Economic Development
This letter addresses your right-of-way modification request dated June 4, 2018 to revise the
requirements for Weyerhaeuser Way South frontage improvements.
Background
The Federal Way Comprehensive Plan designates Weyerhaeuser Way South as a Minor Arterial,
consisting of a 66-foot street with curb and gutter, 6-foot planter strips with street trees, 8-foot
sidewalks, and street lights within a 100-foot right-of-way. Existing conditions vary along this
approximately 1,335' long right-of-way. Existing right-of-way is as low as 66' wide to well over
100'. The existing pavement varies from about 55' wide to 84' wide, with curb and gutter on
both sides. The west side of the road has 5' wide sidewalk only between the Loop Road and the
roundabout, with no planter strip or streetlights. The east side of the road has 5' wide sidewalk
and streetlights for almost the entire length of the frontage, and four foot wide planter strip only
between the roundabout and the SR-18 right-of-way.
A Right -of -Way Modification decision was issued on September 30, 2016 associated with a
314,424 square foot warehouse application on the single parcel located on the west side of
Weyerhaeuser Way S. Frontage improvements for the full width of Weyerhaeuser Way S were
required for the length of the lot. This decision was based on the Weyerhaeuser Company
Concomitant Pre -Annexation Zoning Agreement (CZA) and the 1994 city code in place at the
time the CZA was created.
The warehouse application has since been revised to a "general commodity warehouse"
(Warehouse A) with a gross floor area of 225,950 square feet. In addition, a boundary line
adjustment was recorded on November 3, 2017 that divided the single parcel into two. A second
"general commodities warehouse" (Warehouse B), with a size of 217,300 square feet, has been
proposed for the second lot.

Staff has reviewed the applicable zoning and development standards and the CZA for this site.
Full width frontage improvements and right-of-way dedication for the entire width of
Weyerhaeuser Way S are required for any amount of building square footage exceeding 300,000
square feet. Since the proposed building is less than 300,000 square feet, the CZA states that
only life -safety improvements are required for Warehouse A. Warehouse B would exceed that
threshold, triggering full width frontage improvements.
Modification Requests
The applicant has requested the following modifications:
Modification 1. Planter between sidewalk and face of curb to be planted with grass instead
of street trees until required by future development.
With the Warehouse A development, the applicant has proposed to build 8' wide sidewalk in its
ultimate location along the west side of Weyerhaeuser Way S only. This improvement will run
the length of the frontage on both Warehouses A and B, as shown on the Greenline Warehouse A
Site Plan dated 03/12/2018 (Exhibit A). Full -width right-of-way dedication has also been
proposed for both Warehouse A and B frontages as part of Warehouse A development.
Other frontage improvements proposed to be completed with Warehouse A include: planter strip
(grass only, no trees), relocating bus stops, adding bus shelters, providing a left turn lane for
truck entrance, left -in, right -out driveway, pedestrian crosswalk, and a path through the managed
forest buffer. All proposed improvements are considered either life -safety requirements or
within the scope of the TIA that has been submitted for this development.
This modification is approved, with the following conditions:
1. Street lighting is considered a life -safety issue, and must be constructed on the west side
of Weyerhaeuser Way S. with Warehouse A, concurrent with sidewalk installation.
2. Current ADA standards must be met.
3. Sidewalk and planter strip on the east side of Weyerhaeuser Way S, street trees on both
sides of the roadway, and road widening, may be deferred to a later date that shall be
mutually agreed upon. Improvements must include sidewalk and planter strip built to
current standards on the east side of Weyerhaeuser Way S., from the WSDOT right-of-
way to the Loop Road. Existing street lighting may need to be relocated or replaced.
4. The right-of-way dedication shall insure that right-of-way width is no less than 100' for
the entire frontage of both Warehouse A and Warehouse B.
5. The applicant shall provide a bond for the remainder of the full -width improvements. A
date shall be mutually agreed upon by which time the improvement must be completed.
The applicant shall submit an engineer's estimate for 120% of the cost of improvements,
using prices reasonably expected based upon the agreed required completion date.

Modification 2. Aside from the provided street improvements listed above, leave existing
pavement and channelization intact to maximum extend feasible until required by future
development.
This modification request is denied. Pavement reconstruction and channelization are a condition
of SEPA and will be determined separately from the concomitant agreement and this right-of-
way modification, as applicable to this development.
The right-of-way modification decision issued on September 30, 2016 is no longer applicable.
The conditions of the new modification decision are valid for one year from the date of this
letter. Should this project change significantly from the current site plan, or land use approval is
not obtained within one year, this right-of-way modification shall become void and a new

Request Federal Way Campus LLC is requesting to divide the full frontage
improvements required by the 9/30/16 Right -of -Way Modification decision into two phases,
some with Warehouse A and some with Warehouse B.
Staff Analysis Weyerhaeuser Way S is classified as a Type G Minor Arterial by the
Comprehensive Plan. A spreadsheet is attached showing the existing and required
improvements, as well as the approach proposed by this request.
The proposed phasing does not follow current property lines. As proposed, most of the
improvements would occur with Warehouse B, including some improvements that are fronting
on, and across the street from, Warehouse A.
The new modification request itemizes seven improvements that will be completed with
Warehouse A. Item 1, right-of-way dedication, covers the full improvement requirement on both
sides of the street and along the entire frontage of both Warehouses A and B. Items 2 through 7
fall within Section 14.2 of the Concomitant Agreement which states that "life safety issues" will
be paid for by Weyerhaeuser at time of development, including driveway and intersection
improvements, left turn lanes into new development, pedestrian corridors along public road, and
paving of shoulders for bicycle lanes. These improvements occur along the full frontage of both
Warehouses A and B, but they are not proposed on the east side of Weyerhaeuser Way S as
required in the previously approved right-of-way modification.
The plan shows improvements on the east side of Weyerhaeuser Way S ending short of the Loop
Road, and extending to the south end of the roundabout. Taking into consideration the existing
public right-of-way width and private ownership in the area, it appears these improvements could
be extended as far north as the Loop Road and as far south as SR 167. South of the roundabout,
the adjacent property is not owned by Federal Way Campus LLC, but there appears to be
adequate right-of-way width to construct the improvements.
The proposal does not anticipate full pavement reconstruction, which has been discussed with the
applicant but was not included in the 9/30/16 right-of-way modification. It will be included in
the land use conditions of approval. Staff believes this should be included in this right-of-way
modification.

On August 12, 2016 ESM Consulting Engineers, LLC made a Right -of -Way Modification
Request on behalf of Chill Build Seattle, LLC who was the applicant for the Preferred Freezer
project. At that time, Chill Build Seattle was seeking to develop a Cold Storage Warehouse
with a gross floor area of approximately 314,424 square feet. This amount of building
exceeded the 300,000 square foot frontage improvement exemption established by the
Weyerhaeuser Company Concomitant Pre -Annexation Zoning Agreement (CZA), section
14.2. As a result, Chill Build Seattle was required to make full frontage improvements along
Weyerhaeuser Way South.
On December 13, 2016 Chill Build Seattle, LLC withdrew from pursuing development of the
Preferred Freezer Cold Storage Warehouse and transferred their application to Federal Way
Campus, LLC. Since then, Federal Way Campus has modified their application to develop
Greenline Building A, a general commodity warehouse with a gross floor area of
approximately 225,950 square feet. Revisions to their site plan include the following street
frontage improvements:
1.
Dedication of additional right-of-way;
2.
Remove existing concrete walkway and install 8-foot wide ADA compliant
sidewalk along frontage of Weyerhaeuser Way South leaving room for 6-
foot wide planter (South of Loop Road Intersection to SR-18 westbound on -
ramp signal);
3.
Relocate bus stops and add shelters as noted on site plan;
4.
Provide deep storage, left turn lane and channelization to Weyerhaeuser
Way South for truck entrance;
5.
Provide precast dual faced mountable curb to control truck exits to right
turn out only;
6.
Relocate pedestrian crossing location with pedestrian refuge; and
7.
Provide pedestrian path through the managed forest buffer to provide
access from Building A to new sidewalk.

Modification #1
Federal Way Campus, LLC is providing the required 3-foot utility strip and 8' of ADA compliant
sidewalk from the south entrance to Loop Road, along Weyerhaeuser Way South
terminating at the SR-18 westbound on -ramp signal. As a result, the existing curb shall
remain intact. Modification #1 is requesting the remaining strip of land between the new
sidewalk and existing curb (6-foot planter strip) is planted with grass until future development
requires full street improvements and street trees. This request is supported by the
Weyerhaeuser Company Concomitant Pre -Annexation Zoning Agreement (CZA), section
14.2.
Modification #2
The second modification request is to waive additional right-of-way improvements until the
approval of future development (Greenline Building B) which exceeds the 300,000 square
foot development threshold as stated in the Weyerhaeuser Company Concomitant Pre -
Annexation Zoning Agreement (CZA), section 14.2.
These additional full width right-of-way improvements include 66-foot street with curb and
gutter, 6-foot planter strips with street trees, 8-foot sidewalks, and street lights within a 100-
foot right-of-way.
In other terms, Federal Way Campus, LLC is requesting that future development (Greenline
Building B) bears the responsibility of full width right-of-way improvements along
Weyerhaeuser Way South.

The plans and documents submitted on March 13, 2018 have been reviewed. When preparing conditions
of approval, please include the following conditions:
1. The current approved Right -of -Way Modification includes widening of Weyerhaeuser Way S. As a
part of building permit approval, water quality treatment shall be provided for all new pollution -
generating surfaces within the public right-of-way. Detention shall also be provided as required in
the 2016 King County Surface Water Design Manual (KCSWDM).
2. The applicant has discussed but not committed to any particular Best Management Practices
(BMP's) required by the KCSWDM. The applicant shall incorporate BMP's into the building permit
plan set as outlined in the KCSWDM.
3. The applicant states that this project drains to an offsite wetland (closed depression), Parcel
#2121049014, therefore KCSWDM Chapter 3.3.5 through 3.3.7 applies. If the amount of
impervious surface area proposed by the project is greater than or equal to 10% of the 100-year
water surface area of the closed depression, then a point of compliance analysis must be done to
verify that the water surface levels are not increasing for the return frequencies at which flooding
occurs, up to and including the 100-year frequency. The applicant has not provided a
comparison of the proposed impervious surface area to the surface area of the closed
depression, nor have they provided a minor floodplain analysis to establish an assumed base
flood elevation for the closed depression. Conservation Flow Control (Level 2) must therefore be
considered a minimum standard, and the applicant will be required to provide additional flow
control if the site's impervious area meets or exceeds the 10% threshold, or a flooding problem
will be created or exacerbated. The applicant shall provide necessary documentation and
mitigation prior to building permit issuance.
,k Prior to building permit approval, WSDOT approval of the project's impacts on storm drainage
conveyance within WSDOT right-of-way shall be provided.

At our meeting today, we discussed how the S 324th Street extension project and the connection
to 32nd Ave S and S 323rd Street could be modified to accommodate DaVita's proposed
development consistent with their goal of having no streets between their existing and proposed
buildings.
As discussed, it appears to be in our mutual interest to have DaVita expand within the City. At
the same time, it is also important for the City to maintain adequate transportation mobility,
inclusive of vehicle, bicycle and pedestrian, to support existing and planned development
consistent with our Comprehensive Plan.
As such, although it reduces connectivity between 32nd Avenue and the S 324th Street extension,
the City is supportive of the proposal to extend S 324th Street eastward directly to Weyerhaeuser
Way S instead of terminating the extension at the intersection of S 323rd Street and 32nd
Avenue S in order to meet DaVita's site plan goal, provided the parcel owner to the South that
the revised alignment would impact is also supportive of this concept. We believe that this
modification is functionally consistent with the alignment's current design.
This does complicate the City's ability to maintain connectivity between existing and planned
segments of the BPA Trail across I-5, and we therefore will need to jointly pursue alternatives to
provide non -motorized connectivity between the I-5 / S 324`h Street interchange and the BPA
corridor east of I-5. This may involve a trail connection through the DaVita property between
S 324th Street and 32nd Avenue S.

Federal Way Campus, LLC is amending this Process III land use application to develop a general commodity
warehouse on 15.16-acres of CP-01 zoned land. The proposed warehouse will be approximately 225,950
square feet and include accessory parking for up to 255 vehicles. A stormwater quality control and detention
pond are located off -site to the south on an adjoining parcel as described in #12 of this checklist. Limited
commercial vehicle ingress and egress access will be from Weyerhaeuser Way S near the interchange ramps
for Highway 18. A 50-foot wide managed forest buffer will run along the property boundary adjacent to
Weyerhaeuser Way S and a 100-foot along SR Hwy 18.

There are no fish -bearing or perennial streams on or near the site. A man-made ephemeral ditch,
unnamed, connects Wetland EE to Wetland DR. An ephemeral stream (Stream EA) occurs in the
southeast portion of the project area. See attached Wetland report for more details.13 on -site
wetlands occur within the project limits. Onsite Wetlands: DP (PFO), DQ (PSS), DR (PSS), DT (PSS),
DU (PSS), DW (PFO), DX (PFO), DZ (PFO), EB (PFO/PSS), EC (PFO), ED (PFO), EE (PSS), and EF (PFO). All
wetlands ultimately discharge to Hylebos Creek to the south.

Yes, work adjacent to the man-made ditch is proposed- 9,949 square feet of proposed direct impacts
(fill) to wetlands DU, DW, DX, DZ, EB, ED, and EE. Indirect impacts will affect Wetlands DO, EC, and
EF. Wetlands DP, DR, and DT will not be impacted. Stream EA will not be impacted. See attached
work plans and report for more details.
3) Estimate the amount of fill and dredge material that would be placed in or removed from surface water or
wetlands and indicate the area of the site that would be affected. Indicate the source of fill material. VIL1W
Total wetland fill to equal ±435 cubic yards.
Fill materials will be sourced from the project site.
The filling of these wetlands will have no long-term impacts on the surrounding hydrology. The
runoff from the Site in the post -development condition will be detained within the proposed
Stormwater pond to the south before being discharged under Highway 18. This path of water
movement will be the same in the post -development condition as from the pre -development
condition.
Wetland EE does currently drain to Wetland DR through a culvert and associated ditch that was
artificially constructed many years ago. That artificial connection between Wetlands EE and DR will
be removed in the post -development condition as previous City concerns regarding the Site's
stormwater discharges disallowed any site runoff to be conveyed to these remaining wetlands.

The Weyerhaeuser Headquarters building was constructed in 1969 which makes it 49 years old.
Pursuant to CFR 36, Chapter I, subsection 60.4 criteria for evaluation, the Weyerhaeuser Headquarters
building may be eligible. However, the Weyerhaeuser Headquarters is not currently listed in national,
state, or local preservation registers.
b. Are there any landmarks, features, or other evidence of Indian or historic use or occupation? This may include
human burials or old cemeteries. Are there any material evidence, artifacts, or areas of cultural importance on or
near the site? Please list any professional studies conducted at the site to identify such resources. VILIpI
No known landmarks or evidence have been observed on or near the site. The northern portion of the
site was previously developed as single-family homes in the 1950's.

The methods used to assess the potential impacts included GIS data analysis and WISAARD GIS data
review. Please review the preliminary determination letter from Tetra Tech, who "completed a review
of the Washington Department of Archeology and Historic Preservation website WISAARD for known
archeological sites, National Register of Historic Places properties and completed cultural resource
surveys located % mile of the project area. Tetra Tech also researched BLM GLO Cadastral Surveys to
determine if any known archeological resources may be found in or near the project area. Additionally,
Tetra Tech completed 6 shovel test probes within the proposed project areas to determine subsurface
conditions and possibly the presence of subsurface archeological materials. No archeological features or
artifacts were identified in the 6 shovel test probes." - Stipe, F (2016, November 28). Letter to Talasaea.
Tetra Tech conducted 4 additional shovel test pits as part of the revised application and their report is
included.

access is provided at the southeast corner of the site closest to the Highway 18 interchange.

Weyerhaeuser Way S.

generate 994 total daily trips (795 for passenger vehicles and 199 for trucks). The AM peak hour trips
are 129 (103 passenger, 26 trucks) and the PM peak hour trips is 100 (80 passenger, 20 trucks).

Because these questions are very general, it may be helpful to read them in conjunction with the list of the elements of
the environment.
When answering these questions, be aware of the extent the proposal, or the types of activities likely to result from the
proposal, would affect the iteiii at a greater intensity or at a faster rate than if the proposal were not implemented.
