The Responsible Official of the City of Federal Way hereby makes the following Findings of
Fact based upon impacts identified in the environmental checklist and the "Final Staff Evaluation
for Environmental Checklist, Application No. SEP93-0013," and Conclusions of Law based on
the Federal Way Comprehensive Plan and other municipal policies, plans, rules and regulations
designated as a basis for exercise of substantive authority under the Washington State
Environmental Policy Act Rules pursuant to R.C.W. 42.21C.060.
Findings of Fact:
1. The proposed action includes removal of three underground storage tanks totalling 1,700
gallons and associated plumbing.
2. The "Final Staff Evaluation for Environmental Checklist No. SEP93-0013" is hereby
incorporated by reference as though set forth in full.
Conclusions of Law:
1. Temporary and permanent erosion control mitigation measures related to the proposal
shall comply with the adopted 1988 Uniform Building Code and other adopted
documents, as required by the City. (Comprehensive Plan Policy #NE-6)
2. Assure that commercial development has minimal impact on lakes, streams and drainage
ways, air quality or noise levels. (Comprehensive Plan Policy #C-25)
The lead agency for this proposal has determined that the proposed action does not have
probable significant adverse impact on the environment, and an Environmental Impact Statement
(EIS) is not required under R.C.W. 43.21C.030(2)(c), only if the following conditions are met.
This decision was made after review of a completed environmental checklist and other
information on file with the lead agency. This information is available to the public on request.
Conditions:
1. A building, and related permits, shall be obtained from the City of Federal Way prior
to commencement of any construction activity related to this approval.
2. The public storm drainage system shall be protected against infiltration and contamination
during the tank removal process, as required by the Public Works Director. Appropriate
protection methods and a spill containment plan shall be reviewed and approved by the
Public Works Director prior to issuance of the related construction permit.
3. All tank removal shall be in compliance with plans and procedures approved in
accordance with Local, State and all Federal regulations governing such activities.
4. Soils shall be continually evaluated during excavation to assure detection and removal of
all contaminated elements. All stockpiles of dirt, either contaminated or not, shall
immediately be covered with visqueen and anchored sufficiently to prevent wind or water
erosion. Contaminated stockpiles shall be immediately placed over a visqueen layer to
prevent ex-filtration to the surrounding environment. The final cleanup levels shall
conform to those listed in the Model Toxic Control Act, Chapter 70.105 Revised Code
of Washington. Copies of the Department of Ecology performance reports shall be
submitted to the City of Federal Way Public Works and Building Departments after
completion of the cleanup, verifying that all contaminated soils have been removed.
5. All contaminated soil, if any, shall be removed to an approved off-site landfill within 30
days of excavation. Applicant shall submit to the City of Federal Way Public Works
Department a complete treatment and/or transportation disposal plan for approval prior
to removal of any excavated soil from the site.

6. Copies of Department of Ecology performance reports by the tank remover shall be
submitted to the Ron Garrow, Senior Development Engineer, Public Works Department,
City of Federal Way.
7. All areas disturbed through the tank removal process shall be filled, compacted, graded
level and sealed as required by the Public Works Director and/or Building Official.
This MDNS is issued under WAC 197-11-340(2); the lead agency will not act on this proposal
for 15 days from the date of issuance. Comments must be submitted no later than 5
p.m. / 3 . Unless modified by the City, this determination will become final
following ex iration of the above comment deadline. Any person aggrieved of the City's final
determination may file an appeal with the City within 14 calendar days of the above comment
deadline.

Proposal: Remove and dispose of three underground storage
tanks. Two tanks are 1, 200 gallons each. The
third is 500 gallons.

A: BACKGROUND:
The proposed action is to remove and dispose of three underground
storage tanks. Two tanks are 1,200 gallons each. The third is 500
gallons. . SEPA review is required because the proposal is located
in the Redondo-Milton Aquifer. Analysis of the proposal is based
on the submitted drawings and environmental checklist.
B: ENVIRONMENTAL ELEMENTS:
1. Earth: The site is presently developed as a construction
storage yard. The entire site was cleared and graded as
part of this previous development. Excavation will
require approximately 150 cubic yards of backfill
material, provided from on site stockpiles and off site
sources.
Section 18-122 of the FWCC lists city codes, ordinances
resolutions, plans and polices which have been adopted as a

basis for the exercise of substantive SEPA authority pursuant
to Section 18-121 FWCC, to approve, condition or deny
projects. Policies which are applicable to potential
environmental impacts resulting from the project include the
following:
Temporary and permanent erosion control mitigation
measures related to the proposal shall comply with the
adopted 1988 Uniform Building Code and other adopted
documents, as required by the City. (Comprehensive Plan
Policy #NE-6) .
Based on this authority, the following conditions are
recommended:
a. All tank removal shall be in compliance with plans and
procedures approved in accordance with Local, State and
all Federal regulations governing such activities.
b. Soils shall be continually evaluated during excavation to
assure detection and removal of all contaminated
elements. All stockpiles of dirt, either contaminated or
not, shall immediately be covered with visqueen and
anchored sufficiently to prevent wind or water erosion.
Contaminated stockpiles shall be immediately placed over
a visqueen layer to prevent exfiltration to the
surrounding environment. The final cleanup levels shall
conform to those listed in the Model Toxics Control Act,
Chapter 70. 105 Revised Code of Washington. Copies of the
Department of Ecology performance reports shall be
submitted to the City of Federal Way Public Works and
Building Departments after completion of the cleanup,
verifying that all contaminated soils have been removed.
c. All contaminated soil, if any, shall be removed to
an approved off-site landfill within 30 days of
excavation. Applicant shall submit to the City of
Federal Way Public Works Department a complete
treatment and/or transportation disposal plan for
approval prior to removal of any excavated soil
from the site.
d. Copies of Department of Ecology performance reports by
the tank remover shall be submitted to Ron Garrow, Senior
Development Engineer, Public Works Department, City of
Federal Way.
e. All areas disturbed through the tank removal process
shall be filled, compacted, graded level and sealed as
required by the Public Works Director and/or Building
Official.

2 . Air: Concur with checklist.
3 . Water: Runoff from the site drains west along South 356th
Street to a ditch oriented north/south which conveys water
south, under South 356th Street to a wetland (Wetland #2429)
at approximately South 364th Street. Temporary and permanent
protective measures, using the best available technology, will
be required with the construction permits, as required by the
Public Works Department.
Sections 22-1198 and 22-1199 of the FWCC establish water
quality regulations for water entering public storm water and
groundwater systems. The proposed development must meet the
relevant criteria stated in this section of the FWCC to obtain
building permit approval.
Section 18-122 of the FWCC lists city codes, ordinances
resolutions, plans and polices which have been adopted as a
basis for the exercise of substantive SEPA authority pursuant
to Section 18-121 FWCC, to approve, condition or deny
projects. Policies which are applicable to potential
environmental impacts resulting from the project include the
following:

decrease following tank removal.

8. Land and Shoreline Use: The site is zoned MP. The city
Comprehensive Plan designation is Industrial/Office Park. The
construction proposed will be compatible with adopted city
regulations through review of relevant permit applications.
9. Housing: Concur with checklist.
10. Aesthetics: No significant aesthetic impacts are anticipated.
11. Light and Glare: Concur with checklist.
12 . Recreation: Concur with checklist.
13 . Historic and Cultural Preservation: Concur with checklist.
14 . Transportation: Concur with checklist.
15. Public Services: Concur with checklist.
16. Utilities: Concur with checklist.
C. CONCLUSION:
The proposal can be found to not have a probable
significant adverse impact on the environment if
appropriate conditions are properly implemented pursuant
to a mitigated DNS. Conditions of the MDNS are based on
impacts identified within the environmental checklist,
attachments, and the above Final Staff Evaluation for
Environmental Checklist; and are supported by policies, plans,
rules and regulations formally adopted by the City for the
exercise of substantive authority under SEPA. The City
reserves the right to review any future revisions or
alterations to the site or to the proposal in order to
determine the environmental significance or non-significance

The Responsible Official of the City of Federal Way hereby makes the following Findings of
Fact based upon impacts identified in the environmental checklist and the "Final Staff Evaluation
for Environmental Checklist, Application No. SEP93-0013," and Conclusions of Law based on
the Federal Way Comprehensive Plan and other municipal policies, plans, rules and regulations
designated as a basis for exercise of substantive authority under the Washington State
Environmental Policy Act Rules pursuant to R.C.W. 42.21C.060.
Findings of Fact:
1. The proposed action includes removal of three underground storage tanks totalling 1,700
gallons and associated plumbing.
2. The "Final Staff Evaluation for Environmental Checklist No. SEP93-0013" is hereby
incorporated by reference as though set forth in full.
Conclusions of Law:
1. Temporary and permanent erosion control mitigation measures related to the proposal
shall comply with the adopted 1988 Uniform Building Code and other adopted
documents, as required by the City. (Comprehensive Plan Policy #NE-6)
2. Assure that commercial development has minimal impact on lakes, streams and drainage
ways, air quality or noise levels. (Comprehensive Plan Policy #C-25)
The lead agency for this proposal has determined that the proposed action does not have
probable significant adverse impact on the environment, and an Environmental Impact Statement
(EIS) is not required under R.C.W. 43.21C.030(2)(c), only if the following conditions are met.
This decision was made after review of a completed environmental checklist and other
information on file with the lead agency. This information is available to the public on request.
Conditions:
1. A building, and related permits, shall be obtained from the City of Federal Way prior
to commencement of any construction activity related to this approval.
2. The public storm drainage system shall be protected against infiltration and contamination
during the tank removal process, as required by the Public Works Director. Appropriate
protection methods and a spill containment plan shall be reviewed and approved by the
Public Works Director prior to issuance of the related construction permit.
3. All tank removal shall be in compliance with plans and procedures approved in
accordance with Local, State and all Federal regulations governing such activities.
4. Soils shall be continually evaluated during excavation to assure detection and removal of
all contaminated elements. All stockpiles of dirt, either contaminated or not, shall
immediately be covered with visqueen and anchored sufficiently to prevent wind or water
erosion. Contaminated stockpiles shall be immediately placed over a visqueen layer to
prevent ex-filtration to the surrounding environment. The final cleanup levels shall
conform to those listed in the Model Toxic Control Act, Chapter 70.105 Revised Code
of Washington. Copies of the Department of Ecology performance reports shall be
submitted to the City of Federal Way Public Works and Building Departments after
completion of the cleanup, verifying that all contaminated soils have been removed.
5. All contaminated soil, if any, shall be removed to an approved off-site landfill within 30
days of excavation. Applicant shall submit to the City of Federal Way Public Works
Department a complete treatment and/or transportation disposal plan for approval prior
to removal of any excavated soil from the site.

6. Copies of Department of Ecology performance reports by the tank remover shall be
submitted to the Ron Garrow, Senior Development Engineer, Public Works Department,
City of Federal Way.
7. All areas disturbed through the tank removal process shall be filled, compacted, graded
level and sealed as required by the Public Works Director and/or Building Official.
This MDNS is issued under WAC 197-11-340(2); the lead agency will not act on this proposal
for 15 days from the date of issuance. Comments must be submitted no later than 5
p.m. I 3 . Unless modified by the City, this determination will become final
following expiration of the above comment deadline. Any person aggrieved of the City's final
determination may file an appeal with the City within 14 calendar days of the above comment
deadline.

The following comments are provided for the above referenced project:
Blh The applicant will be required to provide silt fencing downhill of any excavation
activities to prevent the transmission of sediment to any drainage course. Any stock piles
of excavated materials are required to be covered with plastic tarps to prevent rainfall
from washing the materials onto uncontaminated areas.
B2a The use of excavating machinery will result in the emission of carbon dioxide, carbon
monoxide and other vehicle emissions into the air.
B3c1 Runoff from the site drains to a ditch oriented north to south and conveys water to S.
356th Street. From there runoff is conveyed under the street and directed to a wetland
to the south.
B3c2 Contaminated runoff could enter the ground or surface waters and get to the wetland to
the south. These materials would be spillage or leakage from the tanks to be removed.
B3c3 Excavated contaminated materials will be placed on an impermeable plastic tarp for on-
site storage during decontamination procedures. The outside edges of the tarp will be
held up by straw bales to prevent spillage off the tarp. The top of the storage pile will
be covered with a plastic tarp to prevent rainfall from entering the contaminated
materials.

• (3) After January 1, 1991 , only tank services providers who have
obtained a license from the department may install, retrofit, test,
decommission,' or inspect for the purpose of determining compliance
with state regulations, an underground storage tank system in the
state of Washington. •
(4) After January 1, 1991, an application for a tank services
• provider license must be submitted to the department and must include:
(a) The information required by subsection (2) (a) and (b) of this
section;
(b) A list of employees licensed by the department to supervise
tank services, and identification of the specific tank services for '
which they are licensed; the date the employee received a license from
'the department; and the license number of the employee.
(5) The department will review the license application for com-
pleteness. If the application is incomplete, the department shall
notify the applicant of the deficiencies. The department shall deny,
in writing, a license to an applicant who has not satisfied the
license application requirements. The department shall issue a
- license to the applicant after approving the application.
(6) The department shall issue licenses for a period not to
exceed two years. -
(7) Renewals:
(a) License renewals must be applied for in the same manner as is
required for an initial license, pursuant to subsection (v) of this
section. -
(b) The complete license renewal application shall be submitted
to the department no later than thirty days prior to the expiration
date of the current license.
(8) The department may suspend or revoke a license if the tank
services provider:
(a) Fraudulently obtains or attempts to obtain a license;
(b) Fails at any time to satisfy the requirements for a license
or comply with any rules or procedures adopted by the department;
(c) Fails to meet any applicable state or federal standard relat-
ing to the service performed under the license; or
(d) Fails to employ and designate a licensed supervisor for each
underground storage tank project which is directly overseen by the
tank services provider.
(9) 1 tank services provider who has a license suspended or
revoked. Fay reapply for a license after demonstrating to the depart-
ment that: the cause of the revocation has been resolved.

(10) In the event a tank services provider no longer employs a
supervisor licensed to perform a particular tank service, the tank
services provider must stop'providing .this service on , any . regulated
underground storage tank system. Work involving this service shall •
mot start until a supervisor licensed for the particular . service . is
• again employed by the provider and written notice of the hiring of a
licensed supervisor is received by the department. -
(11) . Any tank services provider licensed by the department under
the provisions of this chapter shall:
(a) Comply with VAC 173-360-600 through 173-360-680;
(b) Maintain a current address on file with the department; and
(c) Comply with all federal and state regulations and procedures
when performing. tank 'services. • .

/ (12) (a) A tank service provider or person qualified to conduct a
Asite assessment must complete a checklist for each regulated activity
performed. The service provider shall submit the checklist to the
department within thirty days following the completion of an under-
ground storage tank installation, retrofit, decommissioning, repair,
site check or site assessment, using a form provided by the
department.
(b) The checklist aust,be signed by the owner or operator, an
executive officer of the firm and, after January 1, 1991, by the
licensed tank services supervisor. -
(c) In addition, the firm must submit an as-built site plan,
shoving the location of completed tank system installations or
retrofitted tank system, including adjacent structures, if present.
(13) A licensed tank services provider, or person qualified to
conduct a site assessment or site check shall report to the department
and the tank owner or operator the existence of any confirmed release
from an underground tank system that poses a threat to human health
and the environment. This report shall be provided to the tank owner
or operator immediately, and to the department within seventy-two
•
hours of the discovery of the condition. If the owner or operator are
not immediately available, the report should be made immediately to
the department.

REMOVAL OF UNDERGROUND TANKS - The removal of underground tanks shall
be ACCOMPLISHED BY TAKING THE FOLLOWING STEPS:
•
•
1 . Excavate to expose the top of the tank.
2. Open check valves and allow product lines to drain into tank. Use
particular care in empting lines to avoid- spilling product into the
excavation. Disconnect all product lines and vapor
recovery lines. Leave the vent line connected or provide
temporary vent 12-foot minimum above ground if existing vent was
tied to vapor recovery. Remove submerged turbine pump and riser
if existing. Leave fill riser and drop tube in place. Cap or plug
all other tank openings.
3. Remove all flammable liquid which can be pumped out. It may
be necessary to use a hand pump to remove the bottom few inches
of product.
4. TO REMOVE VAPORS, THE TANK SHALL BE CONDITIONED BY THE FOLLOWING
METHOD:
Carbon dioxide gas shall be used to render the
vapors inert. Remove fill riser and drop tube
and plug opening. Remove a plug from an opening
at opposite end of tank from the vent. Using
carbon dioxide gas cylinder equipped with a
pressure regulator, run the rubber discharge
through this opening to bottom of tank. Set the
pressure regulator at 40 psi and open the valve
allowing gas to flow into the tank. During this
procedure, vapors may be forced out the opening
containing the hose. It is recommended that
this opening be covered to force vapors toward
the vent. Avoid a tight seal so pressure can be
relieved if necessary.
NOTE:
The contractor shall distribute 1 .5 Lbs.
of crushed solid carbon dioxide dry ice) per
100 gallons capacity throughout the length of
the tank after completing the gas-freeing
process.
While the tank is being ventilated, flammable
vapor flow into the surrounding atmosphere. Ignition
sources shall be eliminated from the immediate vicinity
where a hazardous condition might exist. Barricade the
area within 20 feet of the excavation. Contractor shall
maintain two 20 B.C. Fire extinguishers on job site
at all times. The vapor concentration in the tank shall
be checked periodically with a combustible gas meter
to determine when the tank is gas free. Safe reading
of 20% or less of LEL (Lower Explosive Limit) must be
obtained in tank and at the vent riser before tank is
•
considered gas free.
5. After the tank has been freed of vapors and before the tank is
moved from the site, plug or cap all holes. Use screwed
(boiler) plugs to plug any corrosion leak holes. One plug shall
have a 1/2-inch vent hole to prevent the tank from being
subjected to an excessive pressure differential caused by
extreme temperature changes.
6. Tanks should be removed from the premises as promptly as
possible after these procedures have been completed, for the
atmosphere in the tank may not remain gas free indefinitely.
7. If a tank remains at the site overnight, secure by chocking and
leave barricades in place around the tank. Additional vapor
may be released from liquid held in the scale or sediment in
the tank; therefore, the vapor space shall again be tested and
the gas freeing process repeated.
8. A tank must be handled with extreme care. Exercise caution
during the loading, securing on the truck, and unloading at the
disposal site. All holes in the tank must be plugged and the
tank positioned on the truck so that the plug having a 1/2 inch
vent hole is located at the uppermost portion of the tank. All
transportation regulations concerning hazardous materials must
be followed.

9. BACKFILLING OF TANK HOLE (WHEN NEW TANKFIELD IS NOT IN THE SAME
LOCATION) :
The tank hole is then backfilled with a clean material free of
any organic substance and equal to or better than native soil .
Backfill should be placed in 6-inch layers and machine compacted
to a density comparable with native soil .

ENVIRONMENTAL CHECKLIST
Purpose of Checklist:
The State Environmental Policy Act (SEPA), Chapter 43.21C RCW, requires all governmental
agencies to consider the environmental impacts of a proposal before making decisions. An
environmental impact statement (EIS) must be prepared for all proposals with probable significant
adverse impacts on the quality of the environment. The purpose of this checklist is to provide
information to help you and the agency identify impacts from your proposal (and to reduce or
avoid impacts from the proposal, if it can be done) and to help the agency decide whether an EIS
is required.
Instructions for Applicants:
This environmental checklist asks you to describe some basic information about our proposal.
Governmental agencies use this checklist to determine whether the environmental impacts of your
proposal are significant, requiring preparation of an EIS. Answer the questions briefly, with the
most precise information known, or give the best description you can.
You must answer each question accurately and carefully, to the best of your knowledge. In most
cases, you should be able to answer the questions from your own observations or project plans
without the need to hire experts. If you really do not know the answer, or if a question does not
apply to your proposal, write "do not know" or 'does not apply." complete answers to the
questions now may avoid unnecessary delays later.
Some questions ask about governmental regulations, such as zoning, shoreline, and landmark
designations. Answer these questions if you can. If you have problems, the governmental agencies
can assist you.
The checklist questions apply to all parts of your proposal, even if you plan to do them over a
period of time or on different parcels of land. Attach any additional information that will help
describe your proposal or its environmental effects. The agency to which you submit this checklist
may ask you to explain your answers or provide additional information reasonably related to
determining if there may be significant adverse impact.
Use of Checklist for Non-project Proposals:
Complete this checklist for non-project proposals, even though questions may be answered "does
not apply." In addition, complete the Supplemental Sheet for Non-project Actions (part D).
