After evaluating the existing conditions along the referenced street and surrounding neighborhood, review of Federal Way Revised Code (FWRC) provisions (Section 19.135.070), and direction provided by the City Council, the Public Works Department hereby approves your request, as modified below. South 359th Street is classified as a Minor Collector, corresponding to City Standard Street Section Type “R”, which requires a 40-foot paved section, 4-foot planter strips, 6-foot sidewalks and 3-foot utility strips within a 66- foot right-of-way. Existing conditions along the parcel frontage with S 359th St consist of an approx. 20-foot paved roadway, 2-foot (+/-) dirt/gravel shoulder, and a drainage ditch, within a 60-foot right of way. The nearest curb, gutter, and sidewalk sections are approximately 1,000-feet in either direction of the site, to the west on Pac Hwy S, or to the east on 16th Ave S. South 359th is also identified as a Safe School Walking Route for Todd Beamer High School. FWRC Section 19.135.070; Modifications of Improvements Along Property Frontage allows the Public Works Department to grant a request to modify, defer, or waive the required street improvements only after consideration of four specific reasons. One of those reasons is contained in FWRC 19.135.070(1), “Improvements as required would not be harmonious with existing street improvements, would not function properly or safely, or would not be advantageous to the neighborhood or city as a whole.” The required improvements, as modified, are to have the developer install a 5-foot gravel shoulder along the property frontage to accommodate the school walking route. As a condition of future building permits, the applicant will also be required to record a Local Improvement District Waiver of Protest Covenant on each parcel. The developer will be required to obtain a City Right of Way Permit for our review of the design, and the applicant’s eventual construction, of the street improvements described above. Bonding for construction of the improvements will be required in the amount of 120% of the estimated cost of the improvements, and shall be obtained prior to any construction in the right of way. All frontage improvements shall be constructed prior to Final Building Permit sign-off or Certificate of Occupancy of either of the new residential permits. If a permit is not issued within the one-year time limit, this waiver will be void, and a new request for modification must be submitted.
