The property in question is located on parcel #042104-9174. The following information addresses specific questions included in the request. In the interest of clarity, each of these questions is restated below in bold, with the city’s response following. 1. What is the current zone of the property? The above-referenced property is zoned Multi-Family Residential (RM 1800) (one unit/1,800 square feet). 2. Is this property a permitted use in this district? The current use of this property is a mobile home park. A mobile home park, or a manufactured home park, is a permitted use in the RM zone, subject to given criteria. 3. Conformance? Although the use and density on the subject property appear to be conforming, it does not mean that the improvements on the property are conforming developments (that is, built to current zoning code regulations). Verification of conformance is typically performed at the time of a formal project review. At this time, the city cannot confirm compliance with the current zoning code or building requirements without a formal site plan review. 4. Variances, special permits/exceptions for use or structures of the subject propert? The city does not have any variances or special permits issued for this site. Per Federal Way Revised Code (FWRC) 19.30.200, if a nonconforming use or development is damaged by sudden accidental cause, that use or development, including associated improvements, may be reconstructed if it meets the following requirements: (1) The use or development, including associated improvements, as reconstructed, is not any more nonconforming than it was immediately prior to the damage. (2) The applicant applies for building and any land use permits to reconstruct the damaged improvement within six months of the date of the damage, and reconstructs the improvement pursuant to such permits. 6. Is there any outstanding building or zoning violations on file? According to the city’s database, there is no outstanding building or zoning violations on file. 7. Are there any outstanding fire code violations on file? According to the city’s database, there are no outstanding fire code violations on file. 8. Certificate of Occupancy? There were no Certificate of Occupancy (CO) issued for the subject property; therefore, we are not able to provide a copy. CO’s are not issued for mobile homes or manufactured homes in the City of Federal Way. CO’s are only issued to site built single-family dwelling units and commercial buildings. 9. Site Plan Information? All mobile home parks were developed prior to Federal Way’s incorporation in 1990, under the authority of King County; therefore, there are no site plan approvals in our city’s database for this site.
