Dear Michelle Henry:
City of Federal Way staff has reviewed your December 21, 2020, submittal of documents related to the Henry
Reasonable Use request application. City departments have provided the following comments that will need
to be addressed before issuance of a decision on your application, or as otherwise noted. Questions regarding
the technical review comments should be addressed to the referenced staff representative. Additionally,
enclosed in this technical comment letter are the public comments received during the Notice of Application
public comment period between January 29, 2021, and February 16, 2021. It is the responsibility of the
applicant to address the public comments received.
COMMUNITY DEVELOPMENT – PLANNING DIVISION

1. Stream Crossing – As discussed in the Preapplication Conference Summary letter (copy enclosed), the city
will review and decide upon the stream crossing. The Wetlands and Drainage Corridors Evaluation &
Delineation Report and Conceptual Wetland Mitigation Plan submitted with the application does not address the
proposed utility stream crossing. Revise the critical areas report to include responses to the decisional
criteria per FWRC 19.145.320. Additionally, for any stream buffer intrusions, the applicant shall
demonstrate that the remaining and enhanced reduced buffer will function at an equivalent or higher
level than the standard buffer.
A third-party review will be coordinated following a resubmittal of an updated critical areas report
adequately addressing the stream crossing pursuant to FWRC 19.145.080(3). The SEPA process will
begin once the updated critical areas report adequately addresses the stream crossing.
2. Required Yard Setbacks – The proposed 1486 square foot single-family residential footprint is proposed
utilizing a 15-foot front yard setback. Pursuant to FWRC 19.200.010, the RS15.0 zone requires a 20-foot
front yard setback. If the building footprint location does not allow for the required front yard setback
and does not exceed 25 percent of the measurable standard, an administrative variance can be applied for
under a Process III application. Variance decision criteria are contained in FWRC 19.45.030. The
applicant must provide a written response on how each of the variance criteria is met with the submittal;
see the enclosed submittal requirements handout.

3. Tree Retention – Pursuant to FWRC 19.120.130(1), all single-family zoned sites are required to maintain at
least 25 tree-units per acre. This can be met via preserving onsite trees and/or planting new trees. A tree
unit is a credit assigned to existing and replacement trees based on their size and species, respectively.
The submitted tree unit calculation form included a site area of 76,097 square feet, exceeding the lot area
of 36,744 square feet provided on the site plan. Trees located within critical area buffers (but not within
the wetland or stream themselves) can be credited towards satisfying the tree units per acre requirement.
Tree unit credits are found in Table 2 of FWRC 19.120.130-2. Provide an updated tree unit calculation
form for the site and how the tree unit standards will be met.
PUBLIC WORKS – DEVELOPMENT SERVICES DIVISION

1) Show and/or otherwise identify the flow control BMP’s for each lot on the Site & Stormwater Plan.
2) Provide preliminary sizing calculations for the individual residence dispersion trench. These calculations

Water Supply
Fire Flow
The required fire flow for this project is 1000 gallons per minute for residences not exceeding 3600 square feet,
including garage and covered areas. A Certificate of Water Availability including a hydraulic fire flow model shall be
requested from the water district and provided at the time of the building permit application.
Fire Hydrants
A fire hydrant shall be added to the other side of Hoyt Road to ensure the road is not fully blocked by a fire
hose. Suggest putting it next to the private road from Hoyt.
Emergency Access:
Fire apparatus access roads shall comply with all requirements of Fire Access Policy 10.006

approved turnaround is not provided.
Fire Sprinkler System
Fire sprinklers ARE required due to limited access and no approved turnaround.

CLOSING
Please make the following corrections and resubmit the short plat drawing accompanied by the completed
“Resubmittal Information Form,” and a letter indicating how the above comments have been addressed.
Pursuant to FWRC 18.05.080, if an applicant fails to provide additional information to the city within 180
days of being notified that such information is requested, the application shall be deemed null and void and
the city shall have no duty to process, review, or issue any decisions concerning such an application.
