The proposed subdivision will generate 7.07 p.m. peak hour trips, which is less than the "10 trip" threshold requiring that a traffic impact analysis be prepared. 6. A minor stream as defined by the Federal Way City Code flows along the property's west property line. Conclusion of Law: 1. Allow for residential development only when supported concurrently by adequate services including roads, utilities, transit, parks, recreation, schools, fire, and police (policy H-4, FWCP). 2. Campus Parkway S-T-R: 19 - 21 - 4 Parcel Size: 1. 94 acres (84,506 square feet) Proposal: The applicant's proposal is to subdivide the subject property into seven (7) single family residential lots. Zoning: Multiple Family (RM 2400) Comprehensive Plan Designation: High Density Residential (HDR) A. Background: 5. Agency requesting checklist: City of Federal Way, Department of Community Development 10. The applicant will need to receive preliminary and final plat approval prior to official recording of this plat. Each dwelling to be constructed will need to have a corresponding building permit. • B. Environmental Elements: 1. Earth: c. The 1973 USDA Soil Conservation Service's (SCS) Soil Survey for the King County Area classifies the site soils as Alderwood gravelly sandy loam and Everett gravelly sandy loam. Both types of soils are suitable for urban development. h. Development of the site will not commence until a grading and erosion control plan is prepared in accordance with the 1990 King County Surface Water Design Manual (KCSWDM) and approved by the City' s Public Works Department. In addition to the requirements of the KCSWDM, the city, due to site topography (steep slopes) is conditioning subject SEPA determination so that the entire site is mass graded and stabilized prior to final plat approval. The purpose of this requirement is to address possible erosion impacts to the site and adjacent stream that may result from individual grading of the proposed lots. Mass grading and the placement of necessary rockeries and retaining walls as well as hydro-seeding of the site will ensure that the site is stable for construction of homes. Typically mass grading of a site prior to development is prohibited by the requirements of the city's land surface modification section of the City Code. However, Section 20- 179 of the FWCC (Subdivision Ordinance) allows for grading and placement of improvements if approved during the preliminary plat process. 2 . Air: Concur with checklist. 3 . Water: 3.a.1. An unnamed tributary to Panther Lake flows along the westerly edge of the subject property. The tributary has been enlarged and culverted in part over the past to accommodate a large volume of runoff. The unnamed tributary is ephemeral and does not support a resident fish population and is not identified in the Hylebos Creek and Lower Puget Sound Basin Plan. 3.a.2. The applicant will be constructing improvements and doing 2 earthwork within 200 feet of the tributary. The Federal Way City Code section , requires that a 50 foot buffer be provided between the site development and the unnamed tributary. The applicant has provided the 50 feet. 3.b.1. The Hylebos Creek and Lower Puget Sound Basin plan identifies this site as an area recommended for enhanced storm water infiltration. The project proponent plans to use the Panther Lake Storm Water Facility for detention and for infiltration purposes. As part of the Panther Lake improvements, Panther Lake is to be fitted with a mechanism which facilitates infiltration. 3.b.2. Sewer service is available to the site. No septic systems will be allowed. No discharge of waste water is anticipated for this development. 3.c.1. Roof runoff will be infiltrated into the site if possible; other sources of runoff will be directed to the unnamed tributary that flows into Panther Lake. 3.c.1 At the time of development, the requirements of the King County 1990 Surface Water Design Manual will apply to this project, requiring such storm drainage improvements as: 1) surface water detention; 2) biofiltration; and 3) oil/water separation. The proposed project must be designed to comply with all applicable Core and Special Requirements outlined in the surface water design manual. To determine the necessary storm water improvements, a Level 2 Downstream Analysis and a narrative addressing the 7 core and 12 special requirements of the King County Surface Water Manual was completed for the subject property. The Level 2 Analysis suggests that the stream be cleaned of debris and trash in order to facilitate an even and uninterrupted flow of storm water. As stated above, the applicant at their discretion may choose to use the Panther Lake Storm Drainage Facility for storm water detention and infiltration. If this course of action is chosen, the applicant will be required to pay a pro-rata share contribution for the capital costs of the Panther Lake Surface Water Facility. The pro-rata share contribution as calculated by the Panther Lake Study amounts to $1800. 00 per acre. The total amount payable prior to recording of the plat will be $3,942 . 00 dollars. If the Panther Lake Storm Water Facility is not on-line by the time the city grants final plat approval, the applicant will be required to provided on-site detention in conformance with the KCSWDM. Policies adopted by the City of Federal Way as a basis for the exercise of substantive SEPA authority to approve, condition or deny proposed actions which are applicable to potential adverse environmental impacts resulting from this project include the following: 1. Allow for residential development only when supported 3 concurrently by adequate services including roads, utilities, transit, parks, recreation, schools, fire, and police (policy H-4, FWCP) . 2. Enforce measures to be taken during construction to prevent erosion (policy NE-6, FWCP) . 3. Assure for all people of Washington safe, healthful, productive, and aesthetically and culturally pleasing surrounding (policy 10.230.20(2) Federal Way Environmental Policy Ordinance. 4. Require environmental impact assessment and mitigation of potential impacts to sensitive areas before development is permitted (policy NE-9, FWCP) . 5. Retain existing wetlands and drainage channels to recharge aquifers and contain storm water run-off (policy NE-14, FWCP) . 6. Based on these policies, the following mitigation measures should be required to minimize identified potential adverse impacts to the environment: 1. To facilitate periodic maintenance of the stream channel the existing dirt road along the northeast side of the stream will need to be improved to 12 feet wide and be surfaced with grass-pavers for the entire length of the property. 2. Due to site topography a mass grading plan shall be submitted prior to preliminary plat approval. The grading plan shall assume a 2, 000 square foot building pad and a 20-foot driveway for each lot. Actual mass grading of the site will need to be completed prior to the city recording the subject plat. 4 . Plants: At the time of development, site landscaping as required by Article XVII, Landscaping, FWCC, will also be required. In addition the preliminary plat indicates a ' 60 foot tree retention area' that will buffer the proposed residences from the BPA powerlines. 5. Animals: a. It is likely the site provides habitat for small mammals, rodents and amphibians as well as songbirds, waterfowl and insects. 4 6. Energy and Natural Resources: Concur with checklist. 7. Environmental Health: The Bonneville Power Administration has a high voltage powerline that runs along the southern boundary of the subject property. According to recent information on Electromagnetic Fields ("EMF") , there are currently no National or Washington State standards for exposure to electric or magnetic fields. However, standards that BPA sets for EMF levels are comparable to other state standards adopted for EMFs. In addition, over the past twenty years, research has shown that electric and magnetic fields do produce biological effects; but the studies have failed to establish that the effects are harmful to human health. Further, attention has been focused on high levels of continuous exposure experienced by people living or working near transmission lines. Neither the City of Federal Way or State of Washington have adopted any regulations or policies which would prohibit development either under or near the BPA easement. In the absence of conclusive evidence that a harmful relationship exists between EMF and proximity of residences to powerlines, the question of requiring mitigation need not be answered. 8. Land and Shoreline Use: 8.e. The subject property is zoned multiple family based on a density of one unit per 2,400 square feet per unit. This particular zoning district allows for detached dwelling units with a minimum lot size of 5,000 square feet. The project complies with this requirement. 8.f. Federal Way Comprehensive Plan designation for the site is High Density Residential (HDR) . 8.1. The proposed preliminary plat will be reviewed for consistency with the Federal Way City Code and Subdivision Ordinance, State Law (RCW 58.17) as well as all other codes and/or ordinances that may apply. 9.
