The committee includes representatives from the Lakehaven Utility and King County Fire Districts and staff from the city's Land Use and Building Divisions and Public Works Department. The following is a summary of land use comments. Where appropriate, pertinent ordinance sections are noted. The items listed below do not include all regulations applicable to the subject proposal. In preparing your application, all pertinent portions of the city's land use code should be consulted. • LAND USE - Deb Barker, 661-4103 1. Zoning- According to the Federal Way Zoning Map, the site is zoned CC City Center. The Comprehensive Plan designates the site as B-Business. Retail uses providing entertainment, recreational, or cultural services or activities are permitted under the provisions of Federal Way City Code (FWCC) 22-795. 2. Review Process - Your proposal to re-open the health club is subject to tenant improvement review, as defined in FWCC section 22-1, Definitions. Tenant improvements require review by the city's planning, building, and public works divisions, in addition to the fire district. 3. SEPA Review - State Environmental Policy Act (SEPA) review will be required if more than 21 parking spaces are created, or if intrusions into sensitive areas are proposed. Mr. Jim Purdy May 11, 1995 Page 2 4. Required Yards - The required front yard structural setback for this use is 20 feet. 5. Required Parking - As minimum parking standards are not specified for entertainment, recreational, or cultural services or activities uses in the FWCC 22-795 land use chart, the applicant will be required to submit, with the tenant improvement application, a statement of parking needs for the facility and depict how these needs are being met. Please contact Saeid Daniari, Traffic Engineer, at 661-4133 for information on parking generation. Typical parking stall dimensions are 8'x15' for compact and 8.5'x18' for standard parking stalls. Up to 25 percent of the number of parking spaces may be designated for compact cars. The site contains 70 striped parking stalls, two of which are accessible for disabled persons. 6. Signage - FWCC Section 22-795 requires sign category E. This category allows wall mounted, marquee pedestal, and monument signs. The site contains a wall mounted sign and a nonconforming pole sign. A separate sign permit application is required. New sign code standards are expected to be adopted by the City Council within the next two months. Please contact Richard Cottage, Code Compliance Officer, at 661-4017 with specific sign questions. 7. Garbage and Recycling Facilities - Facilities for garbage and recycling are required if there are structural alterations or an increase in gross floor area to the site. FWCC section 22-949 contains the requirement for receptacles, placement, and screening. 8. Sensitive Areas - If the subject property contains any sensitive area, the application is subject to review under FWCC Article XIV. Sensitive areas include, but are not limited to, regulated slopes, well heads, minor and major streams, regulated lakes, and wetlands. The applicant should be aware that properties to the west of this parcel contain wetlands. 9. Nonconformance-When the value of any proposed improvements exceed 50 percent of the assessed or appraised value of the existing improvements, the following must be brought up to code: a. Required Yards - Required yard setback for this use is 20 feet for the front. There is no structural setback requirement for the side and rear yards. No improvements may be placed in a required yard without variance approval. b. Facade Modulation - Any facades of a structure that exceeds 50 feet in length must be modulated with the minimum modulation depth of three feet, minimum width of four feet, and maximum width of 35 feet, pursuant to FWCC section 22-795, note 2. Mr. Jim Purdy May 11, 1995 Page 3 c. Perimeter Landscaping - Section 22-1566(b)(1), type III landscaping five feet in width shall be provided along all perimeter property lines. Type III landscaping provides a partial visual separation of uses with trees, large shrubs, and groundcover. d. Parking Lot Landscaping - Section 22-1567(b)(1)a.ii, 22 square feet of type IV interior parking lot landscaping per parking stall is required. This would be placed at the end of all rows of parking and dispersed throughout the interior parking area in a manner to reduce the visual impact of the parking lot. e. Additional Landscape Requirements - These include such items as: 1) enclosing and screening all trash receptacles, Section 22-1564(d); 2) preservation of significant trees, Section 22-1568; 3) permanently irrigating all lawn/sod areas, Section 22-1564(t); and 4) 25 percent of new landscape materials (i.e. trees, shrubs, and groundcover) shall be drought tolerant, Section 22-1564(f). Please see the entire landscape chapter for. additional landscape requirements. f. Sidewalks - Per FWCC section 22-1445, sidewalks along the perimeter of the building should be a minimum of five feet in width, and pedestrian access that connects these sidewalks to the street should be provided. g. Review Process - A site plan review process is necessary to review the above referenced elements, should the provisions of FWCC section 22-337, (Any other Nonconformance), apply. 10. King County Permits - A document provided to staff depicted a 1978 site plan apparently approved by King County. A site visit revealed that the site has not been developed in accordance with these approved plans. Parking stalls and parking lot landscaping have been omitted and walkways along the perimeter of the building have not been provided. Under the tenant improvement application, the site should be brought to conformance with the plans approved by King County. Any additional improvements to the site are regulated under current code standards of the City of Federal Way and may be subject to site plan review. Vv PUBLIC WORKS MEMORANDUM TO: Deb Barker FROM: Julie Venn For Your Information DATE: May 3, 1995 SUBJECT: Gold's Gym Tenant improvements - File No.: PRE 95-0033 After reviewing the materials submitted and a visit of the proposed site the following comments and findings address issues that need to be resolved prior to developing the site. 1. Since the storm drainage system serving the site does not conform to current treatment standards for water quality control (FWCC Sec. 22-330 and 22-1196), the system will need to be retrofitted. Runoff from the entire site is to be treated thorough the use of facilities designed and constructed in accordance with the requirements of the King County Surface Water Management(KCSWM). The existing storm drainage system will need to be cleaned and inspected to ensure the system is in working order. 2. Roof runoff shall be tightlined into the existing on-site stormwater system. 3. The access to public right-of-way is unclear at this time. Vehicular access easements must be provided and recorded per section 22-1500 of the FWCC. 4. A cost estimate for the tenant improvements should be provided by the applicant along with an appraisal of the existing building. In the event that the expansion is greater than 25 percent of the value of the existing improvements, off-site street or access easement improvements may be required. (The extent of such improvements will be determined once issues in Item 3 above are resolved. 5. Per section 22-1477 of the FWCC, the applicant may make a written request to the Public Works Director for a modification, deferment or waiver from the above requirements. A handout on these procedures is attached. 6. The site plan submitted should show the location of any existing and proposed utilities in the areas affected by construction. 7. At the time of the site plan review submittal a narrative addressing the relevance to the PP\.doc project of the 7 I and 12 Special Requirements of th -SWDM will be required. A level I downstream analysis shall also be provided. The City has available 1" = 100', 5-foot contour, planimetric maps that must be used for basin analysis. The building is in need of a lot of repair from deferred maintenance,which under normal circumstances would be ongoing. Aquatic Ventures,Inc. intends to do these necessary repairs: 1. repair leaking roof 2. repaint building exterior 3. refurbish the H.V.A.C. 4. clean the building interior 5. maintain,trim&clean existing landscaping and replace as needed 6. complete existing parking lot repairs as needed In addition to the ongoing maintenance required,it is.the intent of Aquatic Ventures,Inc.to improve the parking lot and the ingress&egress as needed and improve the property as required by the City of Federal Way to receive an occupancy permit for the"like use"as it was most recently used for,without significant changes to the building or premises. It is my understanding and a logical supposition that buildings in foreclosure are exempt from the time delay for use code. I do not have the statute,but I am looking into it through legal council.
