The city has completed an administrative review of the proposal to construct an 11.3 acre foot
stormwater detention facility and storm drainage pipe upgrades, and hereby approves the above
referenced application. This approval is based on the enclosed Findings and Conclusions for
Application UP398-0012. Criteria for Process III review is contained in Federal Way City Code
(FWCC) Section 22-395(b)(1-5).
The effective date of this decision is June 11, 1998. The decision may be appealed in the form of
a letter delivered to the Department of Community Development Services(33530 1st Way
South, Federal Way, WA)by June 25, 1998,by any person who receives a copy of this decision.
An appeal letter must contain a clear reference to the matter being appealed and a statement of
the factual findings and conclusions of the Director of Community Development Services
disputed by the person filing the appeal,and must include the appeal fee. Any additional
requirements of FWCC Section 22-397 must also be followed. Pursuant to FWCC Section 22-
396,work on the project may not occur until three working days after the appeal period has
expired.
This decision shall not waive compliance with City of Federal Way codes,policies,and
standards relating to this development. If you have any questions regarding this decision,please

FINDINGS AND CONCLUSIONS
APPLICATION UP398-0012
SW 340th Street Storm Water Detention Facility
BACKGROUND
Application UP398-0012 is a request to construct an 11.3 acre foot storm drainage detention
facility. The project location is south of SW 340th Street and north of SW 342nd Street,between
Hoyt Road and 37th Avenue SW, in Federal Way, WA. The storm drainage facility includes
constructing a pond of approximately 625 feet long by 180 feet wide,and approximately 30 feet
in depth. Various storm drainage pipes in the vicinity of the proposed pond will also be upgraded
as a component of this project. The completed project will reduce the frequency and magnitude
of local flooding. The project will control a total of 124 acres of tributary drainage without
increasing peak flows to the east tributary of Joes Creek.
Under Process III land use review,the Director of Community Development Services renders a
written decision after considering all of the information and comments submitted on the matter,
and based upon the decisional criteria in FWCC Section 22-395. The criteria include the
following:
1. It is consistent with the Comprehensive Plan;
2. It is consistent with all applicable provisions of the zoning code;
3. It is consistent with the public health, safety, and welfare;
4. The streets and utilities in the area of the subject property are adequate to serve
the anticipated demand from the proposal; and,
5. The proposed access to the subject property is at the optimal location and
configuration.
Following are findings and conclusions for a Process III land use decision to approve
construction of a 11.3 foot acre storm drainage detention facility and storm drainage pipe
upgrades.
FINDINGS
1. The subject property for the application includes all of the property from the location of the
proposed pond west to Hoyt Road, and includes two different zoning designations. The
proposed'pond is located in a Residential Single Family(RS7.2)zoning district,and the '
remaining property west of the pond is zoned Neighborhood Business(BN).
2. The subject property is currently undeveloped, with the exception of one single family
residence on the west portion of the property. The residence will be demolished under
separate permit.

3. Pursuant to FWCC Section 22-644,a public utility is allowed in an RS zoning district
subject to Process III review.No above grade structures are proposed with the application.
The application is necessary to provide storm drainage facilities to the immediate vicinity of
the project.
4. The Community Development Services Department published a notice of Process III
application in the Morning News Tribune on April 27, 1998,and posted notice boards at the
site and at each of the official notification boards of the city. The 14 day comment period
expired on May 10, 1998. No written comments were received on the application.
5. A State Environmental Policy Act(SEPA) Determination of Nonsignificance(DNS)was
issued for the project by the City of Federal Way on April 13, 1998.
6. No environmentally sensitive areas are known to exist on the subject property •
7. The project design includes a geotechnical report by Landau Associates(February 19,
1998). Landau Associates is an engineering firm qualified to conduct geotechnical
investigations,reports,and recommendations. The project is shown on plan sheets 1 to 18
by KCM Engineers for the SW 340th Street Regional Stormwater Storage Facility.
8. The proposal includes disposing the material excavated from the pond area onto the
remainder of the subject property. Future development of the remaining undeveloped
portion of the property where the excavated soil will be disposed will require independent
land use review and may require further geotechnical investigation and recommendations for
developing the site.
9. A landscape planting plan by Springwood Associates,and stamped by a registered
landscape architect,provides a 15 foot Type 1 (Solid screen)buffer along the east property
line. This 15 foot buffer constitutes the required Type I separation from the BN zoned
portion of the site to the off site residential area, as well as provides solid screen landscaping
of the storm drainage facility to the adjacent residential area. When the remainder of the
subject site develops with future commercial uses, the provided solid landscaping along the
east project limits will serve to provide the required solid screen landscape separation for the
off-site residential uses.
The landscape plan also provides 10 feet of Type II visual buffer landscaping along the
street frontages and between the pond and the remaining BN property. The pond area will be -
landscaped with vegetation suited for a storm drainage pond, with the exception of the
gravel access road. Appropriate erosion control/stabilization of the disposal site must also be
implemented.

10. The proposal meets the decisional criteria of FWCC Section 22-395 (b)and embodies
design principles that protect the public health,safety,and welfare by alleviating flooding
conditions in the vicinity without increasing peak flows to Joes Creek.
CONCLUSIONS
The proposal has been reviewed for compliance with the Federal Way Comprehensive Plan,
Comprehensive Surface Water Management Plan,pertinent zoning regulations,and other
applicable city regulations. The proposal meets the decisional criteria of the Process III review.
Based on the findings and conclusions of this review,approval of the project is recommended.
This decision shall not waive compliance with future City of Federal Way codes,policies,or
standards relating to this decision.

340th& Hoyt Road, planted at 35' on center. Book says these are rapid growth to 50-60
feet. Civil plans also denote ovehead wires are to be undergrounded . These trees
would also be backed by a row of acer rubrums in the five foot front perimteter type III.
Are summit ash ok in the ROW planter strip, seem a little big to me, and not frequestly

AGREEMENT
This agreement ("Agreement") made this _day of , 1998 between
the City of Federal Way, a Washington municipal corporation ("City"), and Thomas
R. Fallis, a single person ("Owner").
Whereas, Owner is the owner of certain real property located in Federal Way,
Washington, and is contemplating developing the property; and
Whereas, the City requires the construction of a storm water detention facility,
and dedication of a certain portion of land for street widening and improvement as a
condition of development; and
Whereas, the City plans to construct and operate a regional storm water
detention facility in the vicinity of Owner's real property, and has considered
condemnation of a portion of Owner's property for the facility; and
Whereas, the Owner is willing to transfer ownership of a portion of his property
to the City for use as a regional storm water detention facility, and the City is willing
to provide consideration subject to certain agreed terms and conditions set forth
below;
NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. Transfer of Ownership
1.1 Deed. Owner shall transfer ownership of certain real property
("Property"), known as Lots 46 through 55, except the east 135 feet thereof,
Hannon's Half-Acres Addition, according to the plat thereof recorded in Volume 16
of Plats, page 28, in King County, Washington to the City by deed in the form of
Exhibit "A", attached hereto and incorporated herein by this reference, under threat
of condemnation.
1.2. Storm Water Drainage. City shall use the Property for a regional storm
water detention facility ("Facility"). The City shall substantially complete the Facility

by December 31, 1998. The City agrees, in consideration of the transfer of
ownership from Owner, that t will provide in the Facility sufficient storage volume to
accommodate the treated storm water discharge generated by a 100-year storm
event which naturally drains from the balance of the Owners' remaining property,
legally described in Exhibit "B" attached hereto and incorporated herein by this
reference ("Remaining Area") under the maximum impervious area percentage
allowed by the current Federal Way surface and storm water regulations and Facility
design. The maximum impervious area percentage shall be 90% of the Remaining
Area. Accordingly, the City agrees that Owner shall not be required to provide any
on-site retention/detention facilities for storm water on the Remaining Area as a result
of the(owner's development or redevelopment of the Remaining Area for a legally
allowed and permitted use for a period of twenty-five (25) years unless the maximum
impervious area percentage is exceeded. Thereafter, additional surface water
detention shall be required if then-current City surface water regulations require more
detention than the facility had been designed to accommodate from the Remaining
Area. Should Owner request development or redevelopment beyond the maximum
impervious area percentage, Owner shall be responsible for any then-existing storm
water detention requirements beyond the amount accommodated in the Facility. The
Owner shall install, at Owner's expense, and in compliance with all applicable codes
and laws, all necessary facilities for direct discharge of treated storm water from the
Remaining Area to the Facility, in accordance with the provisions of section 1.3
herein. City shall provide a "stub out" connection to the Facility for Owner's
development on the Remaining Area. It is mutually agreed that "redevelopment" shall
include the development of the Remaining Area by the Owner, or Owner's successors
in interest, heirs and assigns, by altering or constructing improvements upon the
Remaining Area for any legally permitted use.
1.3 Remaining Area Biofiltration Facility. In consideration of the transfer of
. the Property, and to accommodate Owner's proposed development on the Remaining
Area and the expected dedication of right of way, the City shall provide Owner with
a biofiltration swale of sufficient capacity to treat flows originating_from the
Remaining Area in accordance with current biofiltration requirements. The Biofiltration
Facility will be physically separate from the pond low flow swale and will be
maintained as a part of the larger detention facility by the City.
1 .4 City Development Conditions. The Owner is entitled to utilize the
Property to comply with any existing or future City code requirement for open space,
greenbelt, maximum lot coverage or similar requirements as a result of Owner's
development of the Remaining Area pursuant to a Open Space/Lot Coverage
Easement attached hereto as Exhibit "C" and incorporated herein by this reference.
Additionally, the City agrees that the Owner is entitled to utilize the Property to
comply with any existing or future landscaping requirements for the eastern edge of

the Remaining Area. Nothing herein shall relieve Owner from complying with the
balance of the City's requirements for development.
1.5 License. Owner hereby grants a temporary license to the City, its agents
or representatives to enter upon the Remaining Area in the form of a License
Agreement attached hereto as Exhibit "D" and incorporated herein by this reference
to place soils excavated for its Facility as an engineered fill on the Remaining Area,
to use the Remaining Area for a temporary earthwork disposal area, a temporary
interceptor ditch and for a temporary stockpile area, subject to the following terms
and conditions:
a) The City shall clear (other than the existing structures), rough
grade, and fill the Remaining Area evenly with structural fill taken from
the Facility. The City shall substantially complete the grading and filling
by November 1, 1998. The City shall have no obligation to place fill on
the Remaining Area exceeding the useable fill resulting from its
excavation. The City shall have no obligation to construct any structural
components or improvements in connection with placing such fill and/or
to incur any additional costs other than moving the available fill from the
Facility and placing it on the Remaining Area pursuant to this Agreement
and all permits.
b) This license grants to the City control over any necessary portion
of the Remaining Area during the City's grading and filling activities.
The City's use of the Remaining Area shall be coordinated with Owner's
use of the Remaining Area. This license will revoke upon the City's
completion of the grading and filling activity.
2. Title Title to the Property shall be acceptable to the City. Owner shall
obtain the subordination of all encumbrances or defects which have a prior interest
to the City and which are unacceptable to the City. _
3. Closing
3.1 Closing of the Transfer. This transfer shall be closed on or before
J U r, , 1998, after the City's notice to the Owner of the City's
satisfaction of the contingencies set forth in Section 4.1 herein, or at another time
agreed to in writing by the parties.
3.2 Closing Agent. This sale shall be closed by a closing agent designated
by City. The City and the Owner shall, immediately upon demand, deposit with
closing agent all instruments and monies required to complete the purchase in
accordance with this Agreement.

3.3 Closing Costs. The City shall pay all closing costs, including recording
and escrow fees.
3.4 possession. The City shall be entitled to possession of the Property
either pursuant to the terms of a possession and use agreement, or at closing,
whichever occurs first.
4. Contingencies
4.1 The Contingencies. The City's obligations to accept the Property under
this Agreement are conditioned upon and subject to the City's satisfaction, in its sole
discretion, or the City's written waiver of the following contingencies:
(a) The City's determination that the soils of the Property, or structures or
improvements on the Property, are free from any hazardous substances
whatsoever. Owner shall reasonably cooperate with the City to provide such
information that the City requests to the extent that such information or
documents exist and are under the control of the Owner, and grant to the City
the right to enter the Property at reasonable times upon prior notice to the
owner to inspect and obtain necessary samples from the same. This
contingency is solely for the City's benefit and shall be determined in the
exercise of the City's sole discretion;
(b) Final approval of this Agreement by the City Council of Federal Way;
(c) The truth and accuracy of all representations of Owner;
(d) The absence of any violation of federal, state or City laws including
without limitation, all City codes, ordinances, resolutions, regulations,
standards and policies, as now existing or hereafter adopted or amended,
effecting the use, occupancy or condition of the Property; _
(e) Owner's failure to comply with the order of any court or governmental
authority or agency pertaining to the Property or the use, occupancy or
condition of the Property;
(f) The pendency or threat of any litigation or proceeding relating to the
Property; or
(g) Any material change in the Property or the improvements on the
Property occurring after the execution of this Agreement.

4.2 Contingency Period. In connection with the contingencies contained in
Section 4.1 herein, the City has forty-five (45) days from the date of the City's
receipt of Owner's acceptance of this offer to notify Owner of the City's
determination.
4.3 Expiration of Contingency Period. If Owner does not receive the notice
required by Section 4.2 prior to the closing date, this Agreement shall terminate, at
the City's election.
5. Owner's Representations and Warranties
5.1 No Material Defect. Owner is unaware of any material defect in the
Property.
5.2 Debris and Personal Property. Owner shall remove a 55 gallon drum and
a green gel identified in the City's phase I Environmental Site Assessment.
6. City's Indemnities The City agrees to indemnify and hold harmless the
Owner, against and in respect of, any and all damages, claims, losses, liabilities,
judgments, demands, fees, obligations, assessments, and expenses and costs,
including without limitation, reasonable legal, accounting, consulting, engineering and
other expenses which may be imposed upon or incurred by the Owner, or asserted
against the Owner, by any other party or parties (including, without limitation, a
governmental entity), arising out of the sole negligence of the City, it agents and
employees, in connection with the City's work on the Remaining Area. This
indemnity shall survive the closing.
7. Notice Any notice made pursuant to this Agreement, must be in writing,
signed by the City Manager or designee or the Owner and delivered to the City or the
Owner at their respective addresses set forth below. Facsimile transmission of any
signed original document shall not be the same as transmission of an original.
8. General Conditions
8.1 Performance. Time is of the essence to this Agreement.
8.2 Entire Agreement. This Agreement contains all of the agreements of the
parties with respect to any matter covered or mentioned in this Agreement and no
prior agreements or understandings pertaining to any such matters shall be effective
for any purpose.
8.3 Modification. No provision of this Agreement may be amended or added
to except by agreement in writing signed by the parties.

8.4 Full Force and Effect. Any provision of this Agreement which is declared
invalid, void or illegal shall in no way affect, impair, or invalidate any other provision
hereof and such other provisions shall remain in full force and effect.
8.5 Governing Law. This Agreement shall be made in and shall be governed
by and interpreted in accordance with the laws of the State of Washington.
8.6 Captions. The respective captions of the paragraphs of this Agreement
are inserted for convenience of reference only and shall not be deemed to modify or
otherwise affect in any respect any of the provisions of this Agreement.
9. Survival of Warranties/Obligations The terms, covenants,
representations and warranties contained in this Agreement shall not merge in the
Deed, but shall survive closing. The obligations of the parties contained in paragraphs
1.2, 1.3, 1.4, 1.5, and 5.2 shall not merge in the Deed, but shall survive closing.
10. Termination of Agreement The City offers to accept the Property on the
terms and conditions set forth herein. In the event the Owner does not accept this
offer on or before A rr-i 1 , 1998, this offer shall expire and terminate.

2. SEDIMENT RETENTION FACILITIES SHALL BE INSTALLED
PRIOR TO GRADING OF ANY CONTRIBUTING AREA,
3. SURFACE WATER RUNOFF FROM ALL DISTURBED AREAS
SHALL BE ROUTED TO THE SEDIMENT TRAP BY WHATEVER
MEANS NECESSARY PRIOR TO DISCHARGE FROM THE
SITE.
4. EXISTING OR INSTALLED CATCH BASINS SHALL BE
PROTECTED FROM SEDIMENT DURING THE CONSTRUCTION
SEQUENCE.
5. TOPSOIL AND OTHER SALVAGED MATERIAL STOCKPILES
THAT ARE LOCATED WITHIN PROJECT LIMITS SHALL BE IN
NON —TRAFFIC AREAS. THE SIDE SLOPES SHALL NOT BE
PILED STEEPER THAN 2:1. THE STOCKPILE AREAS SHALL
BE SURROUNDED BY A FILTER FABRIC FENCE AND
INTERCEPTOR DIKE. HYDROSEEDING/HYDROMULCHING OF
THE STOCKPILE SHALL BE COMPLETED WITHIN 15 DAYS
OF THE FORMATION OF THE STOCKPILE OR THE
STOCKPILE SHALL BE COVERED WITH PLASTIC COVERING.
6. MAINTENANCE: EROSION AND SEDIMENTATION CONTROL
FACILITIES SHALL BE INSPECTED, MAINTAINED, AND
SEDIMENT REMOVED BY THE CONTRACTOR ON A WEEKLY
BASIS AS A MINIMUM AND ON A DAILY BASIS DURING
PERIODS OF RAINFALL AS IT BECOMES NECESSARY, THE
CONTRACTOR SHALL RELOCATE, REBUILD, AND MAKE
ADJUSTMENTS TO THESE FACILITIES AS NECESSARY
DURING CONSTRUCTION.
7. DUST CONTROL: MINIMIZE THE PERIOD OF SOIL
EXPOSURE THROUGH THE USE OF TEMPORARY GROUND
COVER AND STABILIZATION PRACTICES. EXPOSED DUST
PRODUCING SURFACES SHALL BE SPRINKLED DAILY UNTIL
WET WHILE AVOIDING PRODUCING RUNOFF. REPEAT AS
NEEDED. PAVED STREETS SHALL BE SWEPT DAILY
FOLLOWING CONSTRUCTION ACTIVITIES. EXPOSED SOIL
AREAS SHALL BE SPRAYED WITH AN APPROVED DUST
PALLIATIVE (SUPPRESSANT).
8. REMOVAL OF ALL TEMPORARY EROSION AND SEDIMENT
CONTROL MEASURES SHALL BE DONE AFTER THE
WORKING AREA IS STABILIZED OR AS DIRECTED BY THE
ENGINEER.
