Dear Mr. Edwards:
Thank your for your letter of June 29, 1994, which provided clarification on the current
ownership of the Eastwind Motel. With confirmation of title transfer, staff will address the
unresolved issues to your clients, Sung H. Lee and So Cho Lee, the new owners.
As you know, the previous owner Kyung Woo Lee built an addition and remodeled the Eastwind
Motel in 1992 without applying for building permits, in violation of city building and zoning
codes. Following staff notification of the violations and the requirements necessary for project
approval, Kyung Woo Lee submitted an application for site plan approval under SPR 92-0010.
To date, requested information has not been provided, therefore, site plan review and business
license registration remain pending.
Federal Way City Code (FWCC) states that additions to motels must be reviewed through the
Site Plan Review process (FWCC sec. 22-794). A building permit is also required. With the
creation of the additional floor area, all pre-existing non-conformances must be corrected
pursuant to FWCC 22-335 (Non-conforming Signs). In my June 15, 1994, letter to Kyung Woo
Lee, I indicated that there are three non-conforming signs on site that must be brought into
conformance with the code.
Site Plan Review
In response to your letter, the city can approve the Eastwind Motel site plan when the following
has occurred:

1. On-site infiltration
B&C Construction, Inc. has indicated that 2100 square feet of paving at the Eastwind Motel
was completed in 1993. This additional impervious surface must be calculated into the on-
site infiltration plans, and a revised plan submitted for review. Infiltration plan revisions
must be received and approved before the site plan is approved.
2. Non-conforming Signs- Removal
The non-conforming portable sign and the double sided sign on the billboard must be
removed. They may be stored on site but may not used for signage purposes.
3. Non-conforming Sign - Performance Bond
A bond to ensure conformance with applicable sign provisions of the non-conformance
section of the code must be received pursuant to FWCC Division 6. Bonds, section 22-147
through 122-159. This performance bond amount will be 120 percent of the cost to remove
the existing pole sign. The cost of removing the pole sign must be provided in writing by
a professional sign company.
The performance bond for the non-conforming pole sign will remain in effect until adoption
of the new sign code, regardless of the sunset provisions of the current sign code. If the new
sign code upholds the present position towards pole signs, the existing pole sign must be
removed. If the new sign code authorizes pole signs, the owner must apply for a pole sign
permit. At such time, following a written request, the bond would be refunded in full.
Building Permit
As noted in the June 15, 1994 letter, a building permit application must be submitted for interior
remodeling and addition work. Refer to the enclosed copy of the Building Division comments
for the necessary permit application information. The building permit may be submitted prior
to site plan approval, but may not be issued until the site plan has been approved. Plan check
fees are collected at the time of application. A building permit application is enclosed. Please
call the Permit Specialist at 661-4117 or 661-4115 for fee information.
Any electrical work performed must be approved by the Washington State Department of Labor
and Industries (L&I). Please call 248-6630 for information. L&I will need to sign the city issued
building permit.
Once the building permit is reviewed and issued, construction work may be performed. The
owners must schedule specific inspections with city's Building and Public Works staff. The
Building Inspectors and the Fire District will review interior and exterior construction, and the
Public Works inspectors will inspect on-site infiltration system installation. When all inspectors
have approved the project, a Certificate of Occupancy will be issued for the addition and the
remodeled portion of the Eastwind Motel.

Business Registration
Because of unauthorized construction, the City Clerk denied the business registration for the
Eastwind Motel in October 1992. A business registration for Sung H. Lee and So Cho Lee is
pending and will not be approved until the site plan is approved and a building permit
application has been submitted. A Certificate of Occupancy must be obtained within three
months of building permit issuance or the business license will be cancelled.
The city may, at the applicant's written request, expand the Site Plan Review application to
include significant tree removal, in accordance with FWCC Division 7, Land Surface
Modification, section 22-1093.13 (enclosed). However, any additional review elements must be
fully resolved before the site plan is approved. Performance bonds for signs are not appropriate
for unresolved tree issues.
Summary
To summarize, the site plan can be approved when infiltration plans have been re-submitted and
approved, the portable sign and the suspended sign are removed, and a performance bond for
the pole sign is posted by the applicant. A building permit application must be submitted and
approved, and associated inspections conducted before a Certificate of Occupancy can be issued.
Business registration may be permitted when the site plan receives approval and a building
permit for the addition is issued. The applicant will have three (3) months from the date of
building permit issuance to obtain a Certificate of Occupancy, or the business registration will
be cancelled.
The city understands your clients position of ownership and will make every effort to ensure that
information is received from the current owner only.

Dear Mr. Lee:
The City of Federal Way's Technical Review Committee met on Thursday, June 26, 1992
to discuss your application for Site Plan Review. The following is a list of requirements
that will need to be addressed before the City can accept the plans submitted.
Public Works
Roof run-off currently flows off the roof and is displaced onto the landscaping via a
downspout. The roof run-off from the addition will need to be tight-lined from the
( 0037 downspout to an approved drainage system. Additionally, it appears that either the
1 ot parking area was resurfaced or expanded in some areas. If applicable, we need to know
the square footage of paving area added, how long ago the work was completed, and if
the paving was done over what used to be landscaping. If over 5,000 square feet of
"- impervious surface has been added, you will be required to make the necessary drainage
improvements to your parking lot so that it complies with the 1990 King County Surface
Water Design Manual. This information will be needed before the City can approve your
plans.
Federal Way Water & Sewer
The Federal Way Water and Sewer District is requiring you to obtain a supersede side
sewer permit in order to modify the existing side sewer. Federal Way Water and Sewer
is a separate entity from the City; therefore, you will need to contact them for permit
requirements and fees. If you have any questions, please contact Rick Gilmore,
Supervisor of Technical Services at 946-2288.
Federal Way Fire Department
After review of the plans submitted the Federal Way Fire Department is requiring the
building to be sprinklered. Minimum fire flow required is 718 gallons per minute. For

Building Department
A set of redlined drawings is enclosed for your review. Several items will need to be
corrected or changed so that the new addition complies with City building code

Land Use
The proposal is consistent with the Federal Way Zoning Code and Comprehensive Plan.
