The Process I MLU application is hereby approved as it meets review criteria set forth in Federal Way Revised Code (FWRC) 19.55.020. The Director's conclusions are based on findings made by the Department's Planning Division. CONCLUSIONS Various sections of the zoning and development code indicate that certain developments, activities, or uses are permitted only if approved using Process I — Director's Approval. Based on the findings below, the proposed improvements to the developed site meet the following Process I approval criteria and land use review thresholds of FWRC 19.15.030 and 19.55.020: The proposed improvements are consistent with applicable chapters of FWRC Title 19 including, but not limited to: Permits and Review Processes; Process I — Director's Approval; Community Design Guidelines; and Single Family Residential (RS9.6). The health, safety, and welfare of the citizens of the city are preserved. The proposal is a minor improvement, modification, or addition to a site that is exempt from SEPA review. FINDINGS OF FACT 1. Proposal — The applicant proposes to build a play area for children. The play area includes play equipment such as swings, teeter -totter, climbing dome, and benches. The location is behind the existing church and away from the main car traffic, located near the Sunday school classrooms. No required parking or landscaping will be removed. 2. Zoning Designation and Use —The subject property is zoned Single Family Residential (RS9.6). There is an existing church and private school on the property. The play area is accessory to the school use subject to the requirements of FWRC 19.200.090, Schools. Play Areas — Per FWRC 19.200.090(3), the outdoor play area must contain at least 75 sq. ft. of play area per child using the area at any one time. The play area must be completely enclosed by a solid fence at least six feet in height. On average, the school has 15-20 kids and the play area is 2,000 sq. ft. It will also be fully fenced for the safety of the children. Ms. Nalivayko Page 2 September 3, 2014 4. Critical Areas — There is an off -site Category I wetland to the east and the associated 200-foot wetland buffer extends onsite. The proposed play area is within the 200-foot wetland buffer; however, the area has always been impacted by a building or gravel parking over the years. King County records and images from Google Earth indicate there was a portable classroom in the proposed playground area, approved prior to city incorporation. The building has since been removed and is used as overflow parking. The site is currently a mixture of sand, gravel, and grass. The proposed play area has been permanently altered and no longer functions as a wetland buffer. There is also an asphalt parking lot between the Category I wetland and the play area. As proposed, the play area does not create any more impact to the wetland buffer than what currently exists. APPEALS The effective date of this decision is September 6, 2014, or three days from the date of this letter. Pursuant to FWRC 19.55.050, any person who commented on the application or requests a copy of this administrative decision may appeal the decision to the Federal Way Hearing Examiner by September 20, 2014. Any appeal must be in the form of a letter delivered to the Community Development Department with the established fee. The appeal letter must contain a clear reference to the matter being appealed and a statement of the alleged errors in the Director's decision, including the identification of specific findings and conclusions made by the Director disputed by the person filling. However, in that you are the only party of record, your appeal period is waived (assuming you do not wish to appeal this decision). Waiver of the right to appeal does not affect the effective date of this decision. CLOSING This decision shall not waive compliance with future City of Federal Way codes, policies, and standards relating to this development. This Process I approval is valid for one year from the effective date of this decision. If no further action is taken within one year, this decision will expire. Per FWRC 19.15.110, a two-year extension may be granted if a written request is submitted to the City's Community Development Department at least 30 days prior to the expiration of the decision. He is asking if we could look at the area next to the area we proposed- similar size. We would use the section that is to the right of the trees- about 2000 square feet. Looking through old aerial photos on Google earth it appears the area proposed for the playground has been used as a parking [ot for a while. It also looks like maybe there was a building at one point when it was a school. If you can provide more evidence that there was an approved building and/or parking in this area prior to city incorporation (contact King County to see if they have the original site plan for the school) then it can be determined that the wetland buffer has been permanently impacted prior to adoption of any Critical Area Ordinance and the playground area would not cause more impacts. Then we will continue review on the playground as proposed with no other review necessary. 2. If it cannot be determined that this area has been impacted prior to incorporation then the current critical area regulation are applicable and no improvements are allowed within the buffer. However, through a land use Process III review, the city may reduce the standard wetland buffer width by up to 50% with buffer reduction. I have attached our Critical Areas Direct Services application. We have a rotating list of consultants that can help with this process. Look over the handout and if you wish to utilized this program then you can use the city's on -call consultants to help with a buffer mitigation plan per FWRC 19.175,040(5) Buffer reduction.
