Citation of Code Provision
An interpretation of Exhibit "C" of the Weyerhaeuser Company Concomitant Pre -Annexation Zoning
Agreement to clarify whether a "church community center" is a permitted use in the Corporate Park (CP-1)
zone. Section VI[(A)(14) in Exhibit "C" of the CZA states that permitted uses can include, "any other use
determined by the Director to be compatible with the above permitted uses."
Summary Statement of Interpretation
A "church community center" is permitted in the Corporate Park (CP-1) zone under Section VII(A)(14) in
Exhibit "C" of the Weyerhaeuser Company Concomitant Pre -Annexation Zoning Agreement.

of the interpretation. The notice of appeal must be accompanied by cash or a check, payable to the City of

in FWRC 19.50.060 and Chapter 19.70 FWRC.

I am concerned about the City of Federal Way allowing any new compatible permitted uses to Exhibit "C" of
the Weyerhaeuser Concomitant Pre -Annexation Zoning Agreement that would be exempt from paying property
taxes resulting in lost revenue to City of Federal Way while the city still is required to provide support and
services this will put additional burden on the city budget and resources, residents and businesses of Federal
Way.
I have questions regarding the interpretation of compatible permitted uses in Exhibit "C" of the Weyerhaeuser
Concomitant Pre -Annexation Zoning Agreement and would appreciate you providing the answers to the
following.
1. Who requested this interpretation of Exhibit "C" to include "church community center" as a compatible
permitted use?
2. Has this interpretation already been coordinated with and/or agreed to by IRG? If so, who was the

I am responding to this notice as a private citizen. I am asking that you waive any appropriate fees that pertain
to my response to the above action.
Since the adoption of the concomitant agreement in 1994, the citizens of Federal Way have not had the
opportunity to review the vision, zoning and development guidelines within the Federal Way Comprehensive
plan or the concomitant agreement.
The Growth Management Act's intention is to involve the public on a regular basis for the zoning and planning
for a city, county and region.
Federal Way's most recent updated comprehensive plan was adopted in 2015. There were not any community
meetings. The former Weyerhaeuser 400 acres were not part of the comprehensive plan process. There was a
window of opportunity to do so when Weyerhaeuser announced they were moving and selling their property in
2014 and when a seller was identified in2016. The City of Federal Way made the determination that the former
Weyerhaeuser 400 acres would not be part of that comprehensive plan update.
The City of Federal Way has taken the position that the present concomitant agreement, which does not have
an expiration date, will remain in place and in perpetuity. I find that this decision is not consistent with State law
and also the Growth Management Act's goals.
I am requesting that you place this interpretation decision on hold as well as any other land use decisions and
permitting until the following have been accomplished:
Update the Federal Way Comprehensive Plan that includes the former Weyerhaeuser 400 acres with a
complete public process as required by the State Growth Management Act.
2. Established a consistent process for adopting and updating concomitant agreements throughout the
city.
3. Adopt a new concomitant agreement for the former Weyerhaeuser 400 acres that reflects the updated
comprehensive plan.
4. Develop and adopt any zoning code changes to reflect the new changes.
Two recent decisions by the City of Federal Way indicate that 20 years is an adequate time to allow for updates
to a concomitant agreement and also vesting rights to zoning. I am referring to the Wild Waves concomitant
agreement and the Gethsemane Cemetery hearing examiner decision.
I believe that when the present concomitant agreement was adopted, it was not the intention by either parties
to have this agreement in place forever.
Perhaps Weyerhaeuser envisioned that their corporate headquarters would be in Federal Way forever.
Many substantial changes have occurred since the adoption of the concomitant agreement. Weyerhaeuser
moved their corporate headquarters to Seattle and they sold their properties in Federal Way. The City and
Weyerhaeuser should have addressed the decision to update the concomitant agreement at that time.

Diljit Sethi and Jasmit Singh requested an interpretation on behalf of the Khalsa Gurmat Center ("Center") to
clarify whether a "church community center" is a permitted use in the Corporate Park zone ('CP-1 zone").' The
CP-1 zoning regulations are contained within Exhibit "C" of the Weyerhaeuser Company Concomitant Pre -
Annexation Zoning Agreement ("CZA") (attached). Section 19.50.010 of the Federal Way Revised Code
("FWRC") authorizes the Director of Community Development to interpret the provisions of a concomitant
agreement. While church and community center uses are not specifically identified within the CP-1 zone, the
uses are compatible with other permitted uses listed in Exhibit "C" of the CZA. Daycare is a listed permitted
use in the CP-1 zone.
The November 2017 preapplication submittal for the Khalsa Gurmat Center indicates the following uses are
proposed: community center, classrooms, enrichment classes, workshops/courses, library, computer lab,
meeting rooms, office spaces, daycare, after school care, prayer hall/multi-purpose hall, commercial kitchen,
gymnasium, outdoor play area, legal clinic, medical screening, parking and other events/related uses.
The December 2017 zoning interpretation submittal indicates the following:
Introduction and Usage:
KGC (Khalsa Gurmat Center) is a non-profit organization recognized under 501(c)(3) by the IRS. KGC
wishes to establish a Community Center which would provide facilities to people of all ages and
communities.
The probable amenities could include — Day care center, after school care, enrichment classes for kids/
youth/ parents/ elders (Language Arts, computer coding, advanced maths, robotics, music, meditation/
yoga etc). The Center is also expected to hold workshops and courses social issues — Civil Rights, Gender
Equality, Anti -Bullying to name a few. Legal Clinic, Medical screening and other events with experts of
the field are expected to happen regularly.
1. Subject
Pursuant to Exhibit "C" of the CZA, is a "church community center" a permitted use within the CP-1 zone?
2. Interpretation
A "church community center" is permitted in the CP-1 zone under Section VII(A)(14) in Exhibit "C" of the
CZA, which states, "any other use determined by the Director to be compatible with the above permitted
uses." The list of permitted uses in the CP-1 zone varies based on whether they occur outside or within the
Managed Forest Buffer. Section VII(A) and (B), "Permitted Uses on Those Portions of the CP-1 Zoned

community center" is a permitted use in the CP-I zone.

Property Lying Outside the Managed Forest Buffer" of CZA Exhibit "C" lists corporate offices, daycare,
and conference center as principal uses permitted outright subject to land use approval. Item #14 in this
same section also permits any other use determined by the Director to be compatible with the other
permitted uses. Accessory uses listed include restaurants supportive of employees or patrons or other
permitted uses; parking facilities (open or enclosed when accessory to permitted uses); and any other use
determined by the Director to be compatible with the other permitted accessory uses.
While church and community center uses are not specifically identified within the CP-1 zone, they are
compatible with other permitted uses listed in Exhibit "C" of the CZA, including corporate office, daycare,
and conference center.
3. Criteria
Pursuant to FWRC 19.50.040(2), and as described in further detail in the other sections of this report, this
interpretation is based on:
(a) The defined or common meaning, as applicable, of the words in the provision.
Section VII(A)(14) in Exhibit "C" of the CZA states, "any other use determined by the Director to be
compatible with the above permitted uses" is permitted. Merriam-Webster's definition of "compatible"
is, "capable of existing together in harmony."
(b) The general purpose of the provision as expressed in the provision.
The purpose of Section VII(A)(14) in Exhibit "C" of the CZA is to provide the ability for uses that are
not listed, but are determined by the Director to be compatible, to be allowed.
(c) The logical or likely meaning of the provision viewed in relation to the comprehensive plan, the FWRC
as a whole, or other plans or studies prepared or adopted by the City.
The Federal Way Comprehensive Plan states, "In 2014, the Weyerhaeuser Company announced that
they plan to relocate their headquarters to Seattle in 2016. The City recognizes the opportunity
presented by this large, well situated campus -like property. The City will work with the seller, future
owner(s), and the surrounding community to realize the property's potential, while maintaining
compatibility with surrounding uses." Regarding the corporate park designation, the plan also notes,
"This zoning presents unique opportunities for development." Section VII(A)(14) in Exhibit "C" of the
CZA provides the ability for other compatible uses to be permitted, enabling unique opportunities for
development to be realized.
4. Analysis
The November 2017 preapplication submittal for the Khalsa Gurmat Center indicates the following uses
and spaces are proposed: community center, classrooms, enrichment classes, workshops/courses, library,
computer lab, meeting rooms, office spaces, daycare, after school care, prayer hall/multi-purpose hall,
commercial kitchen, gymnasium, outdoor play area, legal clinic, medical screening, parking, and other
events/related uses.
While some of these elements may not be typical in every corporate office or conference center, they
do sometimes include such amenities or similar. Daycare is a listed permitted use in the CP-1 zone. It
is of note that the center is not an accredited school and does not include a residential component. -

5. Conclusions
For the reasons stated above, a "church community center" is an allowed use in the CP-I zone. This
interpretation is viewed narrowly as applicable to the proposed "church community center" on the site at
2835 South 344`" Street, not the entire CP-1 zoned property. The subject site is in a unigLIO location and
contains an existing commercial building.
This zoning interpretation only addresses the use and does not approve any Change of Use, Change of
occupancy, site development, construction, license, or permit. It does not approve the contents of the
preapplication submittal, or infer that any future land use applications, building improvements, or site
modifications are capable of being approved. This interpretation does not guarantee any future code
application of Section VII(A)(14) of Exhibit "C" of the CZA.
Public notice of this interpretation shall be provided according to FWRC 19,50.050. Pursuant to FWRC
19.50.060, this interpretation may be appealed to the City Hearing Examiner using Process 1V review,
Chapter 19.70 FWRC, within 14 calendar days of the date of issuance listed below.

KGC (Khalsa Gurmat Center) is a non-profit organization recognized under 501(c)(3) by the IRS. KGC
wishes to establish a Community Center which would provide facilities to people of all ages and
communities.
The probable amenities could include — Day care center, after school care, enrichment classes for kids/
youth/ parents/ elders (Language Arts, computer coding, advanced maths, robotics, music, meditation/
