Development Agreements Requiring Process VI Review

Citation of Code Provisions - Federal Way Revised Code (“FWRC”) 19.80.010; FWRC 19.85.200–210.
Summary Statement of Interpretation - Generally, amendments or modifications to development
agreements are processed and approved using the amendment process specified in Chapter 19.85 FWRC,
Development Agreements, and require no additional review processes under City code. Such an amendment
must be done by written instrument, signed by all parties, and processed and approved as if it were an
application for a new Development Agreement. However, some particular proposals which involve a
Development Agreement amendment may require Process VI Review, either alone or in conjunction with the
standard Development Agreement amendment process, in order to be approved.

Right to Appeal - Any person who is aggrieved by this interpretation may appeal the interpretation
within 14 days (March 31, 2023). The appellant must file a letter of appeal indicating how the
interpretation affects his or her property and present any relevant arguments or information on the
correctness of the interpretation. The applicant shall include the appeal fee as established by the
City. The appeal will not be accepted unless the required fee accompanies it. An appeal of this
interpretation will be reviewed and decided upon using Process IV.
Deadline for Filing an Appeal - On or before 4:00 p.m., March 31, 2023
