This letter is in response to your right-of-way modification request submitted on March 21, 2019. In a
previous right-of-way modification request, the street frontage requirements were reduced from a Type
'W' section to 20' wide asphalt roadway with curb, gutter, sidewalk, streetlights, and planter strip on one
side. In a second review, the improvements were ftirther reduced to eliminate the final approximately 80
feet of frontage due to topographic constraints. This current modification request is to waive all
improvements except the 20 foot wide asphalt roadway, based on Federal Way Revised Code section
19.135.070(l) "The improvement as required would not be harmonious with existing street
improvements, would not function properly or safely or would not be advantageous to the neighborhood
or city as a whole." A drawing showing an offset alignment of improvements was submitted in support of
the request.
1) While it is true that the improvements do not align perfectly, a slight curve has been incorporated
into several roads in the city to accommodate such alignment issues. This should not present a
hazardous situation.
2) Federal Way standards for new development require that private roads serve no more than four
homes, and are no longer than 150 feet. At approximately 470 feet long and currently serving
five single family homes, 6ffi Avenue SW exceeds standards for a private road. The proposed
short plat will add two homes to those already accessing this road, and there is potential for
fin-ther development. Due to projected traffic volunies, 6th Ave SW should be a public street
conforming to a Type 'W' standard with 28 feet of pavement, curb, gutter, sidewalk, planter strip,
and streetlights within a 52 right-of-way. The previous modifications allowed the developer to
build the minimum improvements necessary for safety along the property frontage, and will
require future development to complete the road improvements.
Improvements along the property frontage shall include the following, stopping approximately 80 feet
short of the northeast property comer where topography precludes construction of the road:

street.
• City standard curb and gutter on one side.
• 4-foot-wide planter strip with sod and street trees on one side.
• 5-foot-wide sidewalk on one side.
• Street lighting on one side.
• Set aside the improved area and the unimproved 80-foot future extension as a Tract X for future
dedication.
• Improvements shall be designed by a civil engineer licensed in the State of Washington and
completed prior to recording of the short plat.
This decision shall be applicable for a period of one year from the date of this letter. If a complete short
plat application has not been received within that time period, this right-of-way modification shall be

This is our second request for an exception to the regulation that we install a
roadway as defined in FWRC 19,135,210 and 19,135.220. at the property 35507
6t" ave sw Federal Way, Wash. This is a 600 foot long private road that terminates
at the Federal way retention pond. We have been given relief on the final 80 feet
of this property due to the fact of the conditions that exist and that the
development board has stated that this land will most likely never be developed.
This is a right of way that can never be extended. Our request is that the balance
of our frontage, approximately 220 feet, not be required to establish the 53 foot
easement with curb, gutter, sidewalk etc... We believe a full compliance should
not be requested due to waiver number one stating that it would not be function
property or safely and would not be advantageous to the neighborhood. Mrs.
Susan Honda has visited our property and has passed on to your department her
belief and recommendation that a waiver be issued. We submit that the current
30 foot easement is sufficient to allow for safe and proper development of this
small property. Currently there is a 20 foot wide foot road half way down the
street to our property line and then narrows to 10 foot paved. We would ask that
we be allowed to expand that road to match the other 20 foot already existing.
This road would be constructed to code. There is already a light on the electric
pole in front of our property. The single property that adjoins us could be divided
in the future to get an additional lot but it would be fronted on 6t" pl sw where no
large improvements would need to be made. It would never be developed on our
private road 6t" ave sw, as the cost would be prohibitive to get one lot. We ask
that you grant us this wavier based on the fact that we would be creating a
permanent unsafe dangerous situation where the new drive would terminate in a
dead end situation . I have included two drawings to show the safe proposal we
are asking you to grant and the unsafe current code situation that would be
created if current code is required.

The applicant requests waiver of curb, gutter, planter strip, streetlights, and sidewalk for
the entire frontage on a 3-lots ort plat located on 6 th Ave SW.
6th Avenue SW is approximately 470 feet long with a paved width of 10-20 feet. There are
currently five single family homes with access off of this road. Zoning is RS-9.6, which
potentially will allow development of additional lots for a total of eight to thirteen homes with
frontage on this road. Due to projected traffic volumes, this should be a public street
conforming to a Type W standard with 28 feet of pavement, vertical curb, gutter, 4' wide plant
strip, and 5' wide sidewalk within a 52' right-of-way. I
The applicant submitted a request on May 19, 2016 to waive the required improvements along
his property frontage. The waiver was �denied, but a modification was granted such that as a
condition of the proposed short plat, the, applicant was required to build a minimum 20' wide
paved road with full improvern . ent� on one side along his property frontage. An approved turn-
around was also required at the north end of the improvements. The area was required to be set
aside for future dedication.
The applicant later requested and Was granted an additional modification to waive all
improvements within the northeast 80 feet of the site, where Federal Way Revised Code section
19.135.070(2) was found to apply: "Unusual topographic or physical conditions preclude the
construction of the improvements as required". It was determined that the road would not be
extended in the future.

At your request, staff recently visited the site at the above address with you and, as a result, revised the
decision letter sent on June 15, 2016. If the property is short platted, 6h Avenue SW must be improved
for the length of the property frontage, with the exception of the northeast approximately 80 feet, where
steep slopes preclude construction of the road. This is sq� by Federal Way Revised Code (FWRC)
Section 19.135.070(2) which allows modificatiou 1*0 upon "Unusual tqpographic or physical
conditions preclude the construction of the improvements as required."
As outlined in the previous modification letter, the following improvements are required south of thc;
