Based on the proposal’s consistency with Federal Way Revised Code (FWRC) Chapter 19.142, the floodplain permit is hereby approved, subject to the following conditions: 1. The proposed improvement shall be constructed per the application and associated materials and studies in file 19-104208-AD. A building permit is also required. 2. The proposal shall comply with the conservation measures contained within the August 2020, “Floodplain Habitat Assessment Report – Grealish Bulkhead Repair/Replacement Project” prepared by North Fork Environmental Inc., located on pages 16-17 and 32-33. 3. The owner shall provide verification to the Department of Community Development that the above conditions have been met. The city’s decision is based on, and applicable only to, the project application submitted to the city. Any changes in the nature or timing of work for the project, or the geographic scope of the project, must be submitted to the city for additional review prior to undertaking work associated with such changes. According to the submitted application, “The property owner is proposing to replace the existing concrete bulkhead 1 foot landward of its present location. The landward location will move the structure to or slightly above ordinary high water. This location will lessen the impact to the upper intertidal zone and reduce impacts to the floodplain while protecting the Grealish and neighboring properties.” 2. (a) Proposed Elevation The elevation is not changed with the replacement; the replacement bulkhead will be moved one foot landward. (b) Base Flood Elevation Data The applicant proposes to replace a damaged concrete bulkhead. The project does not involve a subdivision or manufactured home park. (c) Watercourse Alteration No watercourses will be altered or relocated as part of the proposed development. 6 19.142.060(7) Project Requirements A habitat analysis has been submitted and found sufficient for the project. 7 19.142.060(8) Third Party Review In review of the extensive analysis completed for the project, staff finds third party review is unnecessary. 8 19.142.070 Use of Other Base Flood Data (in A and V Zones). N/A, the project is located within Zone VE. 9 19.142.080 Information to be Obtained and Maintained N/A, the project is located within Zone VE. 10 19.142.090 Alteration of Watercourses N/A, the project does not involve alteration or relocation of a watercourse. 11 19.142.100 Conditions for Variance A variance from requirements is not requested. 12 19.142.110 Provisions for Flood Hazard Reduction Construction of a replacement bulkhead requires a building permit to insure appropriate anchoring and construction methods. No utility facilities will be affected, and there is no storage activity. 13 19.142.120 Development Proposals, Including MHPs and Subdivision Proposals The proposal is for a replacement bulkhead, outside of a manufactured home park, and does not involve subdivision of property. 14 19.142.130 Review of Building Permits Elevation data is available to the site. 15 19.142.140(4) Specific Standards The project involves non-residential construction in Zone VE. 16 19.142.150 AE Zones With Base Floods but No Floodway N/A, the project is located within Zone VE. 17 19.142.160 Floodways N/A, the project is not within a floodway. 18 19.142.170 Critical Facility N/A, the project is not a critical facility per FWRC 19.142.040. 19-104208-00-AD Page 4 of 4 Doc. I.D. 81286 3. The applicant submitted an August 2020, “Floodplain Habitat Assessment Report” prepared by North Fork Environmental Inc. The assessment contains conservation measures (enclosed) that will be made conditions of approval. 4. The applicant submitted a June 20, 2020, “Shoreline Geotechnical Assessment – Grealish Bulkhead Replacement” prepared by Envirotech Engineering, PLLC. 5. A SEPA checklist was completed and a Determination of Nonsignificance issued on October 23, 2020. 6. The improvement meets FWRC 15.05, Shoreline Management regulations. A Shoreline Exemption was issued on December 1, 2020. 7. The applicant provided a copy of the Hydraulic Project Approval issued on January 21, 2021, by the Washington State Department of Fish & Wildlife. CONCLUSION 1. The proposed replacement bulkhead within Zone VE complies with the applicable requirements of FWRC 19.142, as indicated in the preceding Floodplain Development Permit Requirements table. CONDITIONS Floodplain Development Permit 19-104208-AD is approved for the Grealish Bulkhead Replacement, subject to the following conditions: 1.
