Committee members at that meeting included representatives from the city's Public Works Department, Department of Community Development Service's Planning and Building Divisions, King County Fire Department, and Lakehaven Utility District. This letter follows up the preapplication conference for your proposal. Department and agency requirements are summarized below or are enclosed with this letter. Staff contacts are listed with each summary. PLANNING DIVISION—Minnie Dhaliwal,253-661-4082 A) Required Review Process Land Use Approval: The zoning of the subject site is Residential Single Family, RS-9.6. It has been previously determined that a minor stream traverses the southwest portion of the subject site. The proposed project involves work in a minor stream buffer. Therefore,the required review process for the project is Process IV (Hearing Examiner's Decision). Under Process IV city staff makes a recommendation to the Hearing Examiner and the Hearing Examiner issues the final decision. All property owners within 300 feet of the subject site are notified of the public hearing. The Hearing Examiner's decision is issued following a public hearing. A development submittal requirements checklist and master land use application are enclosed along with applicable code sections. The building permit can be issued after Process IV approval is granted. Mr. Johnson Page 2 May 24, 2000 State Environmental Policy Act(SEPA): The project is also subject to SEPA review as the project involves work in a stream buffer. The Hearing Examiner's public hearing is scheduled following conclusion of the environmental application. B) Fees: The project requires the following fees(fees are indicated in parentheses): Process IV, Hearing Examiner's Decision($2520,minus$310 deposit paid at the time of the preapplication)and SEPA($550). Additional fees are associated with other city and district regulations and permits. C) Stream Buffer Intrusion: Per Federal Way City Code (FWCC) Section 22-1306,the setback area for a minor stream includes all areas within 50 feet outward from the ordinary high water mark of a minor stream. FWCC Section 22-1312lists the criteria used to approve stream buffer intrusions. The applicant must demonstrate how the criteria listed under FWCC Section 22-1312 are met. Without your analysis of the criteria, we are unable to say at this time if city staff would recommend approval of the intrusion. The first priority in developing his property should be avoidance of intrusions and impacts to the stream and stream buffer. Please be aware that the rehabilitation and restoration of the disturbed stream buffer must be completed as per the approved plans and all timelines must be met independent of this buffer intrusion project. Please be advised that the city's review of specialized studies related to environmentally sensitive areas such as streams is provided to applicants on a cost recovery basis. Upon receiving the formal application,the city will get a cost estimate from the city's consultant. The consultant will only be authorized to review the stream report after receiving payment from the applicant. D) Miscellaneous • All easements must be shown on the site plan. In particular,the title report refers to two items, a sewer easement and conditions/notes delineated on the face of a survey recorded in 1996,both of which are not shown on the site plan. • The other item discussed at the meeting was the access road. Refer to the enclosed Public Works and Fire Department's comments related to the access road. If any improvements that are proposed to the access road are within the stream setback,the required review process will be Process IV. However, if the stream is in a culvert or if improvements are within existing improved area,the stream setback does not apply. The applicant will need to provide a Targeted Drainage Review addressing erosion and sedimentation control, floodplain/floodway delineation, and flood protection facilities as outlined in the 1998 King County Surface Water Design Manual(KCSWDM)and the Federal Way Addendum to the KCSWDM. As a reminder,the following issues must be resolved as part of the building permit,regardless of the location of the home in relation to the stream buffer: 2. The developer must provide a dispersion system for storm water runoff generated by the roof and driveway. A final design has not been approved. 3. If the proposed access will be extended to the adjacent lot to the east,the developer will need to provide an access easement. The access should be a minimum of 20'wide and provide a turn-around for fire vehicles. Five foot wide sidewalk and eight foot wide ditch is also required. If the developer wishes to request a modification to this standard,a written request must be submitted to Cary Roe, Public Works Director. A handout is enclosed which explains this procedure. 4. A lot line elimination must be completed. * . TECHNICAL REVIEW (RESIDENTIAL) Agenda Date: May 18, 2000 Subject: Riverstone Homes/00-102448/Dhaliwal To: Development Review Committee From: Greg Brozek - Federal Way Fire Department WATER SUPPLIES FOR FIRE PROTECTION A Certificate of Water Availability shall be provided indicating the fire flow available at the site. • Fire hydrants shall be spaced 700 ft. or less apart. Every building lot shall have a fire hydrant within 350 ft. All measurements shall be made as vehicular travel distance. Fire hydrants shall be in service PRIOR to and during construction. FIRE APPARATUS ACCESS ROADWAY Fire apparatus access roadways shall be required for every building when any portion of an exterior wall of the first story is located more than 150 ft. from fire apparatus vehicle access. Fire apparatus access roads: 1) Shall have an unobstructed width of not less than 20 feet and an unobstructed vertical clearance of not less than 13 feet 6 inches. 2) Shall be designed and maintained to support the imposed load of a 25 ton fire apparatus and shall be provided with a surface so as to provide all- weather driving capabilities. 3) Shall be not less than a 20 foot inside turning radius and not less than a 40 foot outside turning radius. 4) With a dead-end in excess of 150 feet in length shall be provided with a cul-de-sac or Fire Department approved alternative at the dead end. All such cul-de-sacs shall be not less than 80 feet in diameter. 1 5) Gradient shall not exceed 15 percent. 6) Serving a single residential property which have a dead end in excess of 150 feet in length shall be provided with a turn around approved by the chief. [K.C.F.D.#39 Administrative Policy Guideline No. 1006] EXCEPTION: When buildings are completely protected with an approved automatic fire sprinkler system, these provisions may be modified by the chief. Fire apparatus access road gates shall comply with K.C.F.D. #39 Administrative Policy Guideline No. 1001 (copy attached). AUTOMATIC FIRE SPRINKLER SYSTEMS An automatic fire sprinkler system shall be installed in Group R, Division 3 occupancies: 1) When the occupancy exceeds 2,500 square feet (including attached garages) without adequate fire flow. 2) Without approved fire department access. 3) When the occupancy exceeds 10,000 square feet. 4) When the building is classified as an over-water structure. Comments: The minimum fire flow for one- and two-family dwellings shall be 1,000 gallons per minute. If the slope of a building lot does not allow the building(s) on the site to comply with the "life safety/rescue access" requirement, the building(s) shall be provided with an approved automatic fire sprinkler system. Life safety/rescue access shall mean an unobstructed access to all floor levels and each roof level of a building on not less than 20 percent of the building perimeter by utilizing a 35-foot ladder. An alternate method would be at least one stairway enclosure with exit doorways from each floor level and with a door opening onto each roof level which conforms to the requirements of the Uniform Building Code. Jones and Associates, Inc. 1.0 Introduction This study is for a stream determination and classification of an unnamed intermittent stream which flows into Puget Sound, located south of Redondo. This stream survey was conducted by Jeffery S. Jones, Certified Professional Wetland Scientist. 2.0 Methodology Habitat units identified, measured and evaluated using the USFS methodology"Stream Habitat Classification Inventory Procedures for Northern California" (McCann, 1990) and "Methods for Evaluating Riparian Habitats with Applications to Management" (Platts, 1987). Stream flow was estimated using the formulated Q(cfs)=A(area sf) x Velocity (fps). Streambanks were surveyed by Centre Pointe, Inc., licensed professional land surveyors. 3.0 Stream Location and Description The subject property is Lot 3 of Block33, Buenna Addition, at 268XX 2"d Ave. South, Federal Way, Washington. The stream reach adjacent to the subject property is a tributary of a short stream that discharges directly into Puget Sound. The source of this tributary is a 12-inch corrugated pipe, located near the southwest property corner of Lot 3 and an eroded ditch that flows into the natural drainage feature. The drainage feature is well defined by the topography. It is three to eight feet deep and one to thirty feet wide in the bottom. The stream flows in a series of small cascades and riffles. Below the development known as Redondo Bay the drainage flows into a larger drainage feature. The primary drainage feature flows through a culvert at S.W. 293`d, and then flows six or seven hundred feet down to Puget Sound. Just prior to entering Puget Sound the drainage feature is completed developed and there are two culverts and a section of channel confined by boards. The out-fall from the final culvert is above the normal high water tide line, preventing fish in Puget Sound from entering the stream. 4.0 Riparian Land Use Riparian land use is a combination of existing downstream residential and early successional forest. The development of Redondo Bay has an established 15-foot buffer from the stream channel. 5.0 Riparian Vegetation The riparian vegetation is a red alder(Alnus rubra) overstory with a dense shrub understory of Himalayan blackberry(Rubus discolor) and salmonberry(Rubus spectabilis). Black cottonwood (Populus trichocarpus), big leaf maple (Acer macrophyllum), vine maple (Acer circinatum), stinging nettle (Urtica dioca), and willow (Salix sp) are present along the stream channel. 1 • J. S.Jones and Associates, Inc. 6.0 Fish Habitat and Utilization Stream slopes and seasonal shallow intermittent flows are inadequate for fish passage and use. Downstream slopes exceed twenty percent, with numerous 0.5-foot to 1.5-foot drops. Late December flow depths were very shallow, averaging 0.15 feet deep. Existing downstream culverts and piped sections are obstructions to fish passage. 7.0 Stream Classification and Setbacks City of Federal Way Code, Section 22-1, divides streams into two definitions, Major and Minor. Major streams are defined as "any stream, and the tributaries to any stream, which contains or supports, or under normal circumstances contains or supports resident or migratory fish. Minor stream shall mean any stream that does not meet the definition of a major stream." The unnamed stream has no fish use, therefore it is a minor stream. This finding is consistent with the stream rating immediately downstream for the development known as Redondo Bay. City permit counter staff also stated that the stream has been previously rated a minor stream. Section 22-1306, of the Federal Way Code, requires a 50-foot setback from the ordinary high water mark of a minor stream. It is unclear as to why the development of Redondo Bay was granted a 15-foot buffer. Even though it was annexed from King County, King County has required a minimum 25-foot buffer since at least 1989. Only a variance could have allowed a smaller buffer and a variance was not necessary for reasonable use of the property. 8.0 References Federal Way City Code. 1999.
