Dear Twin Lakes Plaza LLC:
City staff has conducted review of your January 15, 2021, submittal of documents as part of the Process II
Master Land Use (MLU) application for the proposed Jump Start Espresso drive thru fast food restaurant at
the above-mentioned address. City staff has provided the following comments that will need to be addressed
prior to approval of your application, or as otherwise noted. Questions regarding the technical review
comments should be addressed to the referenced staff representative.
COMMUNITY DEVELOPMENT – PLANNING DIVISION

1. Plans indicate that the parking will be shared with an abutting parcel. Shared parking agreements shall be
in accordance with Federal Way Revised Code (FWRC) 19.130.120, including evaluation of parking demand
for any properties/uses that are sharing property. Submit a shared parking agreement and required
documentation in accordance with FWRC 19.130.120.
2. Pursuant to FWRC 19.215.020(6), fast food restaurants must provide one outdoor waste receptacle for
every eight parking spaces. The site plan does not depict the required waste receptacles.
3. Pursuant to FWRC 19.215.020, minimum required yard setbacks are 10 feet from each side and 10 feet
from the rear. The site plan incorrectly labels the front property line containing the primary vehicular
access with a 10-foot setback. Revise the site plan to accurately depict required yard setbacks.
4. The proposed pedestrian pathways need to meet the criteria per FWRC 19.115.050(4)(b), and be shown
on the landscape plan.
5. Per FWRC 19.120.120(6), retaining walls shall have a maximum of six feet in height as measured from the
finished grade at the base of wall to top of wall in commercial zones. Provide elevation drawings of the
proposed retaining wall and demonstrate compliance with the maximum height requirement.

PUBLIC WORKS – DEVELOPMENT SERVICES DIVISION

The Public Works Development Services Division has conducted a review of the submitted materials and the
applicant must provide the following additions and corrections before applying for an engineering permit
(EN) and completing any civil improvements.
1) Plans indicate the use of an underground Biopod water quality treatment system underneath the
proposed drive thru in order to meet the enhanced basic water quality treatment menu. Water quality
facilities for commercial developments outside of the City Center Core must be above ground.
Underground facilities are only allowed with approval from the Public Works Department. This will
require a variance request to be submitted to the Public Works Director for consideration.
2) You are proposing onsite bioretention to meet core requirement #9 and mitigate 42.39 percent of the
target impervious surfaces. You have referenced that the geotechnical engineer stated in the soils report
that the onsite soils are gravelly silty sands to support the feasibility of bioretention. He also states in the
report that these types of soils are “referred to as glacial till” and the “near-surface glacial till soils will not
allow downward percolation of any shallow infiltrated water, which would move laterally toward the
sidewalk and street to the south and the maintenance yard to the west.” Appendix C of the King County
Surface Water Design Manual (KCSWDM), Section C.2.6 states, “Many locations in King County have soils
that are underlain by a compacted layer of soil (i.e., glacial till or hardpan) which severely limits soaking
capacity and causes water to perch on the relatively impervious layer during the wet season. This can
make bioretention impracticable, unreliable, and reduce plant survivability in the bioretention system.
Thus, a soils report is necessary to identify soil types, depth to impermeable layers (hardpan) or the
maximum wet season groundwater level, and infiltration rates.” The submitted soils report does not
discuss infiltration rates and states that infiltration would be infeasible for this site. Please confer with the
geotech to provide his opinion of the feasibility of bioretention in light of these details.
3) Please include the existing width of SW 320th Street, the existing right-of-way line, and existing
improvements. Although the new sidewalk, curb, and gutter are shown, the dimensions of the new
improvements are not.
4) Per the Traffic Division, an additional four feet of right-of-way dedication is required across the frontage
of the parcel, and will need to be reflected on the plans. As such, building setbacks may need to be
adjusted along with any new appurtenances and asphalt sections that encroach or cross other utilities.
5) Please include the total area of the site on the plans. Include existing and new impervious surface areas
with totals. Include the building dimensions.
6) A Technical Information Report (TIR) worksheet will need to be added to the existing TIR.
7) The Operation and Maintenance Manual states that the City of Kent is to review and approve any changes to
this manual prior to its implementation. Change this to the City of Federal Way.
8) Please include flow arrows on newly submitted engineering plans that clearly designate the inlets and outlets.
9) FWRC Chapter 19.96 requires that a system development charge (SDC) be paid prior to connection of
private stormwater infrastructure to the public drainage system. This charge is $981.00 per Equivalent
Service Unit (ESU). One ESU is 3,200 square feet of impervious surface area. The total fee will be
calculated upon receipt of the engineering permit/review submittal for total impervious surfaces.

The Public Works Traffic Division has finished its review of the submitted materials and provides the following
technical review comments:
Plans Comments
1. Show improvements and rights-of-way dedication along the frontage on SW 320th Street consistent with the
planned roadway cross-section Type “I” street. The improvement and rights-of-way dedication must be
shown on the plans, unless a rights-of-way modification waiver is approved by the Public Works Director.
▪ SW 320th Street is a Minor Arterial planned as a Type “I” street, consisting of a 58-foot
street with curb and gutter, 6-foot planter strips with street trees, 8-foot sidewalks, and
street lights in a 92-foot right-of-way. Assuming a symmetrical cross section, four-foot
right-of-way dedication and half street improvements are required as measured from the
street centerline.
The applicant may submit a written request to the Public Works Director to modify, defer, or waive the
required street improvements (FWRC 19.135.070). These modification requests have a nominal review
fee currently at $500, plus the recording fees.
2. Upgrade/improve the existing driveway to the current commercial driveway standard.
3. Traffic impact fee will be assessed at the time of the building permit using the fee schedule in effect at the
time a completed building permit application is filed, and must be paid prior to building permit issuance
(FWRC 19.100.070).
APPLICATION STATUS
The review period for the Use Process II will begin again within 14 days of a complete resubmittal of
items requested/corrected. Please make the corrections and resubmit the requested materials with a
completed “Resubmittal Information Form” (enclosed), and a letter indicating how the above comments
have been addressed.
All resubmittals need to go through the permit portal at https://www.cityoffederalway.com/node/4588.
Pursuant to FWRC 19.15.050, if an applicant fails to provide additional information to the city within 180
days of being notified that such information is requested, the application shall be deemed void.
