Dear Mr. Sadri:
The City has completed an administrative review of the requested variance submitted November
18, 1994, and hereby approves the request for variance per the provisions contained in this
letter. The "Findings of Fact and Conclusions for Variance Request, Federal Way application
number UPR 94-0024" is hereby incorporated as though set forth in full.
The variance proposal to deviate from the undergrounding requirements of City Ordinance No.
91-90, Underground Wiring is approved. These requirements are hereby waived and the
applicant may utilize existing above ground utility poles to link communications systems at the
above referenced facilities.
Conditions of approval
1. The applicant shall obtain a permit from the office of the City Public Works Department
prior to construction of such systems in the public right-of-way in accordance with City
Ordinance Pursuant to City Ordinance 90-91, section 4, Permits, (B) aerial permits.
2. The applicant shall provide documentation that authorizes the use of existing utility lines
in the system connection. A copy of this document shall be placed in the above
referenced file.
Unless modified or appealed, this approval is valid for a period of one (1) year from the date
of the decision. If no further action is taken within one (1) year of the decision, the decision will
expire. One six-month extension may be granted only if a written request is submitted to the

City Department of Public Works, 33530 1st Way South, Federal Way, WA 98003, at least 30
days prior to the expiration of the decision.
This decision may be appealed by any person who received a copy of this decision. The appeal
must be in the form of a letter delivered to the Department of Community Development
Services, 33530 1st Way South, Federal Way, WA, and be accompanied by the established fee,
within fourteen (14) calendar days after issuance of the decision. The appeal letter must contain
a clear reference to the matter being appealed and a statement of the factual findings and
conclusions of the Director of Community Development disputed by the person filing the appeal.
A request for reconsideration of this decision may also be filed by any person who received a
copy of the decision, within fourteen (14) calendar days after issuance of the decision.
This decision shall not waive compliance with future City of Federal Way codes, policies and
standards relating to this development.

FINDINGS OF FACT AND CONCLUSION
FOR VARIANCE REQUEST
UPR 94-0024
Process I Variance request
Request: The variance proposal consists of a request to deviate from the undergrounding
requirements of City Ordinance No. 91-90, Underground Wiring. This ordinance
states "that major additions of new facilities (three or more spans and/or 500 feet
or more) shall be placed underground." The applicant seeks to link two city
owned sites with communications wires placed on existing utility poles.
Location: Steel Lake Fire Station at 31121-28th Avenue South and Steel Lake Annex at
2645 South 312th, in Federal Way, Washington.
Zoning: The Fire Station site is located within the RS (Residential Single Family) zoning
district. The Annex is located in a SE (Suburban Estates) zoning district.
Background: The Fire Station site contains two building providing City of Federal Way Parks
and Recreation Department facilities and storage. The Annex site is one of several
buildings within Steel Lake Park, providing recreation offices and facilities. Both
sites have independent computer networks, that are accessible only via modem.
Two pairs of phone wires are necessary to link the two systems and facilitate data
communication operations of recreation staff at both locations. There are existing
Puget Power utility poles and associated lines between each location.
FINDINGS OF FACT
Following are findings of fact to support approval of a variance request for underground wiring
requirements between Steel Lake Fire Station at 31121-28th Avenue South and Steel Lake Annex
at 2645 South 312th, in Federal Way.
1. The Fire Station site is designated SR (Suburban Residential) by the City's adopted
Comprehensive Plan. The Comprehensive Plan designation for the Annex is OS (Open
Space).
2. The Fire Station site is an unplatted parcel approximately 1.85 acres. The annex site is
in the southerly portion of the 51.7 acre Steel Lake Park.
3 The two sites are approximately 1,100 feet apart, along South 312th Street.
4. The recreation and office uses are permitted within each zoning district subject to site
plan approval.
5. No environmentally sensitive areas have been identified at the Fire Station or the Annex
site.
6. Urban utilities and services are provided at the sites. Current uses of the surrounding
area include the following:
Fire Station: Annex:
North: Suburban Residential City Park
South: High Density Residential City Park
East: Interstate - 5 High Density Residential
West: City Park Vacant Lot
7. The variance request embodies good design principles that will not conflict with adjacent
uses in the immediate area.
8. In accordance with FWCC section 22-351, Process I review, a Notice of Application was
issued on December 8, 1994. This notice was posted at the Federal Way Libraries, the
subject sites, City Hall notice board, and published in the official city newspaper.
Decisional Criteria and Conclusions:
Pursuant to City Ordinance 91-90, section 6 (A), Variance Procedures, a variance request is to
be processed under the provisions of the Federal Way City Code (FWCC) section 22-351,
Process I review. City Ordinance 91-90, section 6 (B) states that the Public Works Director
may waive or modify the underground requirements only if the owner or user demonstrates that
it would be undue hardship to construct such facilities underground. Undue hardship is defined
as 1) the installation would be technologically unfeasible; or 2) the cost of the underground
construction outweighs the general welfare consideration in requiring underground construction.
The applicant has applied for a variance citing the undue hardship of costs associated with
undergrounding communication lines and the temporary nature of the project. The applicant has
stated that the cost of placing the lines underground has been estimated at $4,450.00, while the
cost of utilizing existing power poles is approximately $625.00. The applicant states that the
estimated cost of undergrounding the lines is more than 700 percent higher than utilizing existing
power pole lines, and feels the cost of underground construction outweighs the general welfare
consideration in requiring underground construction.
The applicant also states that portions of the recreation facilities proposed to be linked by the
phone lines may be vacated during 1995, thus rendering this a temporary connection. Upon
vacation, the wiring would be removed.
Conclusions:
The variance request application has been reviewed for compliance with Federal Way
Comprehensive Plan, pertinent zoning regulations and all other applicable City regulations. The
variance request meets decisional criteria required under City Ordinance 90-91, section 6, B.
The variance request has been processed in accordance with FWCC section 22-364, Purposes
of review, and FWCC Section 22-351, Process I review. This decision shall not waive
compliance with future City of Federal Way codes, policies and standards relating to this
decision.

including a File server where all the programs and files are and
each network is independent of the other.
Quite often users at one location need to access programs or data
residing in the file server at the other location. Currently they
have to use a very cumbersome and unreliable modem to do that.
If we can run the requested wire between the two locations then
we can connect the two networks together and eliminate one of the
file servers. This is a much cleaner, faster, and efficient
solution and will improve the data communications between these
locations.
Also because we currently have a direct link between City Hall
and Fire station then, this solution will put all the staff at
City Hall, Fire Station, Maintenance shop, and Annex on one
virtual network therefore improving the data communication,
e-mail, and accounting capabilities.

Mr. Roe
I am requesting a variance to the existing ordinance on underground wiring based on the undue
hardship of costs and the temporary nature of this project.
We need to run two pairs of phone wire between the Steel Lake Annex and the Steel Lake Fire
Station buildings to connect the two Local Area Networks together. This connection is necessary
to the operations of recreation staff at these locations.
The distance between the two buildings is approximately 1,100 feet. Our proposed wiring suggests
to run a wire from the top of Annex building to the Puget Power utility pole and along the 312th
street and across 28th Street and terminate at the Steel Lake Fire Station building. (Please see
attached diagram)
The existing power poles are being used for electricity and Viacom cable at this time. We have
contacted the Puget Power company and they have no problem with our request to use their poles
as long as we pay for the permit and the wire is run at the same height as the Viacom cable is run.
1. Overhead wiring costs:
Cable $275.00
Permit from Peugeot Power $250.00
Misc. hardware $100.00
Labor to be provided by Parks staff.
