We hope that the information discussed at that meeting was helpful in understanding the general requirements for your project as submitted. This letter summarizes comments given to you at the meeting by the members of the DRC. The members who reviewed your project and provided comments include staff from the City's Planning and Building Divisions and Public Works Department, and representatives from Lakehaven Utility District and South King Fire and Rescue. Some sections of the Federal Way City Code (FWCC) and relevant information handouts are enclosed with this letter. Please be advised, this letter does not represent all applicable codes. In preparing your formal application, please refer to the complete FWCC and other relevant codes for all additional requirements that may apply to your project. For specific technical questions about your project, please contact the appropriate DRC representative as listed below. Otherwise, any general questions about the preapplication and permitting process can be referred to your key contact. PROJECT DESCRIPTION Applicant has proposed a land division of one existing commercial property into two commercial properties. The newly created lot will serve an existing Personal Wireless Service Facility (PWSF) lattice tower. The PWSF will be the proposed lot's primary land use. MAJOR ISSUES Outlined below is a summary of the major issues of your project based on the plans and information submitted for preapplication review. These issues can change due to modifications and revisions in the plans. These major issues only represent comments that the DRC consider most significant to your project and do not include the majority of the comments provided. The major issues section is only provided as a means to highlight critical requirements or issues. Please be sure to read the entire department comments made in the next section of this letter. Mr. Pixton Page 2 June 20, 2008 Building Division Where the new property line is moved next to the existing building, the exterior wall shall meet the requirements of IBC table 602 for fire resistance rating requirements. DEPARTMENT COMMENTS Outlined below are the comments made by the representatives of each department present at the preapplication conference. Each section should be read thoroughly. If you have questions, please contact the representative listed for that section. PLANNING DIVISION (Matthew Herrera, 253-835-2638, matt.herrera@cityoffederalway.com) Comprehensive Plan & Zoning Designation — Subject property is currently zoned Commercial Enterprise (CE). PWSF's are a permitted land use pursuant to FWCC § 22-874. 2. Review Process — Land divisions involving commercial uses are reviewed via the Binding Site Plan process. Applications for binding site plans are submitted according to the requirements for content and form for short subdivisions. Binding site plans are processed under the provisions of short subdivisions pursuant to FWCC § 20-81 et seq. Procedural Information — Binding site plan review is administrative. Preliminary approval is granted by the City's Director of Community Development. A notice of application with an accompanied two week comment period is required prior to preliminary approval. A two week appeal period follows the Director of Community Development's binding site plan decision. 4. Public Notice — The notice of application will be published in the Federal Way Mirror, posted at the subject property frontage, and placed at the City's three notification boards. 5. Timing — o Completeness — Within 28 calendar days of receiving an application, the City will determine if the application is complete. If the City deems the application complete, a letter of completeness will be issued. If the City deems the application incomplete, a letter of incompleteness will be issued identifying the items that must be submitted to for a complete application. o Director's Decision — The Director of Community Development will issue a decision within 120 days of the issuance of the letter of completeness. Please be advised that any period during which the applicant has been requested to correct plans or provide additional information, the 120-day review time will stop. The review time will continue within 14 days after the date the corrections and/or information has been submitted. 6. State Environmental Policy Act (SEPA) — As proposed, the binding site plan application is categorically exempt from environmental review pursuant to Washington Administrative Code (WAC) 197-11-800(6)(a). 7. Setbacks — As the land division will be completed via Binding Site Plan, the required 20-foot side yard setback for the PWSF tower will not apply. Critical Areas — According to the City's critical area inventory, no known critical areas or buffers exist on the subject property. 08-102527 Doc I D 45726 Mr. Pixton Page 3 June 20, 2008 9. Administrative Fees — Current Binding Site Plan review fees are $2,141.00. 10. Recordation —Subsequent to binding site plan approval, the City shall record the document with the King County Department of Elections and Records. All recording fees shall be paid to the City prior to recording. Binding site plans shall be recorded consistent with Chapter 58.09 of the Revised Code of Washington (RCW). PUBLIC WORKS DEVELOPMENT SERVICES DIVISION (Ann Dower, 253-835-2732, ann.dower@cityoffederalway.com) The subject site is already composed mostly of impervious surface. The boundary line adjustment proposes no changes to that impervious surface; therefore, no stormwater requirements apply at this time. If changes are made to the site involving building footprint, parking areas, change in use, etc., the applicant is advised to consult with the Public Works Department. PUBLIC WORKS TRAFFIC DIVISION (Rick Perez, PE, 253-835-2740, rick.perez@cityoffederalway.com) Per FWCC Section 22-1474, the applicant/owner would be expected to construct half -street improvements consistent with the planned roadway cross -sections as shown in Map III-6 of the FWCP and Capital Improvement Program (CIP) shown as Table III-19. Based on the materials submitted, staff conducted a limited analysis to determine the required frontage improvements in meeting Federal Way City Code (FWCC). Based on this analysis and FWCC, the applicant would not be expected to construct half -street improvements, due to the lack of new trips being generated and the planned preclusion of access from South 356`h Street when it is converted to a freeway off -ramp. Access to the lot for the wireless facilities would be provided by an easement to South 356`h Street that would remain after the construction of the off -ramp. WSDOT is currently funded to acquire the remainder of the site, and no access is needed. Any remnant sold as surplus property by WSDOT would not include access rights to South 356th Street or the off -ramp. Energy code compliance worksheets are required to be completed and included with your permit application. A wet stamp and signature is required on all sheets of plans and on the cover page of any calculations submitted. Federal Way reviews plans on a first in first out basis; however, there are some small projects with inconsequential review requirements that may be reviewed out of order. 08-102527 Doc ID.45726 Mr. Pixton Page 5 June 20, 2008 Review Timing The first comment letter can be expected within five weeks of submittal date. Re -check of plans will occur in one to three weeks after re -submittal. Revised or resubmitted plans shall be provided in the same format, size, and amount as the originally submitted plans. Revised/resubmitted drawings shall indicate by means of clouding or written response, what changes have been made from the original drawings. Plans for all involved departments will be forwarded from Community Development Services. Federal Way has an expedited review process. Information is available at our front counter. Other Permits & Inspections Separate permits may be required for electrical, mechanical, plumbing, fire suppression systems, and signs. Applicants may apply for separate permits at any time prior to commencement of construction. When required, special inspections shall be performed by WABO approved agencies or by agencies approved by the building official prior to permit issuance. Construction must be approved by all reviewing departments prior to final building division inspection. All concerned departments (Planning, Public Works, Electrical, Fire) must sign off before the Building Department can final the structure for occupancy. Building final must be approved prior to the issuance of a Certificate of Occupancy. The City of Federal Way does not issue temporary Certificate of Occupancies. All construction projects may be required to have a pre -construction conference. If a pre -con meeting is required, all subs, the general or representative, the architect or representative, the engineer or representative, electrical contractor and any other interested party, should attend this meeting. Meetings will occur at the Building Department and will be scheduled by the inspector of record for the project. Site -Specific Requirements o Exterior walls shall meet the requirement of IBC table 602 for fire resistance stating requirements for exterior walls based on fire separation distance. Wall shall be constructed per IBC section 705.1. The information provided is based on limited plans and information. The comments provided are not intended to be a complete plan review and further comments are possible at time of building permit plan review. LAKEHAVEN UTILITY DISTRICT (Brian Asbury, 253-946-5407, basbury@lakehaven.org) In accordance with Lakehaven policy, a separate water service connection application submitted to Lakehaven would typically be required, to provide a separate water service connection for the new parcel/lot. Non -single-family properties require separate domestic, irrigation and fire protection water service connections. Due to the somewhat non -typical nature of this proposed land use action, Lakehaven may consider a request to modify this typical requirement to allow any desired irrigation water to be supplied by the existing water service connection for the existing parcel, and not require a separate service connection. 08-102527 Doc.
