Dear Mr. Ivanchuk:
This letter responds to your request to waive the required street improvements along S 337th St,
which abuts the above -referenced property. After evaluating the existing conditions along the
referenced street, review of Federal Way Revised Code (FWRC) provisions (Section 19-135),
and direction provided by the City Council, the Public Works Department hereby modifies the
requirements for street improvements.
Code Section (FWRC) 19-135.070 Modifications of Improvements Along Property Frontage
allows the Public Works Department to grant a request to modify, defer, or waive the required
street improvements only after consideration of four specific reasons. The reason most
applicable here is contained in FWCC Section 19-135.070(1), "Improvements as required would
not be harmonious with existing street improvements."
S 337th Street is classified as a local street, corresponding to Federal Way Roadway Section "W".
This roadway section requires a 24-foot paved roadway, a four -foot planter strip, a five-foot
sidewalk, and a three-foot utility strip, all within a 52-foot right-of-way. Application of the
required street improvements would result in an improved street section that is not harmonious
with existing street improvements, which consists of an 18-20-foot paved roadway within a
68-foot right-of-way. The applicant is required to widen the road as necessary along the property
frontage to meet a minimum width of 20 feet for safety purposes. The property frontage and
right-of-way must be staked in the field and verified by City staff. If improvements are required,
staff will direct you as to whether a plan and cross-section are required.
The applicant must also execute a City of Federal Way Local Improvement District Waiver of
Protest Covenant (`No -Protest LID'), in the event a future LID is formed to bring S 337, Street
up to require standards. The No -Protest LID document will be sent under separate cover and
must be signed, notarized, and returned to the City prior to issuance of a building permit.

The conditions of this right-of-way modification will be applicable for a period of one year from
the date of this letter. If a building permit is not issued within the one-year time limit, this
waiver will be void and a new request for modification must be submitted.

The applicant is building a new single family home on an undeveloped parcel and requests that
frontage improvements be waived along his approximately 65' of frontage on S 337 h Street.
Staff Analysis
S 337 h Street is a type "W" street requiring 24' of pavement with 4' planter strip, 5' sidewalk,
and 3' utility strip on both sides, within a 52' right-of-way.
The existing street is paved 18-20' wide with a ditch on the south side. It is unevenly crowned,
with very little longitudinal slope, and located within a right-of-way that is approximately 68'
wide. Water meters and/or fences may need to be moved if improvements are required.
Surrounding topography is relatively flat.
Code section 19.135.070 criterion #1, "the improvements as required would not be harmonious
with existing street improvements, would not function properly or safely or would not be
advantageous to the neighborhood or City as a whole" is the reason that most applies in this case.
Requirements / Conditions of Approval Curb, gutter, sidewalk, planter strip, and street
widening beyond 20 feet would not be harmonious with the existing street improvements and are
waived, with the condition that the applicant must provide a minimum of 20 feet of pavement
width along the property frontage. South King Fire approved this modification request, with the

Dear Ann,
A modification request to defer the Frontage improvements is being submitted by LL
Management.
A ROW permit will be obtained to install the road approach prior to construction.
.In response to your comments of April 27, 2017 I have made the following revisions:
1. For the dispersion trench, show setbacks from the building and property lines.
Dispersion trenches must be a minimum of 10 feet from any building and 5 feet from
property lines. -
The 5 foot building setbacks are shown on the plan. A 41 foot dimension is shown
between the house and the dispersion trench. Note added on dispersion trench setbacks.
2. Orange construction fence (or orange silt fence) must be provided along clearing limits. —
Orange Construction fence added to Erosion Control plan and note added to
Drainage plan.
3. Provide a detail of the pervious concrete. —Pervious Concrete Pavement Detail added
per C.2.7.2
