The City of Federal Way has reviewed your waiver request dated November 17, 2017. After evaluating
the existing conditions along the referenced street, review of Federal Way Revised Code (FWRC)
provisions (Section 19.135.280; 19.135.040) and the direction provided by the City Council, the Public
Works Department hereby provides the following response to each of your requests:
Request to waive street improvements:
South 333d Street is identified as a Principal Collector, corresponding to City Standard Street
Section "M", which requires 36-foot paved section, curb & gutter both sides, two 6-foot planter
strips, and two 8-foot sidewalks within a 70-foot right-of-way.
Currently South 333d Street has 36-foot paved section, curb & gutter, no planter strips and
sidewalks that varies (5 to 6 foot wide) within a 60-foot right-of-way.
The Public Works Department hereby approves your request to waive frontage improvements
along South 333rd Street, with the following conditions:
2. Sign and record a Local Improvement District Waiver of Protest Covenant so that the
Applicant acknowledges and understands their responsibilities should the City modify
this roadway in the future.
Request to waive driveway separation requirements:
South 333d Street slopes from east to west with an elevation decrease of 10 to 12 feet. The
current site has two driveways to accommodate large track traffic and the elevational difference.
Most of the elevational difference occurs at or near the western driveway.
The Public Works Department hereby approves your request to waive driveway separation
r6qiiifeiftents along Sbuff03P Street due tq the site topography.
The conditions of this right-of-way modification will be applicable for a period of one year. If the
building permit is not issued within the one-year time period, this modification will be void, and a new
request for modification must be submitted.

Request The applicant proposes a tenant improvement within an existing structure.
Currently this building has two separate access driveways in excess of FWRC 19.135.280 (One
drive for every 330 feet of frontage). In addition the proposed improvements will exceed 25% of
the County's Assessed value of the existing structure which would require frontage
improvements in accordance with FWRC 19.135.040.

Staff Analysis South 333 rd Street is identified as a Principal Collector and is designed to be a
Type "M" street. The roadway section is a 70-foot right-of-way with 36-foot paved roadway,
curb & gutter, six-foot planter and 8-foot sidewalk. The roadway and site slope from east to west
with approximately 10 to 12-foot elevation decrease. Most of which occurs at or near the western
driveway
The existing South 333'd Street has a 60-foot right-of�way, 364bot paved roadway� curb &
gutter, no planter strip and sidewalk that varies (5 to 6 kd4ido. South 33� A Street layout
matches this description from the Community Center to I" Way South.
There is an existing rockery with vaults located at the east end of the parcel located right behind
the current sidewalk. Midway along the frontage is an existing fire hydrant located
approximately 2-feet behind existing sidewalk.
It appears that the existing water main is located beneath the sidewalk on the project side of the
roadway.
Requirements / Conditions of Approval After checking the requirements for frontage
improvements of other recent TI projects in the local area, Development Services staff make the
following recommendations for this project:
1. Approve the modification request of FWRC 19.135.280 to allow the site to keep both
existing driveways. Due to the topography it does not appear feasible for this TI to
remove one of the entrances and maintain large delivery truck accessibility.
2. Approve the waiver of frontage improvements with the following modifications:
a. Dedicate 5-feet of frontage as right-of-way
b. Sign a Local Improvement District Waiver of Protest Covenant; so that the
Applicant will acknowledge and understand their responsibilities should the City
modify this roadway section in the future.

Dear Mr. Saloum:
We are the architects for the proposed improvements to the existing building which was
permitted and constructed in 1989. The Access y0ane0emert(FVVRC 19.135)eantipn of
the Praapp|ioabon Summary Letter indicates that the mziaUnQ site is only allowed one
driveway per 380 ft. of lot frontage (19.135.280). This building and site cannot function
with one driveway so we are requesting an administrative modification to allow the two
driveways h»remain aeconstructed for the following reasons:
The building size and circulation around the building were designed as a one-way
circulation from the rear yard to the street via the 2Oft. wide fire lane along the east
side of the building. There is not enough aide yard to allow the east fire lane to be
two-way traffic. The east driveway serves as the exit from the fire lane and as
inQreem/agnamo to the existing front yard parking spaces and moceae to the building
entry. All truck traffic must enter the west driveway.
2. The existing west drive is much lower than the building entry or front yard parking'
so if it were the only driveway, the fire lane around the building would need to dead-
end in the front yard which would not be good. The grade change between the front
yard main entry' plaza and parking and the vVmet drive is too great for e drive
connection, and connecting the front yard circulation 0othe west drive would require
massive regrading of the site and make the access to the main entry and the
associated plaza impossible to be replicated. P|uo, we don't think it would be
possible to provide the required turning radius for large trucks to exit from the front
yard via a left turn on the west drive to the street.
3. Access to the east drive is currently right-in/right-out from the round -about just tothe
east ofthe project andpreaentanoeofeb/hazonJ.
4. Access to the west drive from 8.333rdioeasily made and accommodates the large
tractor trailer rigs that must enter there boaccess the rear loading docks. The turning
radii at the rear ofthe building accommodate both tractor -trailers and emergency
fire trucks.

In summary, the two driveways need to remain to allow large truck access and emergency
vehicle circulation around the building and out to 333rd St. via the east fire lane drive as
currently exists.
We have attached a site plan to show the current driveways and circulation on the site.

requirements and approve modification of the one driveway rule to allow the two existing
driveways to remain in this situation.

Dear Mr. Saloum:
The costs of our proposed improvements to the building at 840 S. 33rd St. will exceed 25%
of the County Assessed value of the existing structure on the site. As noted in the City's
Preapplication Summary Letter, Diagnostechs, file #17-103957-00-PC, this will trigger the
need for Street Frontage Improvements (FWRC 19.135). We would like to request a
waiver of these requirements based on the following reasons:
1. The street and frontage are in excellent condition and do not appear to need
reconstruction or even significant maintenance.
2. The street frontage is consistent with the design and condition of the rest of the
street in either direction, and other streets in the vicinity.
3. The construction of the frontage improvements will be disruptive to local traffic.
4. The construction of the frontage improvements will be inconsistent with the right-of-
way section on neighboring properties.
5. The construction of frontage improvements appears to be an expensive and
unnecessary improvement at this time.
