CITY'S REQUEST: As part of the Development Review of this project the City of Federal Way based on its present standard code has requested that the property owner complete the following Road / Frontage Improvements for this 3 lot project. 1. The applicantlowner would be expected to construct street improvements consistent with the planned roadway cross -sections as shown in Map 111-6 of the FWCP and Capital Improvement Program (CIP) shown as Table 111-19 (FWRC 19.135,040). Based on the materials submitted, staff conducted a limited analysis to determine the required street improvements. The applicant would be expected to construct improvements on the following streets to the City's planned roadway cross -sections: 2. S 359th Street is a Minor Collector planned as a Type "T" street, consisting of a 28-foot street with shoulder, 8-foot ditch, and 5-foot sidewalks in a 60-foot right-of-way (ROW). Assuming a symmetrical cross section, half -street improvements are required with no ROW dedication as measured from the street centerline. NOTE: Based on the City's Analysis and our confirmation no additional right of way would be required for the above - listed improvements. REQUEST: At this time the Property Owner requests Right -of -Way Improvement Modification Waiver Request for the following. 1. S 359 Street is a Minor Collector planned as a Type "T" street, consisting of a 28-foot street with shoulder, 8- foot ditch, and 5-foot sidewalks in a 60-foot right-of-way (ROW). Assuming a symmetrical cross section, hall -street improvements. BASE FOR REQUEST: In accordance with the City of Federal Way Regulation and Codes we are requesting a Right -of -Way Improvement Modification Waiver for this property and project with the following justification and supportive documentation. MAIN JUSTIFICATION IN SUPPORT OF THE REQUEST: "The improvement as required would not be harmonious with existing street improvements, would not function properly or safely, or would not be advantageous to the neighborhood or City as a whole." Although this is a 3 lot short plat it is only adding 2 new homes to this property area. 2. Presently the property frontage to the 3 lot short plat will be via a private easement. 3. There are no private or public roads proposed as part of this project. 4. The property frontage entrance is located on 359th St Street. 5. The existing property frontage is only 188 ft in width. (See exhibit A and B) 6. If you take out the Private Easement Entrance the frontage will be only148 ft in width. (See exhibit A and B) 7. Additional trees would need to be removed for the Road Right of Way Improvements to be installed. 8. Based on the grade of the site, a retaining wall would have to be added at the back of the Right of Way between the Right of Way and existing lot and home. 9. 359th Street has no frontage improvement within 500 (+) feet to the East and over 500 (+) feet to the West (See exhibit C, D, E) 10. 359th Street has no sidewalks adjacent to the property within 500 (+) to the East and over 500 (+) to the West (See exhibit Z) 11. Doing street widening with frontage improvements would only be for 188 ft of the road and would not provide for a safe road with frontage improvements and tapering from the existing road conditions to the new frontage improvements would result with less the 40 ft of full widened road. 12. Doing street sidewalks would create a sense of a safe road / sidewalk area but only for 188 ft and thus people on the sidewalk then would have to walk out on the street with no other sidewalks thus creating and unsafe pedestrian path. 13. Aligning the drainage ditch based on the new road section would not allow for the existing storm drainage system to function properly. 14. The cost of any frontage improvements would exceed the allowable value % for a project of this size and thus would have to be passed on the home buyer as part of the home price. 15. The property owner will be paying the required Traffic Mitigation fees as required by the City of Federal Way as part of each building permit approval for this property. 16. In addition to the above information and as part of this request we ask the City to process and approve this request based on the following City of Federal Way Code that indicates that "The city may require". Thus based on the above -conditions not being harmonious with existing street improvements and possible safety concerns based on only a small section of the road having improvement we ask for this waiver. REFERENCE INFORMATION: FWRC 19.135.050. The city mad• require the applicant to pave or install additional improvements within rights -of -way, either abutting or not abutting the subject property. This may include traffic signals, channelization, turn lanes, and other improvements necessary or appropriate to improve traffic circulation and safety, the need for which is directly attributable to development of the subject property. Where appropriate, the public works director may permit the applicant to fulfill the applicant's obligation under this section by paying to the city the pro rata share of the costs of the required improvements attributable to development of the subject property, as determined by the public works director. The city may also require the applicant to provide traffic studies and other data describing the traffic impacts of the proposed development, the need for improvements under this section, and the reasonable pro rata share of the costs of these improvements to be borne by the applicant. CLOSING COMMENTS: As stated above, at this time the Property Owner requests Right -of -Way Improvement Modification Waiver Request 1. S 359 Street is a Minor Collector planned as a Type "T" street, consisting of a 28-foot street with shoulder, 8- foot ditch, and 5-foot sidewalks in a 60-foot right-of-way (ROW). Assuming a symmetrical cross section, half -street improvements. If for some reason the City of Federal Way is not in support of this request but is willing to discuss other options as deferment until the area is totally built out, reduction in the improvements required or other items we would be glad to meet and discuss them with you. Federal Way Revised Code (FWRC) Section 19.135.070; Modifications of Improvements Along Property Frontage, allows the Public Works Department to grant a modification, deferral, or waiver of the required street improvements, after consideration of four specific reasons. The reason stated in your request is "...improvements as required would not be harmonious with existing street improvements...", as provided under FWRC 19.135.070(l). South 3591h Street corresponds to Federal Way Roadway Section "T". This section requires a 28-foot paved roadway with shoulder, an 8-foot wide drainage ditch, and a 5-foot wide sidewalk, all within a 60-foot wide Right of Way. The existing roadway section abutting the 359th Street Short Plat parcel consists of an approximate 20-foot paved roadway with a shallow ditch, within a 60-foot right of way. After evaluating the existing conditions along the referenced street, review of Federal Way Revised Code (FWRC) provisions (Section 19.135.070), and direction provided by the City Council, the Public Works Department hereby requires that the following, modified, improvements be constructed along the property frontage: Add 4-feet of asphalt paving along the parcel frontage; Construct asphalt tapers/transitions at each end of the widened roadway section; Construct a shallow swale along the north side of the widened roadway so that stormwater continues to drain to the west as it does presently. The street improvements shall be constructed and accepted prior to Final Short Plat approval. Additionally, the on -site access roadway and drainage system shall be constructed and accepted prior to Final Short Plat approval. The conditions of this modification will be applicable for a period of one year from the date of this letter. If a permit is not issued within the one-year time limit, this waiver will be void, and a new request for modification must be submitted.
