The Responsible Official of the City of Federal Way hereby makes the following Findings of
Fact based upon impacts identified in the environmental checklist and the "Final Staff Evaluation
for Environmental Checklist"; Federal Way application no. SEP94-0014, Conclusions of Law
based upon the interim 1990 Federal Way Comprehensive Plan, and other policies, plans, rules,
and regulations designated as a basis for exercise of substantive authority under the Washington
State Environmental Policy Act Rules pursuant to R.C.W. 43.21C.060.
Findings of Fact:
1. The proposal is to extend westbound and establish new eastbound HOV lanes
along South 348th Street; interconnect signals to improve signalization; add
landscaping to improve arterial aesthetics; construct stormwater facilities to
mitigate project impacts; and correct alignments and modify the crest vertical
curve of South 348th Street.
2. Existing zoning adjacent to the subject site is Business Commercial (BC) and
Office Park (OP).
3. Current uses of the site and surrounding area include the following:
Site: Developed Roadway.
North: Retail, Commercial, Office and Roadway.
South: Retail, Commercial, Truck Stop and Roadway.
East: Retail and Commercial, I-5.
West: Retail and Commercial, Roadway.
6. Preliminary estimates indicate 4,770 cubic yards of material excavated, 7,160
cubic yards of gravel fill imported. Cuts and fills are necessary for the
construction of sidewalks, landscaping, road alignment and storm water drainage
facilities. Imported materials will be from local sources.
7. Any erosion -related impacts during clearing and construction will be mitigated by
implementing a Temporary Erosion/Sedimentation Control (TESC) plan.
8. As with all paved developed areas, the new asphalt areas will contribute some
pollutants to ground and surface waters by means of storm water runoff across
the site. Some of these pollutants can be extracted from the runoff by use of
grass -lined biofiltration swales.
The site will contain a bioswale and detention facility.
9. To control downstream impact of new development, including public and private
streets and highways and where storm water detention is required by code, the
facilities shall be sized in accordance with recommendation BW-3 of the
Executive Proposed Basin Plan, Hylebos Creek and Lower Puget Sound.
Condition #1 below addresses this issue.
10. The environment will be improved by adding landscape medians and landscaping
along the sides of roadways and sidewalks. New landscaping materials (i.e.,
plants, trees, and groundcovers) will consist primarily of drought -tolerant species.
11. The Final Staff Evaluation for Environmental Checklist, Federal Way Application
No. SEP94-0014 is hereby incorporated by reference as though set forth in full.
Conclusions of Law:
Federal Way Comprehensive Plan Policies (1990)
FWCP Section C-25 - Assure that commercial development has minimal impact
on lakes, streams and drainage ways, air quality or noise levels.
The lead agency has determined that the proposed action does not have a probable
significant adverse impact on the environment, and an Environmental Impact Statement
(EIS) is not required under RCW 43.21C.030(2)(c), only if the following conditions are
met. This decision was made after review of a completed environmental checklist, site
visits, and other information and reports on file with the lead agency. This information
is available to the public on request.
Conditions: 1. Runoff from the additional impervious surface areas shall be
controlled by the use of on -site detention per the King County
Surface Design Manual (KCSWDM) and recommendation BW-3
of the Hylebos Creek and Lower Puget Sound Basin Plan unless
additional regional detention is developed. Runoff is restricted to
70 % of the pre -developed two-year runoff with storage provided
for a 100-year storm event. 30 % factor of safety is not required.
This MDNS is issued under WAC 197-11-340(2); the lead agency will not act on this proposal
for 15 days from the date of issuance. Comments must be submitted no later than 5 p.m.
August 24, 1994.
Unless modified by the City, this determination will become final following expiration of the
above comment deadline. Any person aggrieved of the City's final determination may file an
appeal with the City within 14 calendar days of the above comment deadline.

and paving operations.

Construction activity, especially site preparation work, will contribute to a
short term increase in local suspended particulate levels. Construction activity
also contributes to carbon monoxide levels through the operation of
construction machinery, the use of trucks to deliver equipment and materials,
and worker access to the site by automobile. These activities also involve
emissions of hydrocarbons and oxides of nitrogen, potentially elevating the
level of photochemical oxidants, such as ozone, in the ambient air.

In addition, compliance with local, state and federal air quality standards
provide sufficient mitigation of these potential impacts. In addition,
enhancement of on -site vegetation and landscaping will provide filtering of
suspended particulates. In order to minimize dust impacts created by vehicles
tracking dirt off -site, a requirement to wash, as necessary as determined by
the City, all vehicles prior to leaving the construction site will be imposed as
part of the TESC Plan to be reviewed and approved by the City of Federal
Way.
It is expected that by reducing delays experienced by vehicles traveling the
348th Corridor, emissions will be reduced.
No further mitigation is required.

Policies adopted by Federal Way, and contained within the 1990 Federal Way
Comprehensive Plan, which serve as a basis for the exercise of substantive SEPA
authority to approve, condition or deny proposed actions applicable to potential
adverse environmental impacts resulting from this project include the following:
FWCC Section C-25 - Assure that commercial development has minimal
impact on lakes, streams and drainage ways, air quality or noise levels.
These policies serve as a basis for requiring the following SEPA condition:

1. Runoff from the additional impervious surface areas shall be controlled
by the use of on -site detention per the King County Surface Design
Manual (KCSWDM) and recommendation BW-3 of the Hylebos Creek
and Lower Puget Sound Basin Plan unless additional regional detention
is developed. Runoff is restricted to 70 % of the pre -developed two-year
runoff with storage provided for a 100-year storm event. 30 % factor of
safety is not required.

V. CONCLUSION:
The proposal can be found to not have a probable significant adverse impact on the
environment if appropriate conditions are properly implemented pursuant to a mitigated
determination of nonsignificance (MDNS).
Conditions of the MDNS are based upon impacts identified within the environmental
checklist, attachments, and the above 'FINAL STAFF EVALUATION FOR
ENVIRONMENTAL CHECKLIST APPLICATION NO. SEP94-0014 and are supported by
plans, policies and regulations formally adopted by Federal Way for the exercise of
substantive authority under SEPA to approve, condition or deny proposed actions.
The City reserves the right to review any future revisions or alterations to the site or to the
proposal in order to determine the environmental significance or non -significance of the
project at that point in time.

The checklist and construction plans available in the Public Works Department for the
proposed redevelopment of S. 348th Street have been reviewed and the following comments
are provided for the SEPA determination:
A(7) Further activity related to this work will be the future signal coordination with other
signals in the immediate roadway network.
B(1)(g) The checklist indicates that the same amount of impervious surface area will
result from the widening of the street. How will this take place? What
impervious areas will be removed to compensate for the new areas?
B(3)(c)(1) The plans for this project propose to treat runoff from approximately the
eastern half of the roadway through a coalescing plate oil/water separator.
Runoff from this area then proceeds into the head of the biofiltration
swale/detention facility along the roadway. The western portion of the
roadway east of Pacific Higway South is to be collected and conveyed directly
into the proposed biofiltration swale/detention facility approximately midway
along the swale's course without any oil/water separation. The extreme
western portion of the site does not propose any oil/water separation or
detention. The runoff from this area is conveyed along S. 348th Street
westward to the Hylebos wetland area.
The plans should be modified to provide coalescing oil/water separation for all
areas of the site as a retrofit measure required under the nonconformance
section of the Federal Way City Code, 22-330(a)(6), for immediate compliance
with water quality standards. This would require an additional separator prior
to discharge of the western portion of the site east of Pacific Highway South
into the biofiltration swale. In lieu of an additional separator and to achieve
better treatment through the swale instead of combining untreated water with
partially biofiltered water, the runoff from this area should be routed to the
east and the proposed separator at the head of the swale be upsized and
utilized. The extreme western portion of the site should also be retrofitted
with a coalescing separator in the right-of-way prior to discharging into the
hylebos wetlands.
Consideration should be given to the orientation of the drainage facilities to
allow future by-passing of high flows around the biofiltration swale to the
Pacific Highway drainage system and transferring the detention to a future
Welter's pond regional site. Can the upstream bypass piping along the south
side of S. 348th St. be utilized as a high -flow bypass for the street system
around the biofiltration swale?
B(5)(c) The site is located in the Pacific Flyway, a significant route for migrating
waterfowl.
B(7)(b)(2) Night time construction activities will require the written approval from the
Director of Community Development per Section 22-1006 of the FWCC.

General
A plan view of the proposed project is illustrated in
Figures 2-A and 2-B. The main elements of the proposed
project consist of the following improvements:
+ Extend westbound and establish new eastbound HOV lanes
within the project limits (with sufficient width to
accommodate bicyclists).
• Sidewalks on both sides of South 348th Street.
• Signal interconnect to improve signal coordination.
• Landscaping to improve arterial aesthetics and
reinforce the concept of South 348th Street as a
"Gateway" to the City of Federal Way.
+ Stormwater facilities to mitigate project impacts on
the Hylebos Drainage Basin.
• A horizontal alignment shift near SR-99 to best
accommodate the new roadway channelization.
• Modification of the crest vertical curve at the South
348th Street/SR-99 intersection. This will eliminate a
sight distance problem across SR-99.
• The horizontal kink in the South 348th Street alignment
will be straightened to reduce the horizontal offset
across SR-99.
The proposed project elements are the result of analysis
conducted for the Predesign Report, direction from City
staff, and input from local property owners.
The HOV lanes are one of the principal reasons for the
project. Regional policies are encouraging the use of

transit. Development of HOV lanes on arterial streets is
viewed as a means to further enhance the viability of the
regional HOV system. Although they are anticipated to have
minimal impact on improving the level of congestion in the
project corridor for single occupancy vehicles (SOV), the
HOV lanes are intended to provide a time advantage to
transit vehicles using the corridor. A queue jump is
proposed to be included for westbound transit vehicles at
the South 348th Street intersection with SR-99. Additional
width has been incorporated into the proposed HOV lane to
accommodate bicycles and encourage alternative modes of
transportation.
Sidewalks have been proposed to provide better delineation
between pedestrians and vehicles. Vehicular volumes within
the corridor are extremely heavy with average week day
travel volumes over 36,000 vehicles. Pedestrian activity is
constant, although not as heavy as would occur in an urban
environment. As a result, eight -foot sidewalks have been
proposed for the project.
A signal interconnect will be incorporated in order to
improve traffic flow within the corridor. The interconnect
systems are a relatively inexpensive means to improve the
traffic congestion in the area.
A key to the proposed aesthetic improvements in the corridor
is the desire expressed by the local community that South
348th Street represents a "gateway" to the City of Federal
Way. The "gateway" concept for the project is accomplished
by incorporating street trees, shrubs and ground cover into
the project. The proposed landscaped median would also
minimize left -turn opportunities in the corridor. The left -
turns are a contributing element to the corridor's traffic
congestion.
A combined water quality/detention system has been developed
for the project which meets the Hylobos Drainage Basin
requirements for new projects. The proposed system will not
require any additional right-of-way (although some fill on
the site of the truck stop's long-term parking lot will be
necessary). The proposed water quality/detention facility
serves the dual purpose of providing water quality treatment
under low flow conditions and detention for the project
design storm. The additional fill on the site of the truck
stop's long-term parking lot is proposed instead of a wall
that would be required to keep project impacts within the
right-of-way. The fill will still allow the area to be
used for parking while minimizing costs.
The proposed horizontal alignment shift near SR-99 will
accommodate the new roadway channelization and improve
geometrics. The shift is a modification which allows the
South 348th Street channelization on the east side of SR-99
to align as best as possible with the channelization on the
west side of SR-99.
The crest vertical curve on South 348th Street at the SR-99
intersection currently accommodates a design speed of less
than 25 mph for stopping sight distance. The proposed
improvements will correct this deficiency to meet the
project design speed of 40 mph for stopping sight distance.
Several alternatives were considered with the proposed
profile providing a minimal impact to both the existing SR-
99 profile and properties adjacent to South 348th Street.
The proposed roadway profile is illustrated in Figure 3.
12. Location of the proposal. Give sufficient information for a
person to understand the precise location of your proposed
project, including a street address, if any, and section,
township, and range, if known. If a proposal would occur
over a range of area, provide the range or boundaries of the
site(s). Provide a legal description, site plan, vicinity
map, and plans required by the agency, you are not required
to duplicate maps or detailed plans submitted with any
permit applications related to this checklist.
The project is located within the City of Federal Way in
Township 21N, Range 4E, Section 20. The principal area of
construction consists of the South 348th Street corridor
from SR-161 (also known as 16th Avenue South) and west just
beyond SR-99 (a.k.a. Pacific Highway South). In addition,
signal interconnect systems are planned along South 348th
Street from I-5 to 1st Avenue, and along SR-99 from 356th
Street to 336th Street. A left turn signal will also be
added on 1st Avenue at 348th Street. A vicinity map and
site plan are shown in Figures 1, 2A and 2B.
B. ENVIRONMENTAL ELEMENTS
1. Earth
a. General description of the site (circle one): Flat,
rolling, hilly, steep slopes, mountainous, other

Approximately 25 percent along road sideslopes and ditches.

The Soil Conservation Service Soil Survey for King County
(1973) indicates the site area is underlain by Everett-
Alderwood Gravelly Sandy Loam and Urban Land (fill).
Preliminary site investigations indicate the presence of
glacial till.
d. Are there surface indications or history of unstable soils
in the immediate vicinity? If so, describe.
No
e. Describe the purpose, type, and approximate quantities of
any filling or grading proposed. Indicate source of fill.
Minor cut and fill will be required for new sidewalks,
landscaping, road alignment and storm water drainage
facilities. Stormwater facility improvements include
excavation to enlarge ane regrade a water quality swale.
Preliminary estimates for the project indicate 4,770 cubic
yards of material will be excavated with 7,160 cubic yards
of gravel fill imported. Imported landscaping topsoil may
also be required. Imported materials will be from local
sources.
f. Could erosion occur as a result of clearing, construction or
use? If so, generally describe.
The potential for erosion is low because of the flat slopes
in the project area and the minor amount of clearing
required.
g. About what percent of the site will be covered with
impervious surfaces after project construction (for
example, asphalt or buildings)?
Approximately 80 percent of the road right-of-way is
covered with asphalt or concrete paving in its existing
condition. The same area of imprevious surface will remain
as a result of the project.
h. Proposed measures to reduce or control erosion, or other
impacts to the earth, if any:
Erosion control measures will be implemented during
construction as appropriate, including clearly marking
clearing limits, scheduling construction during the dry

season, seeding and mulching exposed soil as soon as
possible, and installing filter fabric fences along the
downstream edge of construction limits. The erosion control
plan will comply with City of Federal Way regulations.
Erosion will not be a concern during project operation.
2. Air
a. What types of emissions to the air would result from the
proposal (i.e., dust, automobile, odors, industrial wood
smoke) during construction and when the project is
completed? If any, generally describe and give approximate
quantities if known.
Construction of the project will result in a temporary
increase in dust and construction vehicle emissions. The
project's HOV lane and signalization improvements may result
in minor improvements to traffic congestion during operation
and an associated slight reduction in vehicle emissions.
b. Are there any off -site sources of emissions or odor that may
affect your proposal? If so, generally describe.
No.
c. Proposed measures to reduce or control emissions or other
impacts to air, if any:
During construction activities fugitive dust will be reduced
by watering exposed soils during dry conditions, and
inactive storage piles will be stabilized with watering,
dust suppressants, or covering.
3. Water

vicinity of the site (including year-round and seasonal
streams, saltwater, lakes, ponds, wetlands)? If yes,

No surface water bodies are located within the project
boundaries other than constructed roadside drainage ditches.
The project site is located in the Hylebos Creek Drainage
Basin and the West Branch Hylebos Creek is near the western
site boundary and Hylobos wetland is located southwest of
the site area.

Water Runoff (including storm water):

The proposed stormwater system will have three collection
and conveyence systems. Systems 1 and 2 will collect runoff
from the road right-of-way and tributary areas in a series
of catch basins and convey the runoff through collector
pipelines to a combined biofilter and detention channel
located on the southeast corner of the intersection of South
348th Street and SR-99 (along the existing ditch). The
detention channel/biofilter will consist of a swaled, open,
300-foot channel vegetated with grasses and emergent wetland
plants. The channel will discharge to the existing 18-inch
diameter storm drain in the east shoulder of SR-99. The
stormwater system eventually outfalls at Welter Pond. A
coalescing plate oil -water separator will be located
upstream of the detention channel/biofilter for conveyence
system 1 which collects runoff from the truckstop area and
portions of South 348th Street.
Conveyence system 3 will collect stormwater from the road
right-of-way from between SR-99 to the westerly project
limits. This system will also consist of catch basins and
collector pipeline discharging to the storm drain in the
existing roadway and outfalling to the West Branch Hylebos
Creek. Because no significant increase in impervious area
is proposed in this area, no retrofit of detention and water
quality controls are propsed for this system.

Some pollutants carried in the roadway runoff may reach
ground and surface waters.

When practical, stationary construction equipment will be
located away from sensitive noise receptors, idling
equipment will be shutoff, and heavy equipment will not
operate at night. A variance from the Federal Way City Code
noise regulations may be required for work between 10:00
p.m. and 7:00 a.m.

a. What is the current use of the site and adjacent properties?
The site is currently a five lane roadway. The adjacent
uses consist of a truck stop and parking area on the south
side and strip commercial and retail uses on the north and
south side of the road.

Proposed Action: The proposal is to
extend westbound and establish new
eastbound HOV lanes along South
348th :street; interconnect signals to
improve signallzation; add landscap-
ing to improve arterial aesthetics; con-
struct stormwater facilities to mitigate
