In order to further review the application and issue a written decision on the proposal, the following comments need to be addressed as applicable. Additional comments are provided for your information. COMMUNITY DEVELOPMENT – PLANNING DIVISION Chaney Skadsen, 253-569-1772, chaney.skadsen@cityoffederalway.com 1. Add one parking space to the site plan. The number of parking spaces provided onsite do not conform with the required parking for the existing use. The site plan appears to depict 30 parking spaces on the subject property. Pursuant to Federal Way Revised Code (FWRC) 19.215.010 one parking space is required per 300 square feet of gross floor area. The existing retail building is 11,466 square feet requiring 39 parking spaces (11,466/300= 38.22). Note that if the formula for determining the required number of parking spaces results in a fraction, it will be rounded up to the next higher whole number per FWRC 19.130.040. Pursuant to FWRC 19.30.180 no nonconformance may, in any way, be enlarged, expanded, increased, intensified, compounded or in any other way made greater. The proposed detached bathroom and storage has a gross floor area of 144 square feet requiring one parking stall. Therefore, in order to not expand the existing nonconformance an additional parking space is required. All comments herein are valid for one (1) year and are based on the proposal(s) submitted and Lakehaven’s current regulations and policies. Any change to either the development proposal(s) or Lakehaven’s regulations and policies may affect the above comments accordingly. 3. A Water and/or Sewer Certificate of Availability issued separately by Lakehaven may be required to be submitted with any land use and/or building permit applications (check with land use agency for requirement). Certificates are valid for one (1) year from date of issuance. If Certificate(s) is needed, allow 1-2 work days to issue for typical processing. 2021 cost for a Water or Sewer Certificate of Availability is $40.00 (each). 4. The site has two (2) existing water service connections: a. SvcNo 11445, Residential, 5/8”x3/4” meter. b. SvcNo 25607, Non-Residential, 1” meter. 5. A water service connection application submitted separately to Lakehaven is required for each new service connection to the water distribution system (e.g., irrigation, etc.), in accordance with standards defined in Lakehaven’s current ‘Fees and Charges Resolution’. Non-single-family properties require separate domestic (per building, typically, some exceptions allowed), irrigation (if irrigated landscaped areas are incorporated into the site development &/or property has a sewer service connection), and fire protection (if required or installed) water service connections & meters. 6. To satisfy premise isolation requirements, the installation & satisfactory testing of an approved backflow prevention assembly (BPA) adjacent to each non-residential domestic & irrigation service meter is required pursuant to WAC 246-290-490 & Lakehaven standards regarding premise isolation. As low health cross-connection hazards, either a double check valve assembly (DCVA) or a reduced pressure backflow assembly (RPBA) is required. Contact Lakehaven’s Cross-Connection Control Program Manager (Chris Zoepfl, CZoepfl@Lakehaven.org, 253-946-5427) for additional information on premise isolation/BPA installation & testing coordination. 7. Based on the proposal submitted, preliminary estimated Lakehaven water service connection fees/charges/deposits (2021 schedule) will be as follows. Actual connection charges will be determined upon submittal of service connection application(s) to Lakehaven. All Lakehaven fees, charges and deposits are typically reviewed & adjusted (if necessary) annually, and are subject to change without notice. a. Water Service/Meter Installation, New Non-Residential Domestic, 5/8”x3/4” preliminary size: $5,130.00 deposit. Actual size TBD by Lakehaven based on applicant’s estimated maximum domestic/commercial GPM usage rate. b. Water Service/Meter Installation, Convert Ex. 1” Non-Residential to Irrigation: $0.00. c. Capital Facilities Charge(s)-Water, 4,764.71 per Equivalent Residential Unit (ERU): $3,240.00 (based on 2020 total water usage on property of 4.02 ERU). Actual amount due TBD by Lakehaven based on applicant’s estimated annual total water usage rate. Water system capacity credits are available for this property from system capacity charges previously assessed, paid directly to Lakehaven, and/or credited to the property for 3.34 ERU. A Sewer Certificate of Availability issued separately by Lakehaven may be required to be submitted with any land use and/or building permit applications (check with land use agency for requirement). Certificate is valid for one (1) year from date of issuance. If Certificate is needed, allow 1-2 work days to issue for typical processing. 2021 cost for a Sewer Certificate of Availability is $40.00. 9. Future and/or additional site development may require extension of sewer system facilities south in Military Rd S, under a LWSD Developer Extension Agreement project. 10. A separate Lakehaven Sewer Service Connection Permit is required for each new connection to the sanitary sewer system, in accordance with standards defined in Lakehaven’s current ‘Fees and Charges Resolution’. Minimum pipe slope for gravity sewer service connections is 2%. In addition to all other sewer service installation standards, installation of a Type 1, 48” monitoring manhole is typically required on the private building sewer line, for all new or modified non-residential connections. 11. Based on the proposal submitted, preliminary estimated Lakehaven sewer service connection fees/charges/deposits (2021 schedule) will be as follows. Actual connection charges will be determined upon submittal of service connection application(s) to Lakehaven. All Lakehaven fees, charges and deposits are typically reviewed & adjusted (if necessary) annually, and are subject to change without notice. a. Sewer Service Connection Permit: $377.13 fee (per building). b. Capital Facilities Charge(s)-Sewer: $4,614.93 per ERU. Actual amount due TBD by Lakehaven based on applicant’s estimated annual domestic/commercial/industrial only water usage rate. Please contact Lakehaven for further detail. APPLICATION STATUS Please make the corrections and resubmit the requested materials with a completed “Resubmittal Information Form” (attached), and a letter indicating how the comments above have been addressed. All resubmittals need to go through the permit portal at https://www.cityoffederalway.com/node/4588. Pursuant to FWRC 19.15.050, if an applicant fails to provide additional information to the City within 180 days of being notified that such information is requested, the application shall be deemed void. The FWRC can be reviewed in its entirety at https://www.codepublishing.com/WA/FederalWay/. Please note, the original plan review fee collected at submittal of your permit covers the initial review and one resubmittal only. On September 1, 2021, the City began charging applicants a resubmittal fee for each review following the first resubmittal.
