Dear Ms. Moreno:
City departments have the following comments in response to your June 10, 2021, submittal. Some
comments provided herein are required and some are informative; others may be applicable during future
steps of the project. Comments in this letter need to be addressed prior to issuance of a land use application
decision, or as otherwise noted. Questions regarding technical review comments should be addressed to the

1. Technical comments made about an item on one sheet, or in a document, may necessitate changes to
other related sheets and documents. It is the applicant’s responsibility to determine any such necessary
adjustments. Please ensure consistent information is communicated throughout the plan set and
associated application materials.
2. Update the incorrect vicinity map in the plan set.
3. Please provide the proposed roof area information on the site plan.
4. Per FWRC 19.200.010 and the 19.05.160 definition of “property line,” a 20-foot setback applies along the
southern lot line, as that is where the primary vehicular access is and this lot is not a flag lot. As a result,
the eastern property line requires a five-foot setback. Adjust the site plan as needed to comply with the
required setbacks.

5. In accordance with FWRC 19.145.090(4), if the city grants a reasonable use request it shall grant the
minimum necessary to provide the applicant with some reasonable use of the subject property; any
waiver of requirements shall result in the minimum possible impacts to the function associated with
proposed improvements on affected critical areas.
Changes to the site layout and reduction of impervious improvements are possible. As a result of the
code above, and in consideration of comment #4, the proposed home and driveway need to be moved
further away from the on-site wetland; explore rotating the layout of the home and moving it further to
the east. Elimination of any excess driveway should be pursued as well. Adhere to the requirements for
driveways in FWRC 19.130.240(1).
6. In the wetland report, it shows a sign detail from King County; use the enclosed detail (3-56 NGPA sign).
7. The buffer enhancement plan needs to be revised to account for the revised location of the residence
pursuant to comments #4-5 above. The wetland fencing should match the project clearing limits and not
allow for extra yard area as shown on the plan in the northeast corner of the property. Also, see comment
#5 above regarding reasonable use and the minimum allowance necessary.
8. No public comments were received during the Notice of Application public comment period that concluded
on August 9, 2021.

Please be aware that this review does not preclude the city from requesting additional information related to
any of the topics discussed above. Please submit by electronic submittal (Document Upload Link or
https://www.cityoffederalway.com/node/4588) revised application materials as appropriate, a letter explaining
how these comments have been addressed, and the completed “Resubmittal Information Form” (enclosed).
Pursuant to FWRC 19.15.050, if an applicant fails to provide additional information to the city within 180
days of being notified by mail that such information is requested, the application shall be deemed null and
void and the city shall have no duty to process, review, or issue any decision with respect to such an
application. Extension requests submitted 30 days prior to the lapse of the 180-day notification that meet the
criteria listed in FWRC 19.15.050(2)(a-c) will be accepted.
