Box 1533 Tacoma, Washington 98406 RE: Violet Fritchard - Acquisition of Lot 2, King County Short Plat #684071 City of Federal Way, Washington Dear Ms. Dimmer: This letter will hopefully provide you and your client, and any other interested party with a clear picture of the restrictions that are assigned to the subject parcel referenced above. Background. The subject property was part of a two lot short plat approved under King County. After review of the short plat documents obtained from King County, it is clear that the County placed a non- buildable designation on Lot 2. This was apparently done because the applicant wanted to forgo the task of demonstrating to the County the feasibility of providing driveway access to Lot 2. A Declaration of Covenant for Non-Building Short Plat Approval was signed for Lot 2, limiting any use on the property, except for fencing. Non-buildable designation removal. In order to remove the non-buildable designation, the property owner must submit a short plat application to the City of Federal Way. Short plat approval is an administrative review not requiring Hearing Examiner of City Council approval. Upon successful completion of the short plat process, the revised plat will be recorded with King County. Recently there has been speculation that a boundary line adjustment or lot line elimination would change the non-buildable designation of the subject property, this is incorrect. In order to modify or address conditions of the subject short plat, the short plat needs to be altered. In this particular case, this can only be done through the short plat process. However, the owners of Lot 1, pursuant to Revised Code of Washington (RCW) 58.17.215, Alteration of Subdivision - Procedure, would use the plat alteration procedure to reduce the 30 foot access/utility easement to 10 feet. Ms. Dimmer Jan. 29, 1993 Page 2 Ownership. If the subject property is sold to another landowner such as Mrs. Fritchard, it will be incumbent upon her to successfully complete the short plat approval process in order to repeal the non- buildable status of the subject parcel. Additionally, Mrs. Fritchard could use the short plat process to both remove the non-buildable status as well as alter any desired lot line(s). The primary objective of the short plat process will be to ensure access to the subject property from S.W. 356th Street. This will likely be done through the conveyance of an access easement. Please note, short platting of the properties in questions will require the applicant to satisfy all requirements of the short platting process under the City of Federal Way, such as designating open space, roadway improvements, etc. If you or your client have any questions regarding this letter, please feel free to contact my office at 661-4104. The correspondence, dated December 10, 1992, is a letter from the City's Technical Review Committee to the Hamilton. The letter contains the comments of the Committee in response to a proposed short plat. During out most recent phone conversation, you asked if there was any way that you could on your accord reduce the thirty (30) foot access and utility easement which crosses your property. There is no land use action that could be initiated on your part that would reduce the easement width. Both you and the Hamiltons will be party to any short plat action that takes place for Lots 1 and 2 of King County Short Plan #684071. In other words, all owners of property involved in a short plat must be party to the short plat. Since the access road to Lot 2 is over 150 feet, a cul-de-sac shall be provided which has a 40-foot outside radius. For more information concerning fire district requirements, please contact Pat Kettenring, Assistant to Fire Marshal at 946-7241. Federal Way Water and Sewer District No sewer service is available from the District at this time. Therefore, the plat will require King County Health Department approval for a septic system. The new location would be along the west side of King County Short Plat 177036 just northeast of Lot 2. The applicant is proposing a 40 foot wide easement to accommodate the access needs. Staff has the following comments regarding this proposal: 1. The proposed access is in approximate alignment with the existing 4th Ave. SW right-of- way to the north of SW 356th St. The easement is also in a location where the City would prefer to extend 4th Ave. SW to the south. Although the proposd 40 feet width is not equal to the 60 feet existing on 4th Ave. SW, further development of the roadway would require additional right-of-way acquisition to the east of the easement. No property would be acquired from Ms. Vi Fitchard to the west of the easement. 2. Development of the easement will be required at the time of building permit application for Lot 2 of King County Short Plat 684071 or further development of any lots in Short Plat 177036. The development criteria are per Section 110 of the FWZC. The roadway shall be paved 28 feet wide with curb, gutter, and sidewalk on both sides. Appropriate storm drainage facilities shall be provided per the 1990 King County Surface Water Design Manual. This may include detention and biofiltration facilities. The current easement consists of a meandering dirt road to the house at the north end of Lot 4. Lots 2 and 3 are developed with manufactured homes. Lot 1 is vacant. 3. An appropriate turnaround shall be provided along the easement per the Fire Department's requirements. Adequate easements shall be provided for these requirements. 4. Current access from 6th Ave. SW is restricted by the encroachment into the easement of the building on Lot #1 of King County Short Plat #684071. There is inadequate room on the other side of the house to get to the site from 6th Ave. SW. The location of the proposed easement is in a location for a future City roadway and the development of this corridor is encouraged. To assist in future City acquisition of the right-of- way through this area, it is proposed that the easement include a statement to the effect that the owners of the underlying properties over which the easement runs agree to dedicate the easement to the City upon request by the City. The owners can also dedicate the easement at any time if the easement and improvements are first brought up to current City standards for public roadways. This property is described as Lot 1 of King County Short Plat #684071, a two lot subdivision (Exhibit A). A review of the file revealed that this easement provides access for Lot 2 and was a requirement for approval of the short plat. Mrs. Lee informed me that she and her husband, Steve Mensching purchased this property from you on condition that you would petition King County to revise the 30-foot easement which serves Lot 2 to a 10-foot utility easement. You recently sent me the following information as verification that the 30-foot access and utility easement had been converted to a 10-foot utility easement: 1. A photocopy of Page 1 of 6 of the recorded short plat document (Exhibit B). 2. An Agreement to Convey Easement (Exhibit C). This was a copy of an agreement made on October 3, 1988 between Ken and Bonny Bassett (Owners) and Bill and Mildred Hamilton (you and your husband as Purchasers) to purchase an easement across the Bassett's property at 35726 - 4th Avenue S.W. This easement was to provide access to your property (Lot 2 of SS#680471) located at 35824 - 6th Avenue S.W. 3. A document recorded under King County Recording No. 8812080890 (Exhibit D). This document was an agreement by you and your husband to pay the Bassetts $3,500 for the easement referenced under No. 2 of this correspondence. 4. Addendum/Amendment to Purchase and Sale Agreement (Exhibit E). This was part of the Purchase and Sale Agreement dated October 3, 1988 between you and your husband as Seller and Steve Mensching and Mei Lin Lee as Buyer. This agreement stated that the Buyer would accept title to the property at 35824 - 6th Avenue S.W. on condition that the Seller would petition King County to revise the 30 foot ingress, egress and utilities easement which serves Lot 2 to a 10 foot utility easement. Mrs. Mildred Hamilton July 13, 1992 Page 2 Access for Lot 2 of King County Short Plat #684071: Although you have obtained an access easement for Lot 2 across the Bassett's property located at 35726 -4th Avenue S.W., acquisition of this access easement did not remove the existing 30- foot ingress/egress and utility easement created as part of Short Plat #684071. It will be necessary to amend the short plat in order to change the 30-foot ingress/egress and utility easement to a 10-foot utility easement. The Federal Way Subdivision Ordinance does not set out a process to amend a short plat; therefore, an application for a short plat amendment would have to be processed pursuant to the requirements of the Revised Code of Washington (RCW) 58.17.215 (Exhibit F). This process would require the signature of the majority of owners of Lots 1 and 2, in this case the signature of the owners of both Lots 1 and 2. In addition, property owners within 300 feet of the subdivision must be notified of the application. The decision on whether to grant the short plat amendment will then be made by the Federal Way City Council. As part of the short plat amendment, an alternate access meeting City requirements and Fire Department Standards must be provided for Lot 2. Based on the information provided, it appears that the new access for Lot 2 is proposed across the Bassett property at 35726 - 4th Avenue S.W. Presently the Bassett property gains access to S.W. 356th Street via 4th Avenue S.W. which appears to be a private easement across Lots 1 through 3 of King County Short Plat #177036 (Exhibit G). The submitted information states that an access easement for Lot 2 of King County Short Plat 684071 has been acquired from the Bassetts (Exhibits C & D); however, no information has been provided on the dimensions of this easement, nor has proof been submitted that the easement includes access across Lots 1 through 3 of Short Plat #177036 (4th Avenue S.W.). Information verifying that an easement has been obtained to provide access for Lot 2 to S.W. 356th Street must be provided. In addition, because the proposed access for Lot 2 from S.W. 356th Street would exceed 600 feet in length, a cul de sac with a minimum radius of 40 feet will be required to meet Fire Department Standards. Non-Building Status of Lot 2 of King County Short Plat #684071: When King County Short Plat #684071 was recorded (July 1985), Lot 2 was designated a non- building lot (Exhibit A). Therefore, even if the existing access for Lot 2 is removed and an alternate access is obtained, a building permit cannot be obtained for this lot without the removal of the "non-building" designation. Since designation of a lot as "non-building" is a process unique to King County, neither State Law nor the City of Federal Way Codes address how this designation can be removed. i t • Mrs. Mildred Hamilton July 13, 1992 Page 3 However, King County procedures would require Lot 2 to undergo subdivision review in order to remove the "non-building" designation and to create a buildable lot. In the City of Federal Way, the corresponding procedure would be the short plat process which is an administrative review not requiring City Council action. Summary: In order to convert the 30-foot ingress/egress and utility easement for Lot 2 to a 10-foot utility easement, a short plat amendment must be tipproved by the Fedeial Way City Council. As part of this amendment process, an alternate acces meeting all City and Fire codes must be provided. • In order to remove the "non-building" designation from Lot 2, the lot must undergo short plat review which is an administrative process, not requiring Council action. However, since the removal of the existing access easement and provision of an alternate access can be included in the short plat process to remove the "non-building" designation of Lot 2, it may be advisable to pursue the short plat option to accomplish both the removal of the access easement and removal of the non-building designation for lot 2. If you desire to proceed with any or all of the above alternatives, it would be advisable to request a preapplication meeting with members of the City's Technical Review Committee which includes representatives from various City departments, the Federal Way Water and Sewer District, the Fire District, the Police Department, and the School District. For that meeting, you will need to provide the City with eight copies of your plans and an explanation of what your proposal entails.
