Dear Mr. Waldner:
The Community Development Department is in receipt of your Process I Master Land Use (MLU)
application for the proposed fenced tow yard area. The Process I MLU application is hereby approved as
it meets review criteria set forth in Federal Way Revised Code (F)ATRC) 19.55.020. The director's
conclusions are based on findings made by the department's Planning Division.
CONCLUSIONS
Various sections of the zoning and development code indicate that certain developments, activities, or
uses are permitted only if approved using Process I — Director's Approval. Based on the findings below,
the proposed improvements to the developed site meet the following Process I approval criteria and land
use review thresholds of Federal Way Revised Code (FWRC) 19.15.030 and 19.55.020:
1. The proposed improvements are consistent with applicable chapters of FWRC Title 19 including,
but not limited to: Permits and Review Processes; Process I — Director's Approval; Community
Design Guidelines; Outdoor Activities and Storage; and Commercial Enterprise (CE).
2. The health, safety, and welfare of the citizens of the city are preserved.
3. The proposal is a minor improvement, modification, or addition to a site that is exempt from
SEPA review.
FINDINGS OF FACT
1. Proposal — The applicant proposes a fenced tow yard at the south end of the property. The
outdoor. storage area is subject to Process I review per FWRC 19.125.170, `Commercial and
industrial uses. 'The project includes using the existing paved area and curb stops to store towed
vehicles. The tow yard will be completely fenced in utilizing the existing fence along the west
property line. The fence is 6 feet tall along the rear (south) property line; the remaining fence will
be six feet tall secured with. one foot of barbed wire on top for a total height of seven feet. The
fence is vinyl -coated mesh, powder coated poles, with solid slats all black in color.
2. Comprehensive Plan & Zoning Designation — The comprehensive plan and zoning designation
for the property is Commercial Enterprise (CE). Per FWRC 19.240.050, tow lots are an allowed
use in the CE zoning. The city provided a Zoning Compliance Letter, dated July 7, 2014, in
which it was concluded that the change of use to a tow lot is in compliance with relevant zoning
requirements and is approved as proposed.

3. Setbacks — The required setbacks for a tow lot are 20-foot front yard and 15-foot side and rear
yard. As proposed, no portion of the fence will exceed six feet when located in the required yard.
Also, no towed cars will be parked in the required side and rear yards.
4. Screening — The proposed fence will provide a solid screen of the stored vehicles. The existing
vegetation, location of the existing building, and the fence provide enough screening that the
stored vehicles will not be visually obtrusive to surrounding properties. No additional screening is
necessary.
5. Community Design Guidelines — As proposed, the fence complies with FWRC 19.115.090(2); the
chain -link fence is visible from public rights -of -way or adjacent properties, not screened by Type
I landscaping, and utilize vinyl -coated mesh, powder -coated poles, dark color(s), and
architectural elements.
APPEALS
The effective date of this decision is August 30, 2014, or three days from the date of this letter. Pursuant
to FWRC 19.55.050, any person who commented on the application or requests a copy of this
administrative decision may appeal the decision to the Federal Way Hearing Examiner by September 15,
2014. Any appeal must be in the form of a letter delivered to the Community Development Department
with the established fee. The appeal letter must contain a clear reference to the matter being appealed and
a statement of the alleged errors in the Director's decision, including the identification of specific findings
and conclusions made by the Director disputed by the person filing.
However, in that you are the only party of record, your appeal period is waived (assuming you do not
wish to appeal this decision). Waiver of the right to appeal does not affect the effective date of this
decision.
CLOSING
This decision shall not waive compliance with future City of Federal Way codes, policies, and standards
relating to this development. This Process I approval is valid for one year from the effective date of this
decision. If no further action is taken within one year, this decision will expire. Per FWRC 19.15.110, a
two-year extension may be granted if a written request is submitted to the City's Community
Development Department at least 30 days prior to the expiration of the decision.

Defirnitions—Registered tow track operator.
(1) "Affidavit of sale" - that document prescribed by the department and given to the successful
bidder by the operator. The affidavit must state that the sale was conducted properly pursuant to
chapter 45,55 RCW and must be notarized. The affidavit may be submitted to the department with an
application for certificate of title or may be used as a title document by a licensed auto wrecker, hulk
hauler or scrap processor.
- (2) "Secure area" a place of safety for vehicle storage and in an area completely enclosed by a
fence of sufficient height and construction to prevent access by the general public, with a gate which
can be locked. The .fence most be.,at 'least six feet high with at.least two strands of barbed wire along
tine top, for a total combined height of eight feet or more. Concertina wire may be substituted for the two
strands of barbed wire. The fencing require eni may be waived by the department where, due to the
topography or zoning, a fence would be impracticable and the storage area is secure without a fence.
Storage within an enclosed building will be considered secure and does not require a waiver. When a
licensee has operator registrations under more than one name and owns or leases a common secure
area, the areas for each operator registration must be segregated by a six-foot fence which will not
'require barbed wire. When two or more operators with different ownership share a secured area, those
respective areas must be segregated by an eight -foot fence as described above.
Wherever practicable secure storage areas will be located on improved property which is graded
and illuminated at night for the safe keeping of stored vehicles.
(3) "Abandoned vehicle report" - is that document, prescribed by the department, by which the
operator is to report to the department their possession of an abandoned vehicle-
(4) "Notice of custody and sale" - is that document, prescribed by the department, and sent by the
operator to the registered owner, legal owner (lien holder), lessor and lessee giving notice of the
amount of the operator's lien for services, place and time of public auction if the vehicle is not
redeemed, and of the operator's right to seek a deficiency against the last registered owner.
(5) "Registered tow truck operator's business location" - is a location at which records and files
necessary to conduct the business are kept, and where the operator can normally be contacted by the
public_

Becky, I am respectfully requesting the following changes to our submitted site plan dated
7/29/2014. These changes are the result of our prior recent telephone conversations which revolve
around the setback, and fence height requirements.
As indicated before, we are a Registered Tow Truck Operator. There are minimum requirements for
storage yards, which I have provided the state code related to this issue. Essentially, the State
requires a 6 foot fence with two strands of barbed wire. However, they will, with think, waive this
requirement when the local ordinances prohibit barbed wire. Since you indicated to me that the
barbed wire would be an issue in the setback area (15ft), 1 pave modified the site plan as indicated by
2 and 3, that we would construct only a 6 foot fence with no barbed wire. We are also proposing to
eliminate the 152 feet of "New Fence", as indicated by 1. We propose to only bring our new fence
perpendicular to the existing fence. This existing fence is a non -conforming fence with razor
wire. Please let me know if you have any questions, and your indulgence into this matter is greatly
appreciated. We are trying to close on the property very soon, this is the only matter holding up the
closing.

Narrative Description of Northwest Towing, Inc. Fence Project
Submittal Requirement for Process I

Director of Community Development:
We would respectfully submit the following information regarding the fence project to be located at
2025 South 341" Place, Federal Way, Wa. Per the administrative decision dated July 7, 2014, we were
given approval of the zoning change of use at the above property. Since we plan on moving our towing
operations from the current location in Federal Way to this location, we require a enclosed/fenced
storage area. You have required that a Process I application be submitted, which we have along with
this narrative.
The fenced area will be a 6' fence with barbed wire on top, for a total height of 7' per FWRC 19.25.120.
We shall utilize a vinyl -coated mesh, powder coated poles, black in color, and include architectural
elements, such as pole caps as included in the submitted information. The decorative slats will also be
installed and I have included pictures. All of the elements will be of a high quality nature and installed
by a professional, reputable fencing company. This fenced area will be very attractive and when
compared to any properties nearby, be the most attractive fence in the area. The property to the west
of this property, currently has chain linked fencing, with razor wire and it is disrepair. This fence line is
also at least 10 feet away from our proposed fence line, with a steep bank as a buffer. We propose a
high quality screening material, see pictures, which will be screening the vehicles stored, nothing we
store is visually obtrusive, and in fact with the sizeable investment in this fence, we will be the Cadillac
of fenced areas with miles of this industrial area. The proposed fenced area will not inhibit safe
vehicular and or pedestrian movement, and the gate placements will provide for very efficient
movement of our vehicles. We will not be intruding on any parking in the proposed project. The
proposal does allow for the natural vegetation and existing landscaped area to be continued and we will
be enhancing those areas as we become settled into the property. No initial plans other than to
maintain the blackberry growth and to add beauty bark or a ground cover to aid in the maintenance of
the property. All curb stops will be maintained and kept in place, vehicle will only be parked on the
asphalt areas which currently exist.
It is our intentions to move forward as quickly as possible with approval of this fence project, your
indulgence into this matter is greatly appreciated.

ADA symbol. The front walkway does not have a curb cut and is not accessible. The back entrance door has a ramp; but
no designated handicapped parking near the ramp. The ramp does not have a handrail to be used by people in a

1. PRODUCT NAME
Fused and Adhered Poly(Vinyl Chloride) -PVC Coated Steel Chain Link Fence Fabric
2. PRODUCT DESCRIPTION
Basic Use:
Fused and adhered fabric is a bonded vinyl, high strength galvanized steel, chain link fence fabric for industrial, commercial,
and institutional application. Fused and adhered fabric is contained in local, state and federal government specifications for
use in prison, road, dock, airport, housing, forestry, and military use.
Composition and Materials:
The galvanized steel care wire for producing fused and adhered PVC coated steel chain link fence fabric is produced by cold -
drawing good oommercial grade steel rod into wire of the appropriate diameter. The steel rod from which the wire is drawn is
produced by the open hearth, electric furnace or basic oxygen process. The galvanized coating is produced by passing the
cleaned wire through a bath of molten zinc which conforms to ASTM B6.
The fused and adhered PVC coating is produced by first applying a thermoset banding agent to the galvanized core wire to
which the PVC is bonded. A coating of PVC up to 0.016 in. (0.25 mm) is then fusion/bonded to the wire.

3. TECHNICAL DATA
General:
The manufacturer, if requested, will supply samples and certification that all materials furnished fully comply with the
appropriate specifications.
Chain Link Fence Fabric:
The base metal of the chain link fence fabric is composed of commercial quality, medium -carbon galvanized (zinc coated) steel
wire. The vinyl coating is thermally bonded to a thermoset bonding layer over a galvanized steal wire_ This process ensures a
tightly adherent and impervious coating free of voids, as well as a smooth and lustrous surface appearance. Vinyl coating
thickness, galvanized coating weight, and wire tensile strength conform to Federal specification RR-F-191, ASTM F668. Class
2a, and AASHTO M-181 Type IV. Class A, as shown in Table 1_ The wire is PVC coated before weaving and is free and
flexible at all joints. Unless otherwise specified, fabric woven in 2 in. (50 mm) mesh, under 72' (1.830 mm) in height, is
knuckled at both selvages; fabric 72' (1,830 mm) high and over is knuckled at one selvage and twisted at the other. All fabrics
woven into meshes under 2 in. (50 mm) have both selvages knuckled. See Table II.
Wire Coating:
Only plasticized poly(vinyl chloride) (PVC) with a low temperature (-20°C, -4°F) plasticizer and no extenders or extraneous
matter other than the necessary stabilizers and pigments, is used. The PVC coating resrsts attack from p!�alonged exposure to
dilute solutions of most common mineral acids, seawater, and dilute solutions of most salts and alkali. See Table III.

Coating Adhesion: The PVC coated wire shall pass the test for adhesion contained in ASTM F668 for Class 2b chain link
fabric.
4. INSTALLATION
Install fence in accordance with'ASTM Practice 567. Handle all PVC coated material with care. If PVC coating is damaged
during installation, contractor must replace or repair the material at own expense.
5. WARRANTY
Fused and adhered PVC coated steel chain link fence fabric is warranted for 15 years against failure due to rust or corrosion.
6. MAINTENANCE
Periodic inspection is recommended but no routine maintenance is required.

2. PRODUCT DESCRIPTION
Basic Use:
PF-40 pipe is used as end, corner or line posts, and rails, for commercial, industrial and institutional installations of chain link
fencing. The requirements for this material are contained in various government specifications for use in prison, road, dock,
airport, housing, forestry, and military installations.
PF-40 pipe is typically used in installations which incorporate zinc -coated or aluminum -coated steel chain link fence fabric,
although it may also be specified for use with other types of fabric, i.e. PVC coated.
Composition and Materials:
PF-40 pipe is manufactured using cold formed steel with a higher yield strength and tensile strength than schedule 40 pipe.
The pipe is triple coated to provide and maintain a lustrous appearance in all climates and under the most severe atmospheric
conditions.

3. TECHNICAL DATA
General:
The manufacturer or distributor, if requested, will supply samples and certification that all materials furnished fully comply with
the appropriate specifications.
Zinc Coated Steel Framework:
The information contained herein for high yield strength/high tensile strength pipe covers the requirements for pipe sizes NPS 1
to NPS 3'/2, corresponding to fence industry sizes 1-3/8" to 4". (Note: The dimensionless designator, NPS is used instead of
traditional terms such as nominal diameter, size, and nominal size.)
Yield Strength Requirement:
The yield strength of PF-40 pipe is 50,000 psi (344 MPa), min.
Coating Requirements:
The exterior of PF-40 pipe is triple coated, ensuring the pipe will maintain its appearance. The triple coating consists of a
metallic coating of zinc, plus a conversion coating and a clear organic film, conforming to ASTM F0143 Type B coating
requirements.
The interior of the pipe is coated with a zinc rich paint conforming to ASTM F1043 Type D coating requirements.
This coating provides a high level of corrosion resistance to the interior of the pipe.
Size and Tolerances:
Sizes and other critical physical characteristics of PF-40 pipe typically used for fence installations are listed in Table 1.
The weight tolerance of the pipe is ±5% of the nominal weights listed in Table 1.
Mill lengths may range from 18 ft to 24 ft, or posts are available to cut -to -length. Posts lengths must be noted on purchase
orders, plans, or specifications.
PF-40 Strength Characteristics
Strength calculations are provided in Table 2. The calculations are based on the specified diameters, wall thicknesses, and
minimum specified yield strength. Strength calculations are in inch -pound units only.
Additional information regarding the size of pipe typically used for various heights of fence fabric is found in Table 3.
4. INSTALLATION
Install fence posts in accordance with ASTM Practice 567.
5. MAINTENANCE
Periodic inspection is recommended but no routine maintenance is required.

WHEN USE PROCESS I IS USED
A project involving improvements to an existing developed site may be reviewed using
Process I criteria if:
There is no change of use;
• It is exempt from requirements of the State Environmental Policy Act (SEPA)
■ There is no reduction, material change or adverse impact to:
o Landscaping, buffering, open space or public areas;
o Required parking;
o Location of utilities, easements or pedestrian connections;
o Approved architectural design; or
o Environmentally critical areas (as defined by Federal Way Revised Code
[FWRC] 19.145).
WHO MAKES THE DECISION
Under Process I, the Director of Community Development Services makes the decision
based on review and analysis of the submittal documents and decisional criteria
(FWRC 19.55.010).
APPEALS
Any decision issued by the director can be appealed by the applicant, anyone who
submitted written comments during the review, or anyone who requested copies of the
decision. Appeals of Process I are decided by the City of Federal Way Hearing
Examiner after a public hearing. See FWRC 19.55.050 for detailed information regarding
appeals of Process I decisions.
How To APPLY
■ This form is to be used by an applicant as a guide in determining what constitutes a
complete application for Process I, Directors Approval.
• All checked items must be submitted to constitute a complete application.
r Process I applications that contain all checked items will be determined complete
at intake. The applicant or agent will be notified immediately if an application is
considered complete.
A complete application does not imply compliance or conformance with
applicable codes.
