The Process II application was deemed complete on December 20, 2021. Some of the comments provided herein are required to be addressed, and some are informative; others may be applicable during future steps of the project. Comments 2 – 7 in the Planning Division section below, and Traffic Division comments 1 and 2 in this letter need to be addressed prior to issuance of a land use Process II decision, or as otherwise noted. Questions regarding technical review comments should be addressed to the referenced staff representative. The Federal Way Revised Code (FWRC) is available online at: http://www.codepublishing.com/WA/FederalWay/. Community Development – Planning Division Jim Harris, (253) 835-2652, jim.harris@cityoffederalway.com 1. General – Technical comments made about an item on one plan sheet, or in a document, may necessitate changes to other related plan sheets and documents. It is the applicant’s responsibility to determine any such necessary adjustments. Please ensure consistent information is communicated throughout the plan set and associated application materials. 2. Screen the drive-thru stacking lane adjacent to and visible from Pacific Highway South, per FWRC 19.115.050(7)(b). Potential design options to meet this guideline include significantly increasing the size, quantity and density of the landscaping and include a berm at a minimum of 36” in height in this landscape area between the drive-thru stacking lane and Pacific Highway South along the frontage. Or alternatively design and construct a drive-thru stacking lane screen wall comparable to the Taco Bell at 1330 South 348th Street, Federal Way, WA. 3. For the east building façade, the elevations and site plan comply with façade modulation and screening options of FWRC 19.115.060(2) by providing building modulation; metal canopies that run less than 50 percent of the façade length; and a pedestrian plaza. The east façade, (as well as the north and south) meet the façade modulation and screening section of FWRC 19.115.060(2). Based on the submitted preliminary site plan, preliminary elevation and project narrative, City staff is unable to determine if the west façade complies with the façade modulation and screening requirements in FWRC19.115.060(2). One treatment (building modulation) is shown on the plans and complies, and a second façade treatment of canopies is discussed in the application narrative but is not clearly shown on the site plan and elevations. Please revise/ clarify the site plan and elevation to show the dimensions of canopy treatment on the west façade. If a minimum of 50 percent of the west façade includes a canopy then this guideline is met. If the canopy on the west façade is less than 50 percent of the façade length, then, then additional façade treatment is necessary to meet FWRC 19.115.060(2). 4. Landscape islands with Type IV landscaping are not provided at the ends of three different parking rows in the locations shown on the enclosed red-line markup. Stormwater facilities cannot be located where parking lot landscape islands are required. FWRC 19.125.070(3) requires Type IV landscaping at the end of every parking row. 5. Per FWRC 19.115.050(4)(e), the pedestrian plaza needs outdoor furniture, fixtures, and streetscape elements incorporated into the site design. 6. The 5-foot wide Type 3 landscape strip shown inside the new southern property line does not meet Type 3 landscaping and the plan will need to be revised accordingly to meet FWRC19.125.050. 7. Use Process II Decisional Criteria – Provide a narrative demonstrating how the proposal satisfies FWRC 19.60.050(2 &3). Public Works – Development Services Division Sam Basmeh, (253) 835-2746, samir.basmeh@cityoffederalway.com 1. Temporary Erosion and Sediment-control (TESC) measures, per Appendix D of the 2021 KCSWDM, must be shown on the engineering plans. 2. The developer will be responsible for the maintenance of all storm drainage facilities (including the detention and water quality facilities) and street systems during the two-year maintenance period. During that time, the Public Works Inspector will make periodic visits to the site to ensure the developer’s compliance with the maintenance requirements. Upon satisfactory completion of the two-year maintenance period, the remainder of the bond will be released. Maintenance for public roads and subdivision drainage facilities then become the Pedro Deguzman March 1, 2022 Page 3 21-104414-00-UP Doc. I.D. responsibility of the City. Maintenance for private roads and drainage facilities, including short plats, remain the responsibility of the individual property owners. 3. Bonding is required for all street improvements and temporary erosion and sediment control measures associated with the project. The bond amount shall be 120 percent of the estimated costs of the improvements. An administrative fee deposit will need to accompany the bond to cover any possible legal fees in the event the bond must be called. Upon completion of the installation of the improvements, and final approval of the Public Works Inspector, the bond will be reduced to 30 percent of the original amount and held for a two-year maintenance period. 4. For Street Trees please follow City of Federal Way Development Standards Drawing No. 3- 30 and 3-31. Public Works – Development Services Division Jason Kennedy - (253) 835-2744, jason.kennedy@cityoffederalway.com The Public Works Traffic Division has finished its review of the Land Use Submittal Dedication Revision (dated 12-15-21) plan sheet submitted informally by the applicant and provides the following technical review comments: 1. The applicant must dedicate 12-feet of ROW on Pacific Highway S for the entire length of the subject property. This will result in a portion of the monument sign on the northwest corner of the intersection to be within ROW. It will be the applicant’s responsibility to obtain and maintain a ROW permit for this sign as long as it remains in its current location. To review any code related to the questions that may arise about future development impacting the sign, please reference FWRC 19.140.210(9). This section of code covers what the conditions and circumstances the sign could remain in its current location involving any post-ROW development and if relocation is required. 2. The applicant must submit a ROW modification request to the revised the original agreement with the City on the amount of dedication of S 316th Street ROW. The amount of ROW dedication in the original Modification Letter dated 7-15-21 from the Deputy Public Works Director was 7-feet for the entire length of subject property. Based on the applicant’s communication since this letter was issued, there appears to be a need to modify amount or ROW to be dedicated west of the driveway on S 316th Street. Please include the revised request in a new modification request to Public Works Department for consideration. Pedro Deguzman March 1, 2022 Page 4 21-104414-00-UP Doc. I.D. CLOSING Please be aware that this review does not preclude the city from requesting additional information in order to issue a Process II decision. Please submit revised application materials as appropriate, a letter explaining how these comments have been addressed, and the completed “Resubmittal Information Form” (enclosed). Pursuant to FWRC 19.15.050, if an applicant fails to provide additional information to the city within 180 days of being notified by mail that such information is requested, the application shall be deemed null and void and the city shall have no duty to process, review, or issue any decision with respect to such an application. Extension requests submitted 30 days prior to the lapse of the 180-day notification that meet the criteria listed in FWRC 19.15.050(2)(a-c) will be accepted. Please note, the original plan review fee collected at submittal of your permit covers the initial review and one resubmittal. Commencing September 1, 2021, the city has begun charging applicants for any additional staff time necessary to complete each review following the first resubmittal. The resubmittal fee will be collected at the time a land use decision is issued. Please submit revised electronic plans for additional review.
