On July 23, 2001, you requested written clarrification regarding whether or not the above parcel would be considered a legal building site. In my August 8, 2001 response, I outlined the provisions contained in Federal Way City Code(FWCC) Section 22-953 that specify the criteria used to determine when a lot or parcel is considered a legal building site. After reviewing the information you have resubmitted for review and initiating additonal staff research, parcel number 322104-9144 would be considered a legal building site for one detached dwelling unit (single-family home). This determination is based on the following. As discussed in my August 2001 letter, in order to determine whether or not the above parcel would be considered a legal building site for one detached dwelling unit, the information verifying the following must be provided to the City: 1. There is or has ever been a residence on the subject property; or 2. The lot lines defining the lot or parcel were recorded in the county assessor's office prior to February 28, 1990, and the lot or parcel has not been simultaneously owned by the owner of a contiguous lot or parcel subsequent to that date. In your June 4, 2002 resubmittal, you have attempted to meet the second criteria by providing a copy of the 1967 King County Assessor's Map with written notes from Noreen Anderson, King County Deputy Assessor, regarding the possible dates the lot lines were recorded. In addition, you have provided a copy of the 1980 Statutory Warranty Deed for parcel 322104-9144. The information you resubmitted for City review did not satisfy the above criteria for determining Mr. Jerry Motomatsu Page 2 June 26, 2002 when a parcel is considered a legal building site for one detached dwelling unit. The following information, collected as a part of staff research, was used to determine that the above parcel is considered a legal building site for one detached dwelling unit. Parcel number 322104-9144 has a triangular shape that is bound on the north by South 373rd Street, to the south and east by South 373rd Place, and to the west by 8th Avenue South. After speaking to the City's Traffic Division, the age of each of the above roadways was conservatively estimated to be in excess of 20-years. Due to the estimated age of these roadways, the lot lines defining this parcel would have been defined prior to February 28, 1990. In addition, due to the separation between parcel 322104-9144 and all adjacent properties provided by the above roadways, simultaneous ownership of any contiguous lot or parcel subsequent to February 28, 1990 would not be possible. The County Assessors office was trying to figure out what to do with the parcel because the owners had not paid their taxes, and I believe the County was taking the land over. The problem with the parcel was the western part has 8th Avenue S running through it, but it does not show up on the assessors map of the that area as right of way. The roadway has been running through it for quite a few years, enough that it required an overlay in 1997. To me that means the road had to be there at least 20 years before that. As far as I can tell the City should own the land beneath the road based on adverse possession. The other roads, S 373rd Street and S 373rd Place(which actually show right of way on the map)are also older roads as they were overlaid last year. My guess would be they well older than 1990 as 373rd Street had been chip sealed as its previous treatment, which is a treatment the City doesn't use. This work would have been completed before the City was formed. We do not have plans for these roads in our hanging files so I could not get any data from that. You have asked for written confirmation regarding whether the lot is considered a legal buildable lot. The following text should provide an answer to your question. For reference, the property is located in a Single Family Residential zone (RS-35). Pursuant to Federal Way City Code(FWCC) Section 22-953, a lot or parcel is a legal building site if it meets all of the following criteria: 1. It was created or segregated pursuant to all applicable laws, ordinances, and regulation then in effect. 2. It is at least as large as the minimum lot size established by this chapter. 3. It is adjacent to a street, providing access to that lot or parcel, that meets the minimum requirements established by or under this chapter. Pursuant to FWCC Section 22-631, in the RS-35 zone the minimum lot size per-dwelling unit is 35,000 square feet. According to Metroscan records, your parcel is approximately 20,461 square feet in size. However, due to the recent roadway realignment/extension of 8th Avenue South, the size of the lot may be smaller. Because your parcel does not meet the minimum lot size .requirements, it is not considered a legal building site. Pursuant to FWCC Section 22-953(b), "Exceptions to Detached Dwelling Units,"subject to all other requirements of this chapter, an applicant may build one detached dwelling unit on a lot or parcel regardless of the size of the lot or parcel, if: Mr. Jerry Motomatsu Page 2 August 8, 2001 1. There is or has ever been a residence on the subject property; or 2. The lot lines defining the lot or parcel were recorded in the county assessor's office prior to February 28, 1990, and the lot or parcel has not simultaneously been owned by the owner of a contiguous lot or parcel subsequent to that date. To meet the first exception requirement, the applicant must submit documentation confirming that a residence is or was located on the property. During a recent site visit, the lot appeared vacant. To confirm if a residence was located on the property you will need to research the King County Assessor's records. While the lot lines defining the parcel were recorded in the county assessor's office prior to February 28, 1990, to meet the second exception requirement the applicant must submit a title report documenting that no contiguous ownership has existed subsequent to February 28, 1990. If either of the two exception requirements were fulfilled, the above-mentioned parcel would be a legal building site for one detached dwelling unit.
