The applicant proposes to subdivide one commercial lot into two commercial lots, thereby segregating the Personal Wireless Service Facility (PWSF) from the existing property. The site is located at 1741 South. 356`h Street (King County tax parcel 282104-9178). The City received your application on August 28, 2008. The Department of Community Development Services deemed the application complete on September 19, 2008. The City of Federal Way hereby grants preliminary approval of the Lloyd Cell Tower BSP, subject to the conditions noted below. This approval corresponds to the BSP drawing, date -stamped as resubmitted October 27, 2008. Pursuant to Federal Way City Code (FWCC) Section 20-62, Binding Site Plan applications shall be processed in accordance with the provisions of short subdivisions; therefore, this Decision of the Director is based on the enclosed Statement of Facts and Conclusions and in accordance with decision criteria listed in FWCC Section 20-91. CONDITIONS OF APPROVAL If the existing "Lloyds Building" located on the proposed "Parcel B" property line is not demolished prior to recording of the Binding Site Plan, the applicant shall comply with the following conditions to the satisfaction of the Building Official: 1. Schedule a demolition to commence within 180 days of recording the Binding Site Plan with the King County Division of Elections and Records. 2. Post a bond with the city in the amount equal to the actual demolition costs. 3. Provide to the city a voluntary compliance agreement that the building will be removed within the 180-day time period. RECORDATION As no infrastructure improvements are proposed or required by the City, the applicant may submit a mylar to the Department of Community Development Services for recording subsequent to the above -referenced conditions being met. The mylar shall be recorded by the city with the King County Department of Elections and Records. All fees for such recording shall be paid by the applicant. A copy of the documents, stamped with the recording number, shall be forwarded to the county department of assessments for assessment purposes. Mr. Pixton January 21, 2009 Page 2 APPEAL PROCESS Pursuant to FWCC § 20-94, any person who receives a copy of this decision may appeal the decision within 14 days of the date of issuance. The decision may be appealed in the form of a letter delivered to the Department of Community Development Services by 5:00 p.m., February 4, 2009, at the following address: City of Federal Way, 33325 8"' Avenue South, PO Box 9718, Federal Way, WA 98063. An appeal letter must contain a clear reference to the matter being appealed, along with a copy of the decision. A statement of the alleged errors in the decision and required appeal fee must be included. Any additional requirements of FWCC Section 20-94 must be followed. SEPA THRESHOLD DETERMINATION Pursuant to the State Environmental Policy Act (RCW Chapter 43.21 C), the proposal is exempt from SEPA review. DURATION OF APPROVAL Binding Site Plan preliminary approval shall expire one year from the date of issuance of this decision. However, the applicant may submit a written request in the form of a letter with supporting documentation to the Department of Community Development Services requesting a one-time extension of this limit of up to one year, pursuant to FWCC § 20-107. OTHER AGENCY PERMITS The applicant is responsible for identifying and obtaining all required state, federal, or other agency permits, as may be required. REQUESTS FOR CHANGE OF VALUATION Any affected property owners may request a change in valuation for property tax purposes, not withstanding any program of revaluation. Proposal — The applicant proposes to subdivide one commercial lot into two commercial lots. The land division will segregate the Personal Wireless Service Facility (PWSF) from the existing commercial lot. The BSP will result in two lots measuring 54,350 square feet (Parcel A) and 3,275 square feet (Parcel B) as shown on the BSP document (Exhibit B). 2. Review Process — Pursuant to Federal Way City Code (FWCC) Chapter 20, Division 4, `Binding Site Plan', the proposed BSP is subject to administrative review and a decision is rendered by the Director of Community Development Services. The proposal has been reviewed by the Development Review Committee, which includes staff from the City's Planning and Building Divisions, Public Works Department, Lakehaven Utility District, and South King Fire and Rescue. Zoning — The subject property is located within a Commercial Enterprise (CE) zone. The existing land use for proposed Parcel A is equipment repair, a permitted use in CE zones with no minimum lot size prescribed in FWCC Section 22-865. The existing land use for proposed Parcel B is PWSF, a permitted use in CE zones with no minimum lot size requirements prescribed in FWCC Section 22-874. 4. Comprehensive Plan — The subject property's comprehensive plan designation is Commercial Enterprise. The proposal is in compliance with the Federal Way Comprehensive Plan (FWCP) and related criteria listed in FWCC § 20-2. State Environmental Policy Act (SEPA) — The proposed BSP is exempt from SEPA pursuant to Washington Administrative Code (WAC) 197-11-800(6)(a). 6. Ingress/Egress — Access to the Parcel A will be via the existing panhandle, which extends to Enchanted Parkway South. Access to Parcel B will be per the conditions of a 15-foot ingress and access easement recorded in 2000 with the King County Division of Elections and Records under number 20000811000018. 7. Stormwater — The subject site is composed mostly of impervious surface. The BSP proposes no changes to that impervious surface; therefore, no stormwater requirements apply at this time. 8. Concurrency & Street Frontage Improvements — Based on Public Works Department analysis and FWCC, the applicant is not subject to concurrency analysis and is not required to construct street improvements due to the lack of new trips being generated. 9. Engineering — No stormwater or street improvements are required; therefore, the City's Public Works Department will not require engineering review. 10. Decisional Criteria —The proposal is consistent with all items listed in FWCC 20-91(b), which include the following: (1) FWCP; (2) Applicable provisions of FWCC Chapter 20 `Subdivisions'; (3) The public health, safety, and welfare; (4) Design criteria, development standards, Revised Code of Washington (RCW) 58.17, and other applicable ordinances or regulations of the City. Provide names of all vested owners and lenders. 13. Provide lot closure calculations. 14. Provide a title report less than 30 days old. 15. Include distances and bearings for the proposed lot. 16. Show existing and proposed easements and other encumbrances. APPLICATION STATUS As of today, the 120-day maximum review time frame is suspended with 15 of the 120 days used. It will be restarted within 14 days of the date of your complete response to the request. When resubmitting requested information, please provide six copies of any plans, four copies of any reports, and the green resubmittal form.
