Dear Bruce Johnson:
The Department of Community Development has completed review of the Accessory Dwelling Unit (ADU)
land use application submitted to the city on December 20, 2021. The ADU application is hereby approved
pursuant to the following findings of fact and conclusions based on those findings.
FINDINGS OF FACT
The following findings are based on site, elevation, and floor plans received with the ADU land use
application.
1. Proposal –The applicant proposes to construct a detached ADU at 3006 SW 341st Street, parcel
#858120-0210. The proposed ADU is 488 square feet and includes an approximately 16 square foot
covered front porch, which as a nonliving area, does not count towards the ADU size per Federal Way
Revised Code (FWRC) 19.200.180, Note 9.
2. Zoning – The subject property is a 9,375 square-foot (0.22-acre) lot with a Single-Family Residential (RS
7.2) zoning designation. The proposal meets the minimum lot size of 7,200 square feet pursuant to
FWRC 19.200.180, Note 1.
3. Lot Coverage – The lot coverage of the single-family dwelling, proposed detached ADU, and other site
improvements do not exceed the maximum lot coverage of 60 percent in the RS 7.2 zone pursuant to
FWRC 19.200.180, Note 2.
4. Setbacks – The front, side, and rear structural setbacks for the detached ADU comply with required
setbacks in the RS 7.2 zone pursuant to FWRC 19.200.180.
5. Height – The single-story detached ADU complies with the 30-foot height limitation in the RS 7.2 zone
pursuant to FWRC 19.200.180.
6. Floor Plan – The size of the proposed ADU is 488 square feet, including a living room, kitchen, storage
room, bathroom, and one bedroom. The principal dwelling unit is 1,220 square feet. The ADU does not
exceed the 40 percent maximum accessory dwelling unit size of 488 square feet (1,220 x 0.4=488)
pursuant to FWRC 19.200.180, Note 9. The ADU does not have more than 2 bedrooms in compliance
with FWRC 19.200.180, Note 9.

7. Parking –The site plan shows an existing driveway in front of an attached two-car garage that can
accommodate two parking spaces. This driveway is located outside of the required 10’ side yard setback.
As such, there is sufficient parking for the one required on-site space for the ADU, pursuant to FWRC
19.200.180, and two spaces for the single-family home pursuant to FWRC 19.200.010.
8. Water & Sewer – The applicant proposes to serve the ADU with public water and sewer. The water
purveyor is Tacoma Water, who issued a Certificate of Water Availability on December 10, 2021. The
sewer purveyor is Lakehaven Water & Sewer District, who issued a Certificate of Sewer Availability on
December 15, 2021. The applicant will need to work directly with Tacoma Water and Lakehaven for any
service changes.
9. Owner Occupancy – On the application, the owner marked that the owner-occupied unit will be the
ADU. As a condition of land use approval, the applicant will be required to record the Letter of Application
and Deed Restriction with King County, and provide a copy of the recorded document to the city. The
document states that the owner shall occupy one of the two dwelling units as a permanent residence for
six months or more per calendar year, pursuant to FWRC 19.200.180, Notes 8 & 11.
CONCLUSIONS
The following conclusions are based on the above findings of fact.
1. The proposal is consistent with policies of the Federal Way Comprehensive Plan.
2. The proposal meets requirements of the ADU Use Zone Chart within FWRC 19.200.180.
3. The ADU is subordinate and incidental in size, scale, and design to the primary dwelling unit.
CONDITION OF APPROVAL
1. Prior to issuance of the building permit for the ADU, the applicant shall complete and record the
enclosed Letter of Application & Deed Restriction with the King County Recorder’s Office and return a copy
to the city Permit Center via the online portal with the enclosed Resubmittal Form.
BUILDING PERMIT REQUIRED
This ADU land use decision does not constitute building permit approval. The ADU requires permitting
from the City of Federal Way’s Building Division. Please contact the Permit Center at 253-835-2607, or

This administrative ADU decision does not waive compliance with future City of Federal Way codes, policies,
