The committee includes representatives from the Lakehaven Utility and King County Fire Districts and staff from the city's Land Use and Building Divisions and Public Works Department. This letter summarizes our pre-application conference on August 31, 1995, at which time members of the CDRC discussed development requirements as they apply to your proposal to. construct a 2,123 square foot fast food restaurant with 27 parking stalls and drive through facilities. Where appropriate, pertinent ordinance sections are noted. The items listed below do not include all regulations applicable to the subject proposal. In preparing your application, all pertinent portions of the city's development codes should be consulted. 1. Zoning, Use, and Review Process - The zoning of the site is BC, Community Business. This zoning permits fast food restaurants under Federal Way City Code (FWCC) section 22- 757, as approved through Site Plan Review process. Under Site Plan Review, the Director of Community Development Services makes.a decision based on criteria listed under FWCC section 22-364. A site plan requirements checklist and master land use application are enclosed, along with applicable code sections. Processing time is approximately 60 to 75 days following submittal of a complete application. Building permits are issued after Site Plan approval is issued. •t �! Mr. Jerry Litwin September 5, 1995 Page 2 Note 1 of FWCC section 22-757 states that the city may, by using Use Process II, modify height requirements based on the satisfaction of four criteria. The FederaLWay Hearing Examiner must approve Process II projects. 2. State Environmental Policy Act (SEPA) - Structures in excess of 4,000 square feet or the creation of more than 20 parking stalls are subject to SEPA review. As proposed, your project requires SEPA review. An environmental checklist must be submitted and reviewed prior to the city issuing an environmental threshold determination. All property owners and occupants within 300 feet of the site are notified of the decision. The notification includes a 15-day comment and 14-day appeal period. SEPA review must be concluded before the site plan approval may be granted. 3. 1995 Fees - The proposal to develop the Taco Bell restaurant requires the following fees (fees are indicated in parentheses): Site Plan review ($1,218.00 includes fire review fee), and SEPA environmental determination review as part of project ($472.00 includes fire review fee). Use Process II, if required, ($2,163.00, including fire review). Additional fees are associated with other city and district regulations and permits. Building permits must be obtained before any work commences. 4. Setback Requirements - Structures must be set back a minimum of 20 feet from the front property line in accordance with FWCC section 22-757, unless a variance is approved through Process II. Roofs may overhang up to 18 inches into the setback area. 5. Site Design - FWCC section 22-1441 states that whenever feasible, buildings on the property should be located between the street and the parking area. If this requirement cannot be met, the applicant must submit a letter with the application stating why. The proposed site plan, received August 10, 1995, meets the intent of the design requirement. 6. Lot Coverage- There is no established maximum lot coverage area. Instead, the buildable area is determined by other site development requirements, i.e., required buffers, parking lot landscaping, surface water facilities, etc. 7. Building Height - The maximum height of the building is 35 feet above average building elevation. 8. Parking Requirements Parking, in the amount of one space per 80 square feet of gross floor area, must be provided per FWCC section 22-757. The proposed 2,123 square foot fast food restaurant requires 27 parking stalls; 27 stalls are proposed. Minimum parking stall sizes are 8'x15' for compact spaces and 8.5'x18' for standard spaces, with a 25.5 foot wide drive aisle. Up to 25 percent of the required spaces may be compact stalls. Parking spaces Mr. Jerry Litwin September 5, 1995 Page 3 may be shared with adjacent uses or businesses per FWCC section 22-1422 (enclosed). With shared parking, 90 percent of the parking spaces required by code for each use or business must be provided on the total site. If shared parking is used, the enclosed reciprocal parking agreement must be recorded prior to site plan approval. 9. Landscaping - A preliminary landscape plan prepared by a licensed landscape architect in accordance with FWCC article XVII, Landscaping, is required as part of site plan submittal. a. Perimeter Landscaping - Article XVII, FWCC section 22-1566(f), Community Business, requires Type III landscaping five feet in width along all properties abutting public rights-of-way, ingress/egress easements, and along all perimeter lot lines. Type III landscaping, a mixture of evergreen and deciduous trees interspersed with large shrubs and groundcover, creates a partial visual buffer to separate uses from the street and soften the appearance of parking areas and building elevations. b. Interior Parking Lot Landscaping-Twenty square feet of interior lot landscaping per parking space must be provided in accordance with FWCC section 22-1567, Parking lot landscaping. Twenty-seven proposed parking stalls requires 540 square feet of Type IV landscaping, installed at the ends of all rows of parking and disbursed throughout the interior parking area. Type IV landscaping consists of trees planted with supporting shrubs and groundcover to provide visual relief and shading. c. Parking Area Screening -The parking areas must be screened from South 348th Street right-of-way with either a three foot tall berm installed within the perimeter land- scaping or substantial plantings added to the perimeter landscaping in accordance with FWCC section 1567(e). d. Plant Species - With the exception of lawn areas, at least 25 percent of new land- scaping materials shall consist of drought tolerant species. The preliminary landscape plan should indicate how this requirement is satisfied. e. Biofiltration - A biofiltration Swale, if required, must be depicted on the application for site plan review. Please note that pursuant to FWCC section 22-1570(g), bio- filtration swales and other surface water/water quality structures may be incorporated into required landscape areas, provided the landscaping standards are met and the integrity of the surface water function is not compromised. (See comments below regarding additional Public Works items.) To incorporate biofiltration swales into required landscape areas, a landscaping modification request must be submitted in accordance with FWCC Section 22-1570. • Mr. Jerry Litwin September 5, 1995 Page 4 f. Significant Trees- A significant tree is defined in FWCC section 22-1568 as a tree 12 inches in diameter, or 37 inches in circumference, measured 4.5 feet above the ground, in good health, and not detrimental to the community or obscuring safe site distance requirements. Alders, cottonwoods, and big leaf maples are not considered significant trees. If the project requires removal of more than 75 percent of the significant trees, they shall be replaced in amount equal to 25 percent of the significant trees which existed on the subject property prior to commencing any development activity. All significant trees located within required perimeter landscaping areas must be retained. The preliminary landscape plan should show all trees that meet the definition of significant, and note whether these trees will be removed or retained. g. Screening of Blank Walls, Foundation Landscaping - Building walls which are uninterrupted by windows, doors, or other architectural features, are 240 square feet in area or greater, and not located on a property line, must be screened by landscaping including trees, shrubs, and groundcover appropriate for the area per FWCC section 22-1564(u). Foundation landscaping is also encouraged. h. Modifications - FWCC section 22-1570 (a) through (I) presents the applicant with landscaping modification options and criteria. The preapplication summary letter stated the applicants intent to request a modification to the area of landscaping required. The modification request should contain specific information as to how the proposal meets the intent of the code. 10. Building Modulation - Any facade of a structure that exceeds 50 feet in length must be modulated with the minimum depth of the modulation at three feet, the minimum width at four feet, and maximum width of the modulation at 35 feet, unless a variance is approved through Process II. As depicted, the west side of the site does not meet the modulation requirement. 11. Waste Receptacles - Note 4 of FWCC section 22-757 states that one outdoor waste receptacle must be provided for every eight parking spaces. These must be depicted on the site plan submittal. 12. Pedestrian Access - Sidewalks, a minimum of five feet in width, should be placed along the perimeter of the building per FWCC section 22-1445. Pedestrian access that connects these sidewalks to the right-of-way shall be provided. 1 • Mr. Jerry Litwin September 5, 1995 Page 5 13. Solid Waste and Recycling Storage - FWCC Sections 22-949 and 22-1564(d) provide standards for design, placement, sizing, and screening of garbage receptacles, dumpsters, and storage areas. The receptacles may not be located in required yards or buffer areas. Please contact Jerry Graham (939-9647) with Federal Way Disposal regarding the sizing of general refuse areas. The enclosure must be screened with landscaping per FWCC section 22-1561. 14. Signs - Medium profile signs are permitted with this use pursuant to FWCC section 22- 1601(A)(2). Building mounted signs are also permitted per FWCC section 22-1601(B). A sign permit must be obtained under separate permit; a sign permit application and FWCC Article XVIII (Signs) are enclosed. Please contact Betty Cruz, Code Compliance Officer, at 661-4017 with any sign questions. Generally, pedestal and monument signs are allowed as medium profile signs. The allowed sign height is calculated at the rate of .75 feet in sign height for every ten lineal feet of frontage on a public right-of-way. A medium profile sign shall not exceed 12 feet in height and may be a minimum of five feet in height. Allowable sign area is calculated at one square foot per lineal foot of frontage on a public right-of-way not to exceed a maximum sign area of 80 square feet for the total of all sign faces on each permitted sign with no one sign face exceeding 40 square feet. Every sign is allowed a minimum of 50 square feet of all sign faces with no one sign face exceeding 25 square feet. One pedestal or monument sign is permitted for the subject property. 15. Outdoor Activity or Storage-FWCC sections 22-1113 and 22-1564(b) and (d) address the issue of outdoor activity and storage areas and screening associated with this type of use. Please refer to these sections for specific requirements. 16. Rooftop Appurtenances - Rooftop appurtenances must be screened in accordance with FWCC sections 22-960 and 22-1047. The site plan should contain a statement of all proposed rooftop appurtenances. 17. Light Standards - Lighting fixtures are not allowed to replace trees within required landscape islands. A lighting plan depicting the location of fixtures must be submitted if lighting fixtures are proposed within any landscape areas. 18. Easements - Please provide a copy of any easements for the subject site. 19. Zoning Code Changes - As stated in the preapplication meeting, portions of the non- residential sections of the zoning code will be changed pursuant to the comprehensive plan update. PUBLIC WORKS TRAFFIC DIVISION (Fay Saudi, 661-4139) A Traffic Impact Analysis (TIA) is required for this project. The TIA must include discussion of queuing issues and a driveway access study. The study must determine if a driveway for the subject site would operate in a safe and efficient manner. A Certificate of Water Availability shall be provided indicating the fire flow available at the site. This project will require fire hydrant(s). Existing fire hydrants on public streets are available for this project. Existing fire hydrants on adjacent properties shall not be considered unless fire apparatus access roads extend between properties and easements are established to prevent obstructions of such roads. When any portion of the facility or building protected is in excess of 150 feet from a water supply on a public street, as measured by an approved route around the exterior of the facility or building, on-site fire hydrants and mains capable of supplying the required fire flow shall be provided. Fire hydrants: 1) Shall be located not more than 300 feet on center. All measurements shall be made as vehicular travel distance. 2) Shall not be located closer than 50 feet to any building. 3) Shall not be obstructed by any structure or vegetation, nor shall the visibility of the fire hydrant be impaired for a distance of 50 feet in the direction of vehicular approach to the fire hydrant. [K.C.F.D. #39 Administrative Policy Guideline No. 1004] Fire hydrant locations are subject to the approval of the Fire Marshal or his/her designee. When exposed to vehicular damage, fire hydrants shall be suitable protected. Fire hydrants shall be in service PRIOR to the start of combustible construction. FIRE APPARATUS ACCESS ROADS Fire apparatus access roads shall be provided when any portion of the facility or any portion of an exterior wall of the first story of the building is located more than 150 feet from fire apparatus access as measured by an approved route around the exterior of the building or facility. EXCEPTION: When buildings are completely protected with an approved automatic fire sprinkler system, these provisions may be modified by the chief. Plans for fire apparatus access roads shall be submitted to the fire department for review and approval prior to construction. Fire apparatus access roads: 1) Shall have an unobstructed width of not less than 20 feet and an unobstructed vertical clearance of not less than 13 feet 6 inches. 2) Shall be designed and maintained to support the imposed load of a 25 ton fire apparatus and shall be provided with a surface so as to provide all-weather driving capabilities. 3) Shall be not less than a 32 foot inside turning radius and not less than a 40 foot outside turning radius. 4) With a dead-end in excess of 150 feet in length shall be provided with a cul- de-sac at the dead end. All such cul-de-sacs shall be not less than 80 feet in diameter. 5) Gradient shall not exceed 12 percent. [K.C.F.D. #39 Administrative Policy Guideline No. 1006] Designated fire lanes may be required for emergency access. This may be done during the plans check or after the facility is in operation. When required, approved signs or other approved notices shall be provided and maintained for fire apparatus access roads to identify such roads and prohibit the obstruction by parking and other obstructions. DATE: August 31, 1995 SUBJECT: PRE95-0055, Proposed Taco Bell, 1406 S 348th Street The pre-application has been reviewed for the subject project and the following comments are provided: A. Land Use Issues 1. Storm water runoff from the site will need to be controlled through the use of facilities designed and constructed in accordance with the requirements of the latest edition of the King County Surface Water Design Manual (KCSWDM) . These facilities include, as a minimum, a biofiltration swale and oil-water separation as may be required. The site plan prepared for the project should take into consideration the spacial requirements for these facilities and depict their conceptual location for the land use permit. Further design details will be required with the building permit in order to construct the facilities. 2 . The City has identified downstream conveyance, erosion and habitat problems associated with stormwater runoff. As part of the land use application and SEPA process, the applicant will need to analyze those problems and provide appropriate mitigation as approved by the City. As an option, the applicant may voluntarily provide mitigation as recommended in the Executive Proposed Basin Plan (Hylebos Creek and Lower Puget Sound) . More specifically, the site is located within the West Branch Hylebos Creek Sub-Basin in an area recommended for enhanced stormwater infiltration and implementation of basinwide recommendation BW-2 . Soil logs will need to be provided to verify infiltration suitability. In the even that infiltration cannot be achieved and runoff must be discharged off-site, the Basin Plan calls for the use of a 7 day storm event (BW-2) in sizing on site detention facilities (if required) instead of the 24 hour event generally used in the KCSWDM. However, a 30% safety factor does not have to be used in the detention facility design. 3 . The applicant will need to provide (with the application) a Level 1 downstream drainage analysis and a written narrative on the relevance to the subject site of the 7 Core and 12 Special Requirements of the KCSWDM. Copies of 5 foot topographic contour maps are available for use in preparing the drainage analysis and can be obtained from the City by contacting Kevin Peterson at 661-4126. 4. As part of the SEPA process, the applicant will be required to submit a Traffic Impact Analysis (TIA) . A scoping sheet will be prepared (if the applicant wants to proceed with the project) and is to be used as the basis for this analysis. The TIA will be used to assist in determining any required pro-rata share contributions to traffic improvement projects (used to mitigate the impacts of development) . Any questions regarding this analysis or the scoping sheet should be forwarded to the City's Traffic Analyst, Fay Schafi, at 661-4139. 5. The applicant will not be required to install road improvements other than a tandard drive approach (30 foot maximum width) since S� 348th Street is being fully improved by the City at this time. However, the proposed location of the site's driveway entrance may need to be moved to properly tie in with the improvements along S( 348th Street. The exact configuration of the entrance cannot be determined until the required TIA has been reviewed (see item 4 above) . 6. Wheel stops will need to be provided to keep vehicles from overhanging into sidewalks; otherwise, those sidewalks adjacent to parking areas will need to be increased to 7 feet in width. 7 . Curbing will need to installed along any new pavement edges. B. Building Permit Issues 1. Final site improvement plans will need to be prepared for the project and submitted with the building permit application. The plans shall be drawn on 24" x 36" size sheets at a scale of 1" = 20' , based on KCAS or NGVD-29 vertical datum and signed/sealed by a Professional Engineer licensed in the State of Washington. 2 . A Technical Information Report (TIR) will need to be prepared for the project and submitted with the building permit application. The TIR will require the signature/seal of a Professional Engineer licensed in the State of Washington. p 4 . The applicant shall reimburse the City for the cost of all required regulatory, warning and street name signs that are installed prior to acceptance by the City of all other required improvements. 5.
