact calculations between the plans and reports and
properly describe the existing gravel road in reference to FWRC 19.145.440(4) (wetland buffers) and FWRC
19.145.270(4) (stream buffers).Upon resubmittal, the documents were sent to Landau for review. The
updated reports and plans do not satisfy all of the required revisions mentioned above. Prior to issuance of
decisions on the proposals, the application materials must be updated to address the technical comments in
the enclosed October 19, 2021, Peer Review Summary letter from Landau.

CLOSING
Please resubmit an updated critical areas report accompanied by the completed “Resubmittal Information
Form” for each process III application and include a letter indicating how the above comments have been
addressed. Resubmittal shall be done electronically through the document upload portal (Document Upload
Link).

According to FWRC 19.15.050, if an applicant fails to provide additional information to the city within 180
days of being notified that such information is requested, the application shall be deemed null and void and
the city shall have no duty to process, review, or issue any decisions concerning such an application.
Please note, the original plan review fee collected at submittal of your permit covers the initial review and
one resubmittal only. On September 1, 2021, the City began charging applicants for any additional staff time
necessary to complete each review following the first resubmittal. The fee will be 30% of the original
planning review cost due at the time of resubmittal to the Permit Center. Due to the nature of your
applications the resubmittal fee will only apply to one application instead of all three.
