At your request, staff recently visited the site at the above -address with you and, as a result, revised the
decision letter sent on June 15, 2016. If the property is short platted, 6th Avenue SW must be improved
for the length of the property frontage, with the exception of the northeast approximately 80 feet, where
steep slopes preclude construction of the road. This is supported by Federal Way Revised Code (FWRC)
Section 19.135.070(2) which allows modification based upon "Unusual topographic or physical
conditions preclude the construction of the improvements as required."
As outlined in the previous modification letter, the following improvements are required south of the
steep slope area:
• Minimum 20' wide asphalt pavement travelway with approved tam -around at the end of the
street.
• City standard curb and gutter on the west side of the street only.
• 4-foot wide planter strip with sod and street trees, west side only.
• 5-foot wide concrete sidewalk, west side only.
• Streetlighting, west side only.
■ Set aside the improved area and the unimproved future extension of 6"' Ave SW as a Tract X for
future dedication
• Improvements shall be designed by a civil engineer licensed in the State of Washington and
constructed prior to recording of the short plat.
This decision shall be applicable for a period of one year from the date of this letter. If a complete short
plat application has not been received within that time period, this right-of-way modification shall be

Staff Analysis
6th Avenue SW is currently a sub -standard private road that, due to projected traffic volumes,
should conform to a Type W street with 28 feet of pavement, vertical curb, gutter, 4' wide
planter strip, and 5' wide sidewalk within a 52' right-of-way. The applicant submitted a request
on May 19, 2016 to waive the required improvements along his property frontage. The waiver
was denied, but a modification was granted such that as a condition of the proposed short plat,
the applicant was required to build a minimum 20' wide paved road with curb, gutter, planter
strip, and sidewalk on one side along his property frontage. An approved turn -around was also
required at the north end of the improvements. The area was required to be set aside for future
dedication.
The applicant later requested that staff visit the site with him to review conditions within the
northeast (approximately) 80' of his property. After visiting the site, staff determined that
within that northeast area, Federal Way Revised Code section 19.135.070(2) applies: "Unusual
topographic or physical conditions preclude the construction of the improvements as required".
Staff is therefore in support of waiving the improvements within the northeast 80 feet of the site.
A proposed lot within that area could be served by a private driveway.
Requirements / Conditions of Approval
The following improvements shall be required along the property frontage, stopping
approximately 80' short of the northeast property corner, where topography precludes
construction of the road:
• Minimum 20' wide asphalt pavement travelway with approved turn -around at the end of
the street
• City standard curb and gutter (one side)
• 4-foot planter strip with sod and street trees (one side)
• 5-foot wide concrete sidewalk (one side)
• Streetlighting (one side)
• Set aside the improved area and the unimproved approximately 80' future extension of
the improvements as a Tract X for future dedication.
• Improvements to be designed by a civil engineer licensed in the State of Washington and
completed prior to recording the short plat.

This letter responds to your request to waive the required street improvements along
6th Avenue SW, a sub -standard private street which abuts the above -referenced property.
Federal Way Revised Code (FWRC) Section 19.135.070; Modifications of Improvements Along
Property Frontage, allows the Public Works Department to grant a modification, deferral, or
waiver of the required street improvements, after consideration of four specific reasons. The
reason stated in your request is "...improvements as required would not be harmonious with
existing street improvements...", as provided under FWRC 19.135.070(1).
The street of 6th Avenue SW, is a private road in this location, which corresponds to Federal
Way Roadway Section "W". This section requires a 28-foot paved roadway with vertical curb
and gutter, a 4-foot wide planter strip with street trees, and 5-foot wide sidewalk, all within a
52-foot wide Right of Way (26-feet on each side of centerline).
After evaluating the existing conditions along 6th Avenue SW, review of Federal Way Revised
Code (FWRC) provisions (Section 19.135.070), and direction provided by the City Council, the
Public Works Department hereby denies your request to waive the requirements for street
improvements, and requires that the following improvements be constructed along the property
frontage:
• Minimum 20' asphalt pavement travelway with approved turn -around at the end of the
street;
• City standard curb and gutter;
• 4-foot planter strip, which includes planting of sod grass and street trees;
• 5-foot wide concrete sidewalk;
• Streetlighting
• Set aside the area for future dedication
The City will require that design plans be completed by a civil engineer licensed in the State of
Washington and be submitted for review and approval. The street improvements must be
completed prior to recording the short plat.

It appears to me that the type w road as required might create an
awkward situation. The first half of the street which does not touch our
property is a 20 foot road that borders on the east side of the existing
easement. All development will be done on the bottom half of the west
side, three new lots. It seems that to develop my half of a 28 foot road
would create an awkward situation. It seems to me that it would be
preferable to continue down the same line as the existing road. This is a
small private road that is landlocked and can never be expanded or
joined to any further development. There can only be a possible five
new lots developed on this road. I believe a twenty foot road would be
safe and adequate for this situation.

2. 1 would ask you to waive the need of sidewalks, planter strip, and
street lights. There will only ever be five houses to service this area with
no through streets. There is already a street light mounted on a pole
approximately mid way on the property that lights up the area very
well.
3. 1 would ask you to waive the request to pave the road the entire
frontage of our property. The last 80 feet of the property descends
down into a wooded, unstable, steep, topography on the east side. We
have never considered this area to be usable but just some wasteland.
The house lot 4 that abuts this area will actually face south and enter
the property via an easement created from the existing house. I would
ask that the paved road end in the area that it presently does with the
lower 80 feet remaining the gravel road installed by Lakehaven

In summary, I believe these requests would allow for a safe,
harmonious condition that would function best with the existing
conditions. I hope that you would agree and we can proceed with the
improvements for this neighborhood. I believe three new 450,000 -
550,000 homes would be a big improvement and perhaps motivate the
existing residents to take better care of their properties.
